Petitioner seeks a Special Use Amendment:
SUA -49 -03 03050006 §6.02 three modular classrooms
The site is located at 10721 Lakeshore Drive. The site is zoned S -2 /Residential.

General Information:
The site is located in a neighborhood near 106 Street and Keystone /US 431. The site and surrounding
area is zoned S -2 Residential. The existing land use is an elementary school. The comprehensive plan
shows this area to be a Residential Community Area, with a residential road running along the site.

...CRADLER: Briefly out at
Forest Dale Elementary School the project is already under construction with approvals. The
school needs to add three (3) portable bathrooms on the south side of the building. They will be
there for a year partly because of the current construction and the shifting of students. They need
that space. These will be leased portable classrooms with setup with proper calibrations and tie
downs and removed at the end of the construction period. No other effects on the plans, site plan
or any other layouts. The students will access back into the school...
...HOYT: Just a couple of comments A. Cradler. The fire alarm systems are interconnected to the
buildings so they will go off and the kids in the trailers will know it has been activated in
the building. Please identify each trailer with a number or letter one, two three, A, B
C. So we know what trailer to go to if someone is hurt...

Background Information:
The school had a Special Use
approval in March 2002. They
want to amend that approval, in
order to add three portable
classrooms to the south side of the
school, while new construction is
taking place. The portable
classrooms will be removed
around August 2004, once the
new construction and renovation
project for the school is complete.
The construction and shift in
student enrollment provides a
need for extra classroom space.

Petitioner seeks approval of a 25578- square -foot addition to an existing 78000 square -foot School of
General Elementary Education on 22.251± acres. Petitioner also seeks the following Developmental
Standards Variances:

V -3 -02 ZO 25.7.01 -2 26.83- square -foot Traffic Directional Sign B

Depaitinent recommends favorable consideration of Docket No. SUA -1 -02 conditioned upon the
petitioner working with the Urban Forester to address the Landscape Plan comments in his review letter.
The Department recommends favorable consideration of Docket Nos. V -2 -02 through V -5 -02 as
amended. The Department recommends favorable consideration of Docket Nos. V -6 -02 and V -7 -02.
Pat Rice moved for approval of SUA -1 -02, Carmel/Clay Schools, Forest Dale Elementary,
conditioned upon the petitioner working with the Urban Forester to address his comments contained in a
letter dated March 25, 2002, and supplied to the petitioner at this public hearing. Following a second by
Leo Dierckman, the motion was APPROVED 3 -0...
An alysis:
The addition of three temporary classrooms will ease the congestion of students in each classroom,
allowing for a better teaching environment. These classrooms will be removed once the renovation
project is completed. The modular classrooms will not ruin the aesthetics of the site, because construction
equipment and building materials will also be on site, making it acceptable knowing that these things are
temporary and the final result of a bigger, better school is worth the eyesore now.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: The continued existence of the school with extra
classrooms on this site will not be injurious to the public health, safety, morals and general welfare of the
community.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: It is the Department's opinion that the use and

allowing three portable, temporary classrooms to be placed.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in

years occupied by an elementary school and utilized for institutional purposes. The site would continue
to function in this manner if the 3 classrooms were removed. The Department recognizes that there is a

unique need at the educational facilities Provide the necessary number of temporary classrooms during
expansion.
Recommendation:
The Department recommends favorable consideration of Docket No. SUA- 49 -03.
