AND CITY CODE VIOLATION— NO VALID PERMIT / CONSTRUCTION WITHIN EASEMENT Dear Sir or Madam: This letter is being provided to inform you that this Department has some concerns regarding the condition of the property and as well as the safety of the structure located upon the property at 10310 North Delaware Street, a property listed under your ownership. On August 4, 2009, a simple site visit was performed which revealed construction of a detached accessory structure has begun without the issuance of a valid building permit, the review and approval of site drawings and building plans, and completed and passed inspections. Please be advised that Section 29.04.02 of the Carmel/Clay Zoning Ordinance, as well as Section 7-9(a) of the Carmel City Code refer to the necessity of acquiring the required building permits: § 7-9 Application for Permits and Builder Information. (a) It shall be unlawful for any person or entity to construct, alter, repair, remove or demolish any building or structure, or to commence construction or the alteration of real estate, without first filing a written application with the Director and obtaining an improvement location permit or other appropriate permit regarding same, unless the submission ofsame is expressly excused by applicable law. After a review of the plat map of the property, it appears that there is a five-foot easement that runs across the back of the property. According to section 25.01.01(B)(3)(b) of the Carmel Clay Land Use Regulations, no part of any accessory use may be built within three feet of an easement: b. Minimum Side and Rear Yards. i. When more than ten (10) feet from a Principal Building, Accessory Buildingsvand Uses shall be set back a minimum of the greater of the following: (a) Five (5) feet, or ONE CIVIC SQUARE CARMEL,INDIANA46032 317/571-2417 (b) Easement plus three (3) feet, but not within any Easement or required landscaped or greenbelt area. (c) No fill from any excavation may be placed within the Easement. Because the foundation of the building lies in the easement, there are two options for remedying this situation. Either the portion of the foundation that lies within the easement, and also within three feet of the easement, must be removed and restored to its natural vegetative state. Or, the encroachment must be legalized by a Consent of Encroachment from the Board of Public Works. Should you wish to pursue the Consent of Encroachment, you will need to speak with the City's Engineering Department at 571-2441. Please be advised that failure to perform one of the above -referenced options by November 30,2009, will result in further enforcement action, including the issuance of written citations and the requirement to appear in Hamilton County Court.
