This property is currently zoned residentially (R2), which does not permit for business operations to be run from the property. The only standards that permit for a business to be run from a residential property are the Home Occupation standards of §25.18 and the Sign Ordinance §25.07.02-03 of the Carmel Zoning Ordinance (see Enclosed). The nature of the home occupation standards is to allow a home business to operate with NO visible evidence or impact upon the propertys residential character. Please note, in the attached section of the Carmel Clay Land Use Regulations, automobile repair is listed an excluded use from the Home Occupation Standards. Inspections have been performed periodically on the property since June of 2009. In that time, several vehicles have been noted on the site in various states of repair. At certain times, vehicles have been lifted on jacks, and the vehicle inside of the garage is in a state of disrepair. While, at this time, these observations may not constitute a violation of the Citys ordinances, it would be important to note that investigation will continue on the site. If the case becomes clear that automobile repair is ongoing at the site, the City is prepared to pursue additional enforcement action against you as the property owner, including written citations, fines, and the requirement to appear in Carmel City Court. It is a violation of Carmel City Code § 6-1 l4 which states: "Because of the danger to the health from vermin, the danger of personal injury to children attracted by such vehicles, danger of fire by the storage of gasoline and oil thereon, any abandoned, unlicensed, inoperable, disassembled, wrecked or junked motor vehicle on any street or public property for more than five days or upon any private property for more than 15 days, except as hereinafter provided, is declared to be a nuisance and unlawful." These 2 vehicles located in your driveway can be stored inside a completely enclosed garage legally. If they continue to remain where they are now located further enforcement action will ensue, including having the vehicles towed from the property. Please either relocate the vehicles as directed or remove them from the property by May 23, 2009.
