These issues include awning signage, submission of an updated landscape plan showing revisions for ADLS review, and the issuance of a final Certificate of Occupancy. Approved awning signage for your property by the Carmel Board of Zoning Appeals stipulated (as your plans indicated) that two (2) awning signs be placed on the front of the property, and two (2) awning signs be placed at the back of the property. This approval was pursuant to a Development Standards Variance petitioned by Frederick Simmons for ` your property. Currently, all four (4) awning signs are placed on the front of the building, and therefore, are in violation of the Variance agreement. Daren Mindham, Urban Forester for the City of Carmel, has indicated that your property/business has not submitted an updated landscape plan showing building and landscape revisions to the Department of Community Services for ADLS review. Therefore, a final Certificate of Occupancy has not been issued to the property. Carmel City Code stipulates the following under §7-20 Certificate of Occupancy or substantial Completion: and; (a) No certificate of occupancy for any building or structure erected, altered, or repaired after the adoption of this section shall be issued unless such building or structure was erected, altered or repaired in compliance with the provisions of this Code. (e) Temporary certificates of occupancy must be abated within the prescribed time limit or late fees per Chapter 10 of the City Code will apply. Additionally, the location of illuminated window signs in your windows is not permitted per Section 25.07.02-12 B Illuminated Window Signs states: 1) NUMBER: One (1) sign per tenant/property owner and may be in addition to any other permitted signs including but not limited to non -illuminated Window Signs. 2) MAXIMUM SIGN AREA: Three (3) square feet 3) LOCATION: As per definition of Window Sign. 4) DESIGN: No restrictions except for those signs which require approval by the Commission. However, signs in Unified Centers must be of a similar design and style of construction. 5) ILLUMINATION: Permitted. 6) REQUIRED APPROVAL: ADLS approval is required for all permanent signs that are established in a Zoning District and/or Overlay Zone requiring ADLS approval. 7) SIGN PERMIT: Required. 8) FEES: Required. These issues must be addressed immediately. Remove the illuminated window signs permanently. Since you have previously been notified of the need for ADLS plan review, and for the issuance of the Certificate of Occupancy (Daren Mindham; RE; Building Permit #04010146) you will be given thirty (30) days to: (1) change awning signage as per Variance agreement and approved plans; and (2) contact Daren Mindham (317/571-2417: 8:00 a.m. — 5:00 p.m.) and begin the process for ADLS plan review, and for attainment of the Certificate of Occupancy. All of this MUST be achieved by May 31, 2008. Failure to do so will result in the issuance of daily citations until all issues are in compliance.
