RE: Use Variance College Park Church Temporary Modular Classrooms
Dear Mr. Peterson:
We have reviewed the use variance request for this project and have the following comments:
1. The proposed project falls in the unincorporated area and MS4 jurisdiction of
Hamilton County.
2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone.
3. The proposed project falls in the Fitch and Jessup Regulated Drain Watershed.
4. Since the trailers are being proposed over existing impervious surface, the existing
detention facilities in place are sized appropriately and there will be no increase in
runoff to the Fitch and Jessup Regulated Drain.
5. Hamilton County Surveyor's Office has no objections to the use variance.

I met with Angie earlier this week to discuss a significant building and parking addition to the College Park Church. We
have not calculated it yet but it will be close if not over the 35% coverage for the proposed project. A similar building
expansion had been previously approved a few years ago but never constructed. Their current existing facility is much
smaller and the coverage percentage should not be in question.

I'm not sure I understand the question. If the lot coverage is more than 35 then there should have been a variance to
allow for that.
Are you saying that there were previous special use approvals that overlooked or ignored this requirement?

The site has multiple variance and special use amendment approvals. There are no variances for increasing the
percent of lot cover more than 35 due to Tots of impervious parking, that I can see. The church may need to
request that variance at the next BZA meeting to get that all straightened out... Or maybe it was considered as
approved, since the special use amendment was approved multiple times and those site plans did show the
parking areas... I have copied the BZA attorney on this email to see what we can do.
There was a variance in 1996 to have a building that was 30 -ft tall, but today's ordinance allows for a building
that is 35 -feet tall. The height is measured from halfway between the ridge and eaves of a roofline. And there
was a variance to have a building addition 5.5 feet taller than the maximum building height, in 2003.

Dear Mr. Peterson:
The following letter represents comments for this project specifically addressing the area of alternative
transportation. I have reviewed the project submitted for the October 21, 2009 Technical Advisory Committee
meeting and the comments from the Alternative Transportation review have been satisfactorily addressed.
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re- submitted, particularly if
any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other committee meetings.
The Department of Community Services reserves the right to provide additional comments based on subsequent
reviews.
