The purpose of the waiver is to allow the sidewalk to be located outside of the right -of -way. Connectivity provided by the sidewalk is retained in our waiver request. Approval of the waiver simply allows the sidewalk to meander through an adjoining common area to provide a safer route and more pleasurable experience for users of the sidewalk. We believe that the location of the walks provides safe, attractive connections of the neighborhood to the asphalt pathway along 141S Street by routing the walk through the common area away from the street entry to the community. This alignment reduces the vehicular /pedestrian conflicts at the entry drive the place with the highest concentration of cars in the neighborhood. The realignment of the walks has also allowed us to create a distinctive neighborhood entry with a different feel than standard subdivision entries.
