Roberts 426 Emerson Road Carmel, IN 46032 Cityof Carmel DEPARTMENT OF CONiNIUNITY SERVICES Division of Building• and Code Services VIA CERTIFIED MAIL COPY RE: CARMEL CITY CODE VIOLATION —ABANDONED VEHICLE Dear Sir or Madam: This letter is being provided to inform you that it has recently been brought to the City's attention that at 426 Emerson Road, a property listed under your ownership, abandoned vehicles are being stored on the property. It is a violation of Carmel City Code § 6-114 which states: "Because of the danger to the health from vermin, the danger of personal injury to children attracted by such vehicles, danger of fire by the storage of gasoline and oil thereon, any abandoned, unlicensed, inoperable, disassembled, wrecked or junked motor vehicle on any street or public property for more than five days or upon any private property for more than 15 days, except as hereinafter provided, is declared to be a nuisance and unlawful." Specifically, this letter refers to the green sports utility vehicle that is in inoperable condition and being stored outside the detached garage on the site. If it continues to remain where it is now located further enforcement action may result which can include written citations and the requirement for you to appear in Carmel City Court and the assessment of fines. This vehicle can legally be stored in this condition within a garage. Furthermore, this violation letter is being sent to you because of complaint our office received on July 30, 2009, regarding the possibility of a body shop being operated from the site. While, as of this time, the City of Carmel has been unable to verify the existence or non-existence of such an operation, you should be aware that the operation of any sort of automobile repair from a dwelling is prohibited by the Carmel Clay Land Use Regulations, which, in §25.18, states: 25.18 Home Occupation 25.18.01 Standards Generally. A. Floor Area: Home Occupations shall utilize no more than fifteen percent (15%) of the gross floor area of the dwelling. B. Character: 1. The Home Occupation shall not change the character of the Dwelling, Lot orparcel; 2. The Dwelling shall not bear any indication from the exterior that it is beingutilized in whole or in part for any purpose other than a Dwelling; 3. The Home Occupation shall not be permitted outside storage or display ofmaterials in connection with the Home Occupation; 4. The Home Occupation shall not be permitted signs other than those normally permitted in the district in which the Home Occupation is located. C. Nuisance: The Home Occupation shall be conducted wholly within the Dwelling, such that there is no outside noise, vibration, odor, smoke, dust, glare or electrical disturbance. D. Employees. The Home Occupation shall employ no more than one (1) individual outside of the immediate family. E. Deliveries. The delivery of any materials for the Home Occupation will not exceed two (2) trips per day by any vehicle not owned by a family member. F. Equipment. The Home Occupation shall utilize only mechanical equipment that is customarily used for domestic purposes and is of a size and type that is similar to domestic mechanical equipment or is customarily found in a business office. 25.18.02 Excluded Uses: A. antique or gift shop; COPY B. serving of food or beverages; C. animal hospital or commercial kennel; D. automobile repair; E. major appliance repair or services; and F. any processing or manufacturing that produces noxious materials or products. At this time, several site investigations have been performed, and numerous vehicles have been observed on the site in various states of repair. This letter serves to inform you of these home occupation standards and to alert you to the fact that the City of Carmel will continue to aggressively pursue enforcement action on the subject site, should it become evident that an illegal home occupation is taking place on the site. Should a violation of the above -referenced home occupation standards be found, citations will be written, summoning you to appear in Carmel City Court. Please either relocate the inoperable vehicle as directed or remove it from the property by August 27, 2009.
