A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AMENDING THE CARMEL CLAY COMPREHENSIVE PLAN "C3 PLAN 2009" REGARDING
BROWNFIELDS
WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained m IC 36 7 4)
each unit of local government that wishes to adopt land use and Toning ordinances must first approve by
resolution a comprehensive plan for the geographic area over which it has jurisdiction and
WHEREAS, I C 36- 7 -4 -01 provides that a Comprehensive Plan be approved by Resolution in
accordance with the 500 series for the promotion of public health safety, morals convenience order or the
general welfare and for the sake of efficiency and economy in the process of development, and
WHEREAS the Carmel Clay Comprehensive Plan "C3 Plan 2009" Docket No 08070020 CP was
given a favorable recommendation by the Carmel Advisory Plan Commission on November 18, 2008, and duly
approved by Resolution No CC -03 04 -09 -02 of the Common Council on May 4, 2009, and was certified by the
Caramel Plan Commission on May 20, 2009, and is therefore the official Comprehensive Plan of the City of
Carmel and Clay Township, and
WHEREAS, the Carmel Advisory Plan Commission voted to certify Comprehensive Plan Amendment
Docket No 09080022 CPA with a favorable recommendation to the Common Council on September b 2009,
NOW, THEREFORE, BE iT RESOLVED by the Common Council of the City of Carmel Indiana
that
Section I The Common Council hereby adopts the Brownfields Redevelopment Resolution Comprehensive
Plan Amendment into Part 2 Comprehensive Plan Essence City-Wide Policies and Objectives, as follow s
Objectn e 715 Due to increasing interest in redeveloping previously developed areas the
City would like to conduct inventones analyses and cleanups of its brownfields This
will serve to facilitate redevelopment in several areas as well as making the City healthier
and more sustainable The City will also be working with citizens and professionals to
identify and pnontize brownfields
Section 11 After its adoption this Resolution shall be filed in the office of the Clerk Treasurer of the City of
Carmel who shall also forward one (1) copy of this Resolution to the secretary of the Carmel Advisory Plan
Commission and one (1) copy to the office of the Hamilton County Recorder, all in accordance with IC 36 7 4-
509 and other applicable laws
Section III This Resolution shall be in full force and effect from the date of passage and its publication as
provided by law

Commission (Docket No 09080022 CPA) to amend the Carmel Cla% Comprehensive Plan
(C3 Plan 2009) in order to piovrde for brownfield redevelopment
The Carmel Advisory Plan Commission's recommendation on the petition is FAVORABLE
At its legullr meeting on September 15 2009, the Commission voted nine (9) in Favor one (1)
Opposed (Rick Ripma), zero (0) Abstaining, to forward to the Common Council the proposed
Resolution CC- 10- 05 -09 -01 with a Favorable Recommendation
