FRONTAGE RD General Information: The petitioner would like to vary the sign requirements of the PUD ordinance Z- 386-02 (Clay Terrace Development). The provision in Section 10.3.0 for center identification ground signs would be changed to allow 21 pedestrian signs, as approved on the sign site plan, total on -site and to increase the signs' height from 5' to 10'9". The provision in Section10.3.D for wall signs would be changed to a new formula to determine maximum sign area and to allow specific wall sign types as approved by the Plan Commission previously on July 15, 2003 (Docket No. 19 -03b ADLS). The provision in Section 10.3.C.2 for US 31 Center Identification Ground Sign would be changed to increase the height of the sign from 7' to 11'11". This sign design has also 4 been changed from the design that was approved the first time to the design that was approved by the Plan Commission on July 15, 2003 (Docket No. 19 -03b ADLS). The provision in Section 10.3.C.1 for two Center Identification Signs would be changed from 6' to 7'5 This sign design has also been changed from the design that was approved the first time to the design that was approved by the Plan Commission on July 15, 2003 (Docket No. 19 -03b ADLS). Background Information: (Excerpt from the July 15, 2003 Plan Commission Meeting Minutes): li. Clay Terrace (Development Signage) Docket No. 19 -03b ADLS; The applicant seeks approval an overall signage plan for the Clay Terrace development. The site is located at the southwest corner of US Highway 31 and East 146 Street. Filed by Mark Jong of Lauth Property Group. Paul Reis, 5013 Buckeye Court, Carmel, attorney for the applicant, appeared before the Plan Commission. Also in attendance was Joe Downs, Vice President of Development Operations for Lauth Property Group. The petitioner presented the sign package for Clay Terrace to the Special Study Committee on July first. The sign package covers both the overall development signage within the development as well as tenant signage package wherein all tenants must comply. In the course of the review, the Committee requested that the petitioner provide designated areas for bicycle parking together with the appropriate signage for that use, and the petitioner agreed to do so. The Committee voted a favorable recommendation to return this item to the full Commission. Dianna Knoll reported for the Committee. There have been many meetings and review of this proposal and the petitioner has been very workable in meeting the Committee's requests. The Committee voted 7 -0 to return this item to the Commission with a favorable recommendation. Jon Dobosiewicz said the Department is recommending approval of the ADLS as revised and forwarded by the Committee. Ron Houck moved for approval of Docket No. 19 -03b ADLS, Clay Terrace; seconded by Wayne Wilson and APPROVED 10 -0. (July 1, 2003 SS Committee Meeting Minutes not available.) Analysis: Instead of doing a one -time amendment to the PUD ordinance Z- 386 -02, the petitioner would like to bring 10 variances to the Board. If approved, these variances will allow the Clay Terrace Development the signs approved by the Plan Commission in the approved signage portion of the ADLS. 5 Findings of Fact: Entry Monument Signs 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: The existence of two entry monument signs on this site will not be injurious to the public health, safety, morals and general welfare of the community. It will aid in identifying the shopping center. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by allowing the two entry monument signs. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The strict application of the Zoning Ordinance will not result in practical difficulties in the use of the property. Findings of Fact: US 31 Monument Sign 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: The existence of one US 31 Monument Sign on this site will not be injurious to the public health, safety, morals and general welfare of the community. It will aid identifying the shopping center for US 31 passersby. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by allowing one US 31 Monument Sign. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The strict application of the Zoning Ordinance will not result in practical difficulties in the use of the property. Findings of Fact: Tenant/Pedestrian Signs 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: The existence of many Tenant/Pedestrian Signs on this site will not be injurious to the public health, safety, morals and general welfare of the community. It will aid in directing patrons within the site. These signs were approved by the Plan 6 Commission on July 15, 2003, Docket No. 19 -03b ADLS (Clay Terrace Sign package). 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by allowing the Tenant /Pedestrian Signs. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The strict application of the Zoning Ordinance will not result in practical difficulties in the use of the property. Findings of Fact: Wall Signs 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: The existence of Wall Signs on this site will not be injurious to the public health, safety, morals and general welfare of the community. It will aid in directing patrons on -site. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: It is the Department's opinion that the use and value of the area adjacent to the property will not be affected in a substantially adverse manner by allowing the Wall Signs approved by the Plan Commission on July 15, 2003, Docket No. 19- 03b ADLS. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The strict application of the Zoning Ordinance will not result in practical difficulties in the use of the property.
