1800 106 Street West, Carmel, Indiana 46032
The City of Cannel is seeking a Development Standards Variance on behalf of the property owner, 1800 106
Street Partners, LLC, to reduce the minimum front yard requirements. Purchase of additional right -of -way
along 106 Street will reduce the front yard to 15 feet. However, current zoning of this property as S -1/
Residence requires a front yard of at least 40 feet. The granting of the proposed Variance should alleviate the
property owner of potential undue hardship in future matters associated with the reduced front yard.
The Department respectfully requests approval of this Development Standards Variance request.

FINDINGS OF FACT DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:

2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The City's purchase of right -of -way to install a bike path will cause a reduction in the front yard. Requesting
variance approval for new front yard setback to be legally established
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
The building on this site will become illegally non conforming if the variance is not granted, not due
through any fault of the property owner.
DECISION
IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
