I]IvI 1 Odc 1il%R'CS VIA CERTIFIED MAIL COPY RE: ZONING ORDINANCE VIOLATION — ILLUMINATED AND FLASHING Dear Sir or Madam: This letter is being provided to inform you that a temporary sign(s) violation has been brought to this department's attention. The sign(s) advertises for the tobacco store at 444 South Rangeline Road, in the City of Carmel, a property listed under your ownership. Signs are not permitted to flash, scroll, or move in any manner. According to Section 25.07.01-4 Prohibited Signs, of the Carmel/Clay Zoning Ordinance the following sign(s) are prohibited: e) Signs which move by design or have a major moving part. Furthermore, only one window sign per tenant is allowed by Ordinance. The intent of this section of the Ordinance is to permit businesses to have an open sign, while preventing an unsightly amount of illuminated window signage. Section 25.07.02-12 B Illuminated Window Signs states: 1) NUMBER: One (1) sign per tenant/property owner and may be in addition to any other permitted signs including but not limited to non -illuminated Window Signs. 2) MAXIMUM SIGN AREA: Three (3) square feet 3) LOCATION: As per definition of Window Sign. 4) DESIGN: No restrictions except for those signs which require approval by the Commission. However, signs in Unified Centers must be of a similar design and style of construction. 5) ILLUMINATION: Permitted. 6) REQUIRED APPROVAL: ADLS approval is required for all permanent signs that are established in a Zoning District and/or Overlay Zone requiring ADLS approval. 7) SIGN PERMIT: Required. 8) FEES: Required. This letter shall serve as the first and final warning for this type of violation. A reinspection of the property will occur on Monday, October 12, 2009.
