Dear Jon:
As per our conversation, the above variance request is not necessary, as the garage set back requirement
under the Character Subarea within the Historic District Overlay does not apply to new construction but, instead,
only applies to renovations. As a result, the townhomes which are considered new construction in the Character
Subarea do not require. a variance from the garage set back requirement set forth in the Character Subarea.
Consequently, as per your recommendation, we are hereby withdrawing the above referenced variance request.
Notice to the surrounding property owners has gone out which notice omits reference to the above referenced
variance. As I indicated to you in our earlier conversation, the notice to the paper did contain a reference to the
above- referenced variance, and that notice has already been published. However, as you_instructed, inclusion of
the above referenced variance in the notice published in the Indianapolis Star should not be a problem.
Should you have any questions regarding the foregoing, please do not hesitate to contact me. I

I an anticipating a favorable decision of the Plan Commission on October 21, 2003. Therefore,

applications: SU- 82 -03, V -83 -03 and V- 84 -03. I am forwarding to the Indianapolis Star for
timely publication the enclosed Notice and in addition am mailing a copy of the enclosed Notice
to each adjoining property owner as set forth on the attached list prepared and certified by the
Auditor of Hamilton County. I will prepare and deliver informational packets for distribution to
each member of the Board of Zoning Appeals no later than November 12, 2003, and will provide
