The Enclave of Carmel Subdivision, generally, has a Development Standards Variance approval (V- 14c -90) that allows a reduction in the minimum aggregate side yard from fifteen feet to ten (10) feet. The site plan on file shows an aggregate of 8.79 feet (4.71' 4,08'), This will need to be corrected by the applicant. While The Enclave of Carmel Subdivision, generally. has a Development Standards Variance approval (V- 14a -90) that allows a reduction in the minimum front yard from thirty -five feet to twenty (20) feet, there are eight Tots including Lot 33 that have a Development Standards Variance approval (V- 20b -93) that allows a reduction in the minimum front yard from thirty -five feet to fifteen (15) feet. However, The Enclave of Carmel Subdivision, generally, has a Development Standards Variance approval (V- 14d -90) that allows a reduction in the minimum width at building line from eighty feet to forty -eight (48) feet. Therefore. regardless of the minimum fifteen -foot front yard setback requirement on Lot 33, the width of the lot at the building line MUST be a minimum of forty- eight feet From the site plan that is in the file, it does not appear that this requirement has been met. The Division of Building Code Enforcement will contact the builder to apprise him of the need to either revise his plans. or file additional Development Standards Variance applications with the Board of Zoning Appeals. Laurence, We need your interpretation on something. Elliott Wright have submitted plans to build on Lot #33 in the Enclave, The question is regarding the minimum setback. This is a pie shaped lot with plans to build a rectangle house on it. Therefore, at the front of the house, which has been placed with the min 15' setback, there is 4.71' between house and property line on one side and 4.08' on the other side. This is 1.21' less than the required 10 aggregate side yard, but it is only at the corner. As you move back along the side of the house, the side yard quickly exceeds the requirement.
