City of Cannel DEPARTMENT OF COMMUNITY SERVICES Division of Building and Code Services October 7, 2009 Kroger Limited Ptn I Real Estate Dept 5960 Castleway Dr. W Indianapolis, IN 46250 RE: ADLS VIOLATION — KROGER Dear Sir or Madam: VIA CERTIFIED MAIL COPY This letter is being provided to inform you that it has recently been brought to the Citys attention that the exterior of the structure at 1217 S Rangeline Rd., a property listed under your ownership, has been altered without Plan Commission approval. This property is zoned B3, a business district. As per §14.00.02.B of the Carmel Zoning Ordinance... Architectural Design, Exterior Lighting. Landscaping and Signage. To insure the compatibility of the proposed use with adjoining areas, the Commission shall review the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) application of any proposed use of any Lot or parcel of ground within the B-3 District prior to the issuance of an Improvement Location Permit by the Department. Once approved by the Commission the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) shall not be materially or substantially changed or altered without the prior approval of the Commission. Y Recently, a new video vending machine was placed in the walkway at the front of the structure. As I such, the change requires an ADLS Amendment to be permitted. Please contact Mike Hollibaugh, Director of the Department of Community Services, at (317) 571-2417 for more information and the process for applying for the ADLS Amendment. The next deadline to file for ADLS Amendment is October 22ntl, 2009. Failure to comply by that date will result in further enforcement action, including the issuance of written citations and the requirement to appear in Carmel City Court.
