Docket No. 09080023 PP: The Cottages at Carmel Primary Plat The applicant seeks plat approval for 40 lots on 6 acres. Also, subdivision waivers requested are: Docket No. 09080024 SW SCO 6.03.20: no private streets permitted Docket No. 09080025 SW SCO 6.05.01: minimum lot width of 50 -ft at street R/W Docket No. 09080026 SW SCO 8.09.01: sidewalks on both sides of street required The site is located at 531 S. Guilford Rd. and is zoned B -7 /Business. Filed by Justin Moffett for Highline Construction, Inc. The development plan, architecture, landscape plan, signage, etc. were all reviewed and approved by the Plan Commission in December 2007. Now, the petitioner is back before you for approval for a primary plat with waivers; the developer has withdrawn the application for a Horizontal Property Regime (HPR) to sell condominiums, due to national mortgage lending issues with that type of set -up. Please refer to the petitioner's informational packet for further detail. The following development standard variance requests will be reviewed and voted upon by the Board of Zoning Appeals on October 26: Reduction of minimum setbacks for side yard, aggregate side yard, and rear yard, Reduction of lot widths and minimum lot sizes, and Increase in maximum lot coverage. Comments /Concerns: 1. The Dept of Engineering has no major issues with the plat, since private streets were reviewed with the original DP /ADLS approval and with the HPR application, and they really cannot retrofit the site to bring the private streets up to City standards for public streets. 2. The Forestry Dept has no issues with the plat, since the landscape plan was approved with the DP /ADLS petition. 3. DOCS needs all documents associated with the public notice: affidavit, green cards, adjoiner list, etc. The Dept of Community Services (DOCS) recommends that the Commission suspends its rules of procedure this evening, and vote on these items.
