FINDINGS OF FACT SPECIAL USE
1. The Special Use in Flood Plain District, Ordinance Z -160, Section 21.6 as amended
does not apply and all prerequisites have been met by Petitioner as verified by:
The site does not fall with a Flood Plain District per the Surveyor's notes included for
reference.
2. The Special Use will be consistent with the Character and Permitted Land Use of the
zoning district and Carmel /Clay Comprehensive Plan because:
This site is an existing elementary school approved as a Special Use within the S -2
zoning district. The portable classrooms are at times required at school sites and
are consistent with the overall use of the site. The portable classrooms in this case
will be temporary installations and removed once the overall construction Project is
complete at the site.
3. The Special Use is physically suitable for the land in question because:
There is sufficient space adjacent to the building for locating the portable classrooms.
The location on the south side of the Project is also the furthest away from any
adjacent residential properties. The location will be within the planned parking area
on the south side and does not affect any other planned amenities on the school site.
4. The Special Use will not injuriously or adversely affect the adjacent land or property
values because:
The location of the portable classrooms on the south side of the building places them
at a location furthest from any adjacent residential properties. There is additional
buffer space between the portable classrooms and the adjacent agricultural field to
the south before any residential properties exist.
The portable classrooms will be temporary and will be removed once the entire
Project previously approved for this site is completed.
5. The Special Use will not adversely affect vehicular or pedestrian traffic flow, nor the
adequate availability of water, sewage, or storm drainage facilities, or police or fire
protection because:
The portable classrooms are located in an area that does not affect any other
planned amenities during the construction process at the site. The classrooms do
not increase the need or create any additional load on the water or sanitary sewer
facilities at the Project site. Electrical service to the portable classrooms can be
supported from the service to the school. Emergency access will be available to the
portable classrooms, and their location does not block any emergency access into
the building.
6. The special use complies with all applicable criteria.

SPECIAL USE APPROVAL REQUEST
7. State Explanation of Requested Special:
Carmel Clay Schools wishes to amend the Special Use Approval obtained in March
2002 in order to add three portable classroom units to the south side of the site.
These portable classroom units are required due to the new construction and
renovation occurring at the school along with shifts in student enrollments. The
portable classrooms will be temporary during the anticipated construction duration.
Once the new construction and renovation Project is complete in August 2004, the
portable classroom units will be removed.
8. State Reasons Supporting the Special Use:
The portable classrooms are required to continue the educational program delivery at
Forest Dale Elementary School during the construction process. The addition of
these units will allow Carmel Clay Schools and Forest Dale Elementary School to
continue to serve the growing elementary student population in the area.
The portable classrooms will be temporary and not impede or alter any current uses
of the Project site.

NOTE:
LEGAL NOTICE shall be published in the Noblesville Daily Ledger a MANDATORY twenty -five (25) days prior to
the public hearing date. The certified "Proof of Publication" affidavit for the newspaper must be available for inspection the
night of the hearing.
LEGAL NOTICE to all adjoining and abutting property owners is also MANDATORY, two methods of notice are
recommended:
1) CERTIFIED MAIL RETURN RECEIPT REQUESTED sent to adjoining property owners. (The white receipt
should be stamped by the Post Office at least twenty -five (25) days prior to the public hearing date.)
2) HAND DELIVERED to adjoining and abutting property owners (A receipt signed by the adjoining and abutting
property owner acknowledging the twenty -five (25) day notice should be kept for verification that the notice was
completed)
REALIZE THE BURDEN OF PROOF FOR ALL NOTICES IS THE RESPONSIBILITY OF THE APPLICANT. AGAIN, THIS
TASK MUST BE COMPLETED AT LEAST TWENTY -FIVE (25) DAYS PRIOR TO PUBLIC HEARING DATE.
