Indianapolis, IN 46280 RE: ZONING ORDINANCE VIOLATION — LAND USE Mr. & Mrs. Hunter, This letter is being provided to inform you that our department has recently received some concerns regarding 2201 99°i St. E. in Clay Township, a property listed under your ownership. This property is currently zoned residentially (R1), which does not permit for business operations to be run from the property. The only standards that permit for a business to be run from a residential property are the Home Occupation standards of §25.18 of the Carmel Zoning Ordinance (see Enclosed). The presence of transportation vehicles and trailers, port-o-lets, and other such equipment found at your property upon investigation are in direct violation of the Home Occupation standards, and in particular the Character (25.18-B) provision(s) of the ordinance. This Land Use violation must be corrected by August 4, 2007. Failure to correct these violations will result in daily citations being issued until the property is determined by Department of Building and Code Services staff to be in compliance. The inspection at your property also revealed a violation of the Carmel City Code §6-77(k), which construes the following conditions to be public health nuisances: (k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building materials, machinery, dead trees, or parts thereof, upon any premises in a residential area. Metal poles, truck bed liners, loose bricks, pallet(s), a tree stump, tires, boxes, etc., were found on the property in violation of the cited ordinance. These violations must also be brought into compliance by August 4, 2007 in order to avoid escalation of compliance measures.
