Dear Jon:
Enclosed please find a copy of the Letter of Grant you sent to me for the above
matter. Please note, the last paragraph refers to "Section 25.07.07: Sign Permits... I
believe you meant to refer to Section 26.2.7 of the Zoning Ordinance regarding the 25 foot
garage set back. I was hoping you could revise the content of the Letter of Grant to refer to
the garage set back provision of the Zoning Ordinance. Please give me your thoughts.

At the meeting held Monday, October 27, 2003, the Cannel/Clay Advisory Board of Zoning Appeals took the following
action regarding the Development Standards Variance (V) filed by you for property located at Cherry Tree Road and
Hazel Dell Parkway.
APPROVED: Docket No. V -99 -03 Development Standards Variance. The Board voted three (3) in favor, taro (2)
apposed, thereby approving the petition.

Please be advised that per Sec on 25.07.07: Sign Permits of the Ordinance, e signs roved pursuant to
the aforementioned Developm dards Variances must be eir shed within one ear. The expiration date
of the approvals is October 27, 2004

Application to. Replat. With respect to the Application for Developmental Standards Variance,
please- place the request on the meeting of the Board of Zoning Appeals scheduled to occur on
October 27, 2003, and confirm for me that it would be acceptable to go to TAC on October 15, 2003.
With respect to the Application for Replat, please place the request on the agenda of the meeting of
the Plan Commission scheduled for November 18, 2003, and confirm for me that replatting is a
noticed public hearing before the Plan Commission.
