The purpose of TAC is to discuss the technical aspects of the constructed infrastructure and since this was already accomplished through TAC for ADLS we should be fine. Now we're just working with the legal aspects of lot ownership so I'd hope we wouldn't lose a month for not having the legal drawings finished for TAC members. While I cannot guarantee your item a place on the Sept 16 TAC agenda, there is good probability, since the plat relates to a prior DP /ADLS petition that the TAC members reviewed a while ago. Please have Jim Shinaver also contact John Molitor,20the plan commission's legal counsel; he may be able to help answer the question about the DP possibly serving as the Primary Plat.....his contact info is JMolitor @prodigy.net and (317) 843 -5511. Weihe does not have the plat drawings done yet and if you don't mind I will supplement the application in the next 10 days or so. All of that said, Gary Duncan has advised us that he sees these roads as private roads. Shinaver's office will be contacting Mike to determine whether or not our original approval through the ADLS/DP process meets the same legal requirements as a preliminary plat. They think that it might, in which case we would withdraw all or a portion of our applications. Please let me know if there are any other steps we need to take for the application tomorrow.
