right -of -way along the south end of the project that we thought would be vacated prior to plat recording. However, the

Dear TAC Members,
Included with this memo are secondary plat drawings and the first four pages of the site construction
plans for The Cottages at Carmel at 531 S. Guilford Road. This project was previously known as
"Guilford Patio Homes" when we went through the TAC process for our ADLS /DP approvals in
2007/08. We also noticed TAC members on September 3, 2009 when we submitted our preliminary
plat.
You may remember that we previously explained that there are no substantive changes made to the
project from what was previously approved through the ADLS /DP process and what was previously
reviewed by TAC members. All of the site work for this project is completed and we are now building
units. Therefore, we are not required to attend the TAC meetings but are submitting the secondary
plat drawings to TAC members if they desire to further review the project. Keep in mind that the
changes we are making are to the ownership of land and not the facilities that have been approved
and constructed already.

See the email below from Brady Kuhn at Weihe about the missing sidewalk. Regarding the northern path that would act
as a sidewalk connector were willing to do it but we need to add it when unit #23 is built because our foundation overdigs
will enevitably tear things up.

No sidewalks are shown on the Secondary Plat. They are not required to be shown on this document. I believe Angie is
referring to sidewalk locations on Primary Plat. We removed the north south sidewalk along the rear of 15 -23 at your
request prior to submitting the Primary Plat. We then added a sidewalk on the color exhibit along the front of 15 -23 on the
color exhibit for Plan Commission, but did not update the Primary Plat with this information. A revised sheet 1 of
the Primary Plat is attached showing the sidewalk that was added.
The street names were changed and reapproved after the construction plans were complete. Attached is the approved
street name and address lists to send to Angie.
Well take care of the rest of the Secondary Plat comments Angie sent yesterday and let you know when they are ready.

day.

RE: Open Pavement Cut Request Guilford Patio Homes
Dear Board Members:
Mr. Jim Shields of Weihe Engineers, on behalf of Uptown Partners, LLC, is requesting approval for an
open pavement cut of the existing pavement located at 531 South Guilford Road to facilitate water line
construction for the Guilford Patio Homes Subdivision.
The attached exhibit indicates the approximate location of the requested open pavement cut, which is
approximately 165' north of the intersection of 226th Street and Guilford Road.
The Department recommends that the Board approve the request open pavement cut and lane
restriction /closure contingent upon satisfaction of the following requirements:
1. In addition to complying with the approved construction plans for the Guilford Patio Homes
project, the contractor shall comply with the provisions of Carmel City Code 6- 227(a)(1), 6 -227
(a)(8), and 6- 227(b).
2. The petitioner understands that approval is granted for the open pavement cut only. All other
items of work shown on the attached exhibit are subject to review and approval by the
Department of Engineering and other Departments of the City as part of a separate approval
process.
3. One lane of traffic shall be maintained in each direction at all times on Guilford Road and the
work shall be restricted to the hours between 9:00 AM to 3:00 PM.
4. Contact with the Department of Engineering to schedule a pre construction meeting and review
of Maintenance of Traffic Plan prior to implementation of constructed systems. The Traffic
Control Plan must conform to standards of INDOT Work Zone Safety Manual requirements. A
minimum 48 hour notification of lane restriction to the Department is required.
5. A contractor currently bonded with the City shall perform the connection to the existing water
line.
6. Flagger shall be used during construction period.
7. Open pavement cut shall be restored in accordance with City Standard Street Cut Patch Repair.

8. The Guilford Road surfacing operation associated with the Guilford Patio Homes project shall
not take place until the work for this open cut is completed.

taking place, buildings that are not served from a commercial power source and in existing areas of buildings
undergoing alterations or repairs that do not result In the removal of Interior wan or ceiling finishes exposing
the structure, unless. there is an attic, crawl space or basement available which could provide access for
building wiring without the removal of interior finishes.
(4) Interconnection. Where more than one smoke alarm is required to be installed within an indviduai dwelling unit in
Group R -2, R -3, R-4 and in dwellings not regulated as Group R 'occupancies, the smoke alarms shall be
interconnected in such a manner that the activation of one alarm will activate all of the alarms in the individual unit.
The alarm shall be clearly audible In all bedrooms over background noise levels with all intervening doors closed.
Exception:
(1) Interconnection is not required In building which are not undergoing alterations, repairs, or construction of any
kind.
(2) Smoke alarms in existing areas are not required to be interconnected where alterations or repairs do not
result in the removal of interior wall or ceiling finishes exposing the structure, unless there is an attic, crawl
space or basement available which could provide access for interconnection without the removal of interior
finishes.
6.227 improvements To The Premises
(a) General

maintenance activities and in accordance wtth•Section §6 -220 (b) (7) of this Code,
(2) No construction activity, installation of improvements or clearing of any vegetation or ground cover shall occur in
areas designated as Tree Preservation Easement.
(3) No construction activity, installation of Improvements or clearing of any vegetation or ground cover shall occur
within a platted or dedicated landscape easement with the exception of additional tree or plant material or other
vegetation with the approval of the City of Carmel Urban Forester.
(4) Excepting those improvements allowed by other codes or ordinances or allowed by a permit from the Board of
Public Works and Safety pursuant to Carmel City Code Section §8-67, no construction or other materials utilized
to improve or maintain the Premises or temporary or permanent Improvements, shall be installed, placed or
stored:
i Within a platted or dedicated drainage, sanitary, utility or other designated easement.
ii Within areas designated as Flood Route.
Within platted or dedicated right-of-way or public ground.
iv Upon, in or under any street, greenway or alley.
v In a manner inconsistent with the provisions of Section §6-222 (b) (16) of this Code.
(5) No person shall alter or modify existing grading or ground surface elevations within easements or rights-of-way at
any time.
(6) No person shall alter or modify existing City of Carmel, public or other improvements within easements or rights•
of•way at any time without proper approvals.
(7) Grading, filling, excavating or any change in the grade of the premises is permitted outside of platted or dedicated
easements or rights-of-way, but shall be acceptable in appearance, shall not cause, create or result in or represent
the potential to cause, create or result in a Detriment and shall not result in the diversion of storm water.

v Provide an acceptable traffic control plan for the work within the right -of -way and obtain Department
of Engineering approval of the Plan prior to commencing the Work in the event that closure of any
lanes of travel of the public street necessary for completion of the work and such closure Is approved
by the Board of Public Works and Safety.
vi Post traffic control devices at the locations on the approved traffic control plan and notification of the
Department of Engineering of such postings at least one week in advance of the start of
construction.
(b) Permits and Bonds
(1) Pursuant to Carmel City Code Section §8.65, the Owner or Responsible Party shall obtain proper permits and post
proper bonds or other performance guarantees required by the City for all work in right-of-way and for connections
to a public drainage system prior to starting the work. Work In the right of-way is subject to inspection and
acceptance by the City.
(2) The Owner or Responsible Party shall obtain all other permits and post all other performance guarantees required
by the City and shall obtain all other permits r n other federal, state or local government agencies having

(3) The Owner or Responsible Party shall provide written approval from the Home Owners Association to the City for
ail proposed installation of new, or maintenance of existing, Improvements If the approval of the Home Owners

(c) Review and Approval
(1) The City, and in some instances the Homeowners Association, depending on the restrictive covenants of
subdivision, reserves the right to review, approve or deny any and all proposed improvements, or modifications to
existing Improvements on the premises, within the right -of -way or within platted or dedicated easements.
(2) The City may provide technical advice to the Owner or Responsible Party for installation of proposed
Improvements or modifications to existing Improvements but assistance will be limited to advice only. The City
assumes no responsibility if the Improvement does not function properly or as intended.
(3) Prior to installing any new, or conducting maintenance of existing, Improvements on the premises, within platted or
dedicated easements or within the right -of -way, the Owner or Responsible Party shall review the covenants for
any restrictions related to the installation or maintenance activities. The City MI not approve installation of
improvements that violate existing restrictive covenants.

RE: Curb Cuts Request Guilford Patio Homes
Dear Board Members:
Mr. Jim Shields of Weihe Engineers, on behalf of Uptown Partners, LLC, has requested approval for two
curb cuts to serve Guilford Patio Homes located at 531 South Guilford Road. This project received
DP /ADLS approval on 12/18/07 under Docket No. 07070059 and HPR approval under Docket No.
08010009.
The proposed south curb cut will serve as the main entrance for said project and is located
approximately 147' north of the intersection of 1260' Street and Guilford Road. The width and return
radii of the curb cut conform to current City standards. There are no alignment issues with this curb cut
as there are no current curb cuts on the west side of Guilford Road.
The proposed north curb cut will serve as one way right out only exit (designated as a private drive) and
additionally serve as emergency vehicle access. This curb cut is approximately 504' north of the
intersection of 126 Street and Guilford Road. There are no alignment issues with this curb cut as
there are no current curb cuts on the west side of Guilford Road in this area also.
The Department of Engineering recommends that the Board approve the requested curb cuts
contingent upon satisfaction of the following requirements:
In addition to complying with the approved construction plans for Guilford Patio Homes, the
project's contractor shall comply with the provisions of Carmel City Code 6- 227(a)(1), 6-
227(a)(8), 6- 227(b) and 6- 227(h).
The petitioner understands that approval is granted for the two curb cuts access only. All other
items of work shown on the attached exhibit are subject to review and approval by the
Department of Engineering and other Departments of the City as part of a separate approval
process.
The northernmost curb out shall be restricted to right -out only access.

RE: Open Pavement Cut Request Guilford Patio Homes
Dear Board Member:
Mr. Jim Shields of Weihe Engineers, on behalf of Uptown Partners, LLC, is requesting approval for open
pavement cuts of the existing pavement of Guilford Road to facilitate sanitary sewer and storm sewer
main extensions to service the proposed Guilford Patio Homes development. The work to make these
connections will require lane closures and lane restrictions of the affected roadway.
The attached exhibit indicates the approximate locations of the work. The southernmost pavement cut
is approximately 122' north of the intersection of 126 Street and Guilford Road. The northernmost
pavement cut is approximately 518' north of same intersection.
The Department recommends that the Board approve the request open pavement cuts and lane
restrictions /closures contingent upon satisfaction of the following requirements:
The petitioner understands that approval is granted for the open pavement cuts only. All other
items of work shown on the attached exhibit are subject to review and approval by the
Department of Engineering and other Departments of the City as part of a separate approval
process.
One lane of traffic shall be maintained at all times on Guilford Road and work shall be restricted
to the hours between 9:00 AM to 3:00 PM.
Submittal to the Department of a Traffic Control Plan for said work conforming to standards of
INDOT Work Zone Safety Manual requirements for review and approval prior to implementing
the traffic control plan.
Fiaggers shall be used during construction periods.
A contractor currently bonded with the City shall perform the connection to the existing
manholes.
Open pavement cuts shall be restored in accordance with Carmel City Standards.
In addition to complying with the approved construction plans for Guilford Patio Homes, the
contractor shall comply with the provisions of Carmel City Code 6- 227(a)(1), 6- 227(a)(8), and 6-
227(b).
Surface overlay of Guilford Road Associated with the development project shall be done after
the proposed open pavement cuts have been restored.

RE: Guilford Patio Homes Stormwater Technical Standards Variances
Mr. Jim Shields of Weihe Engineers, Inc., on behalf of Uptown Partners, LLC, is requesting variances from
the City of Carmel Stormwater Technical Standards Manual.
The Department of Engineering established that the permanent drainage outfall could not be directed to the
north, east or south due to existing drainage history of these areas and the limited ability of these systems to
accept additional runoff. The Department worked with the petitioner to allow the drainage to discharge to
the City's storm sewer system proposed with the Guilford Road improvement project. The schedule for
implementation of this project has been extended beyond the timeframe of this project and an interim
drainage outlet was established. In order to discharge to the interim drainage outlet, modifications to the
design of the site were required. The petitioner has agreed to make these changes; however, several
variances are also required to facilitate the site discharging to the interim outlet. Other variances, not
related to this interim outlet, have also been requested. The permanent drainage outlet for this development
will be the future trunk line of the City's storm sewer system.
The following variances are requested as a result of the interim outlet:
1. Section 302.06 (2) "The 100.year elevation for stormwater detention facilities shall be
separated by not less than 25 feet from any building or structure to be occupied."
The petitioner has indicated that the design of the site prior to the change required to discharge to the
interim outlet conformed to this standard. However, the current site design requires the water to stage
higher into the detention facility resulting in Units 19 -23 and Unit 24 being only 17 -feet away from the
100 -year elevation of the detention facility.
The Department supports this variance request due to the fact that the proposed detention facility is a
dry detention facility that will able to be maintained from within the facility, not solely from the banks.
2. Section 305.04 "Minimum and maximum allowable slopes shall be those capable of
producing velocities no less than 2.5 and no greater than 10 feet per second, respectively,
when the sewer is flowing at full capacity, not average velocities or velocities resulting from
conveying the flow from the design storm."
This variance is requested for the outfall pipe only. Due to the elevation restrictions of the interim
outlet and a limit on how high the site could be raised (such limit being affected by the availability of
soil material, the existing elevations of the adjacent properties and the proposed perimeter drainage
improvements), this pipe is proposed at a slope that will result in less than the minimum velocity at full
pipe flow.
The Department supports this variance request due to the fact that approval of this variance would be
expected to result only in the potential for increased maintenance of this pipe to remove accumulated
sediment within the pipe. Since the runoff from the site will be treated by the proposed on -site best
management practices, the potential for sediment accumulation will be limited.
3. Section 501.01— "....there shall be no Tess than 2.5 feet of cover along any part of the pipe
from final pavement elevation or final ground surface elevation to the top of the pipe."

As with the variance from Section 305.04, the limit on how high the site could be raised affected the
minimum cover provided over the storm piping.
The Department is willing to support this variance provided that Class V reinforced concrete pipe is
installed under paved areas where the minimum cover is not provided. Such pipe should limit the
potential for more frequent maintenance of the overlaying pavement system.
4. Section 501.03 "A minimum drop of 0.1 foot through manholes and inlet structures should
be provided. (Plans do not show the 0.1 foot drop)
In order to provide as much cover as possible over the piping system (even though the minimum cover
was not provided in some cases thus requiring the need for the variance from Section 501.01) the
piping system is proposed without this 0.1 -foot drop.
The Department is willing to support this variance due to the fact that the absence of this drop is not
expected to have a negative impact on the hydraulics oldie proposed piping system due to the limited
size of the piping system.
The following variances have also been requested:
1. Section 302.02 "........requiring all onsite to be contained in a dry or wet detention pond
A small area on the south side of the property is not planned to be detained in the main detention
facility. The runoff from this area is intended to "recharge" the existing wetland area on the property
as the majority of the watershed draining to this wetland is being redirected into the main detention
facility.
The Department is willing to support this variance due to the fact that the runoff to Timber Creek
Condominiums is being reduced from the existing condition and some amount of water is needed to
maintain the existing wetland.
2. Section 302.06 (7) "Minimum orifice size on pond outlet is 6 inches."
The proposed storm water detention facility is proposed to also function as a storm water quality best
management practice (BMP). To function as a BMP, a smaller orifice is required.
The Department is willing to support this variance provided that the Storm Water Pollution Prevention
Plan requires more frequent maintenance of this outlet structure to ensure that the orifice does not
become obstructed by debris or other material.
3. Section 306.02 ".....30' easement over piping from the right -of -way."
The approved site plan for this Horizontal Property Regime (HPR) development does not provide
adequate width for such an easement to achieve the number of condominium units along the Guilford
Road frontage.
The Department is willing to support this variance provided that the piping from the right -of -way is
maintained by the developer (and subsequently the HOA).
The Department recommends that the Board approve the requested variances conditioned upon the
following:
1. The petitioner include in the project's Storm Water Pollution Prevention Pian requirements for
regular maintenance of the orifice to ensure it is kept clear of debris that might restrict the flow out
of the detention facility.
2. The petitioner enters into an Agreement with the City to maintain the piping from the right -of-
way.
3. The petitioner include in the project's Storm Water Pollution Prevention Plan requirements to
maintain the outfall pipe on a regular basis to ensure that it is free from any silt or debris that
might accumulate within the pipe.

current protection.
Exception. Smoke alarms are permitted to be solely battery operated In tuuitdings where no construction is
taking place, buildings that are not served tram a commercial power source and in existing areas of buildings
undergoing alterations or repairs that do not result in the removal of Interior wah or ceiling finishes exposing
the structure, unless. there is an attic, crawl space or basement available which could provide access for
building wiring without the removal of interior finishes.
(4) Interconnection. Where more than one smoke alarm is required to be installed within an individual dwetting unit in
Group R -2, R.3, R-4 and in dwellings not regulated as Group R •occupancies, the smoke alarms shall be
interconnected In such a manner that the activation of one alarm will activate all of the alarms in the individual unit.
The alarm shall be clearly audible in all bedrooms over background noise levels with all intervening doors closed,
Exceptions:
(1) Interconnection is not required in building which are not undergoing alterations, repairs, or construction of any
kind.
(2) Smoke alarms in existing areas are not required to be interconnected where alterations or repairs do not
result in the removal of interior wail or ceiling finishes exposing the structure, unless there is an attic, crawl
space or basement available which could provide access for interconnection without the removal of interior
finishes.
§6.227 Improvements To The Premises
(a) General

Carmel standards or of the federal, state or local government agency that have jurisdiction such installation and
maintenance activities and in accordance with•Section §6 -220 (b) (7) of this Code,
(2) No construction activity, installation of Improvements or clearing of any vegetation or ground cover shalt occur In
areas designated as Tree Preservation Easement.
(3) No construction activity, installation of Improvements or Bearing of any vegetation or ground cover shall occur
within a platted or dedicated landscape easement with the exception of additional tree or plant material or other
vegetation with the approval of the City of Carmel Urban Forester.
(4) Excepting those Improvements allowed by other codes or ordinances or allowed by a permit from the Hoard of
Public Works and Safety pursuant to Carmel City Code Section §8-67, no construction or other materials utilized
to improve or maintain the Premises or temporary or permanent improvements, shall be installed, placed or
stored:
Within a platted or dedicated drainage, sanitary, utility or other designated easement.
ii Within areas designated as Flood Route.
iii Within platted or dedicated right -of -way or public ground.
iv Upon, in or under any street, greenway or alley.
v In a manner inconsistent with the provisions of Section §6-222 (b) (16) of this Code.
(5) No person shall alter or modify existing grading or ground surface elevations within easements or rights -of -way at
any time.
(6) No person shall atter or modify existing City of Carmel, public or other Improvements within easements or rights
ofway at any time without proper approvals.
(7) Grading, filling, excavating or any change in the grade of the premises is permitted outside of platted or dedicated
easements or rights-of-way, but shall be acceptable in appearance, shall not cause, create or result in or represent
the potential to cause, create or result in a Detriment and shall not result in the diversion of storm water.

(8) For all work M the City of Centel right -of -way, the Owner or Responsible Party shall:
Install Improvements in strict accordance with Section §6.220 (b) (7) of this Code,
Notify the Department of Engineering Right of Way Manager and Construction Manager at least 24-
hours In advance of the start of construction within the right -of -way.
ni Restore the right -of -way as requested by the City during and at the completion of construction. This
shall include, but not be limited to repair and/or complete removal. and replacement• to current City
standards of damaged curbing, pavement, sidewalk, sod, grass, trees, or other vegetation.
Determination of damaged public Improvements shall be the sole discretion of the City.
iv Prior to starting the work, schedule a pre construction meeting with the Department of Engineering to
review the Department's construction requirements, staff notification requirements, required
inspections for certain stages of the work and to review the authority of the Department as it relates
to work within the City right -of -way.
v Provide an acceptable traffic control plan for the work within the right -of -way and obtain Department
of Engineering approval of the Plan prior to commencing the Work in the event that closure of any
lanes of travel of the public street necessary for completion of the work and such closure is approved
by the Board of Public Works and Safety.
vi Post traffic control devices at the locations on the approved traffic control plan and notification of the
Department of Engineering of such postings at least one week in advance of the start of
construction.
(b) Permits and Bonds
(1) Pursuant to Carmel City Code Section §8 -65, the Owner or Responsible Party shall obtain proper permits and post
proper bonds or other performance guarantees required by the City for all work In right -of -way and for connections
to a public drainage system prior to starting the work. Work in the right of-way is subject to inspection and
acceptance by the City.
(2) The Owner or Responsible Party shall obtain all other permits and post all other performance guarantees required
by the City artd shall obtain all other permits from other federal, state or local government agencies avi

(3) The Owner or Responsible Party shall provide written approval from the Home Owners Association to the City for
all proposed installation of new, or maintenance of existing, Improvements if the approval of the Home Owners
Association for such work is stipulated in the restrictive covenants.
(c) Revlew and Approval
(1) The City, and in some instances the Homeowners Association, depending on the restrictive covenants of
subdivision, reserves the right to review, approve or deny any and all proposed Improvements, or modifications to
existing Improvements on the premises, within the right -of -way or within platted or dedicated easements.
(2) The City may provide technical advice to the Owner or Responsible Party for installation of proposed
improvements or modifications to existing improvements but assistance will be limited to advice only. The City
assumes no responsibility 11 the Improvement does not function properly or as intended.
(3) Prior to installing any new, or conducting maintenance of existing, Improvements on the premises, within platted or
dedicated easements or within the right -of -way, the Owner or Responsible Party shall review the covenants for
any restrictions related to the installation or maintenance activities. The City will not approve installation of
Improvements that violate existing restrictive covenants.

(3) The City reserves the right to install Erosion Control, Sediment Control and Storm Water Quality measures or to
maintain and /or repair existing Erosion Control, Sediment Control and Storm Water Quality measures due to lack
of installation or maintenance of Installed measures for Improvement projects by the Owner or Responsible Party
at the Owner's or Responsible Party's expense if lack of maintenance or state of disrepair is determined, at the
sole discretion of the City, to cause, create or result in or represent the potential to cause, create or result in a
Detriment.
(h) Driveways
(1) The City shall allow one (1) curb cut access to each premises served by City streets and roadways unless
otherwise approved by The Board of Public Works and Safety. The City shall determine the type of access
provided to each curb cut that is in the best interest of public safety.
(2) Temporary construction entrances or other type of temporary access that are not located at the existing driveway,
curb cut or main property access point shall be approved by the Board of Public Works and Safety pursuant to §6•
227 (d) (1) of this Code or approved by the Department of Engineering if Board of Public Works and Safety
approval is not required,
(3) Temporary construction entrances or other type of temporary access that are not located at the existing driveway,
curb cut or main property access point shaft be installed or the access provided at the approved location.
Temporary construction entrances shall be constructed in strict accordance with current City Standards and shall
be In accordance with all provisions of Sections §6-227 (h) of this Code. At the Time stipulated by the Board of
Public Works approval, the temporary construction entrance (if constructed) shall be completely removed In
accordance with Section §6.227 (h) (10) of this Code and the right -of -way at the paint of access, and in the vicinity
of the point of access if affected by the work and vehicular or other traffic associated with the access, restored in
accordance with Sections 6-227 (a) (8) of this Code.
(4) in a cases where an existing driveway, curb cut or main property access is utilized as a construction entrance or
other type of temporary access, the existing improvements within the right -of -way shall be restored in accordance
with Sections §6227 (a) (8) of this Code when the work is complete.
(5) Pursuant to Carmel City Code Sections §8.62 and §8.65, Right -of -Way Permits and proper posting of Right -of-
Way Bonds or Performance Bonds (at the discretion of the City) are required for all modifications to the portions of
the existing drives that are located in the right-of-way, installation of new driveways within the right -of -way,
temporary construction entrances or other type of temporary access, and use of an existing driveway, curb cut or
main property access as a temporary construction entrance or other type of temporary access, whether or not the
work requires approval by the Board of Public Works and Safety.
(6) The portions of proposed driveways within the right -of -way or modifications to the portion of existing driveways
within the right-of-way shall be constructed of concrete, unless the restrictive covenants or other prevailing
conditions warrant an asphalt drive. The portion of the driveway within the right -of -way shall be constructed or
modified in strict accordance with the current City standards. If an asphalt drive is installed, the sidewalk across
the driveway shall be concrete. Under no circumstances shall an asphalt driveway be constructed within the right
of -way where the existing roadway has concrete curb and gutter.
(7) Ali proposed driveway construction or modifications to existing driveways shall be from the back edge of the
existing curb. The existing curb shall not be disturbed by the work unless the approved Construction Documents of
the development anticipated the work, In this case, the existing curb shall be removed and replaced in accordance
with the approved Construction Documents of the development or applicable City standards.
(8) Pursuant to Carmel City Code Section 0-62, no person shall construct a new driveway across an existing
sidewalk without approval by the Board of Public Works and Safety.
(9) In areas where the existing roadway is not curbed, new driveways shall be constructed such that the existing
roadside drainage Is maintained, This shall include, if required by the City, the installation of 12 -inch minimum
diameter pipes, Installed so that the pipe inverts match the existing roadside ditch elevations.

(10) In the event that an existing driveway is proposed to be removed, removal work shall be in accordance with the
following:
The existing driveway material and any underlying aggregate shall be completely removed within the
limits of the right -of -way or as directed by the Board of Public Works and Safety.
ii The existing roadside drainage system shall be restored across the former driveway to match or
Improve upon the existing swats configurations upstream and downstream of the existing driveway.
The area of the removed driveway within the limits of the right -of -way shall be backfilled and
topdressed with 6- inches minimum of topsoil such that the area is level with the undisturbed area.
Iv Sod shall be installed within the area of the removed driveway within the limits of the right -of -way.
(1) Sidewalks Mufti -use Paths
(1) If removal of the existing sidewalk or multi -use path is required to facilitate the installation of a new driveway or
modifications to an existing driveway, such work being approved by the Board of Public Works and Safety, the
sidewalk shall be reconstructed of concrete and a multi-use path of asphalt in accordance with the current City
Standards.
(2) New sidewalks or modifications to existing sidewalks shall be concrete and new multi-use paths or modifications to
existing multi-use paths shall be asphalt and shall be constructed in accordance with the current City standards.
(3) Pursuant to Carmel City Code Sections §8 -63 and §5.65, Right -of -Way Permits and proper posting of Right -of-
Way Bonds or Performance Bonds (at the discretion of the City) are required for all modifications to the portions of
the sidewalks or multi-use pathways within the right -of -way or installation of new sidewalks or multi -use pathways
within the right -of -way, whether or not the work requires approval by the Board of Public Works and Safety.
(4) Sidewalks or multi-use paths constructed across premises as improvements are commenced on individual,
unimproved building Tots shall be constructed in accordance with the approved construction plans on file with the,
City and shall be constructed by the Owner or Responsible Party.*
Section 3. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby
repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or
amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties
incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings
are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this
Ordinance had not been adopted,
Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such
decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can
be given the same effect.
Section 5. This Ordinance shall be in full force and effect from and after its passage and signing by the
Mayor.

as Water Features with only water pertinent information.
Certified as- builts shall accurately reflect all field design. As- builts must be stamped "Field Verified" and signed by the
developer's registered professional engineer or land surveyor.
Disc file names shall be clearly labeled and easily identifiable to all users.
Projection shall be referenced to NAD83, Indiana State Plane Coordinate System, East Zone, using U.S. Survey Feet and
per the Hamilton County datum.
All pertinent drawing elements will reside in the primary drawing file. There shall be no cells, nodes, blocks, or reference
files attached to the drawing.
Tie into section comers in the Indiana State Plane Coordinate System to insure proper orientation.
All underground fittings shall be marked with lath or PVC and identification for GPS capturing.
Must show measurements between all fittings with each fitting identified, and water mains identified by size and material.
The as- builts, both paper and digital, must be revised to show the exact location of all water mains, laterals constructed,
hydrants, valves, service lines fittings as installed with measurements from a permanent structure (e.g. fire hydrant)
After installation, actual point coordinate locations for all hydrants, valves, fittings, etc. shall be captured using Survey
Grade GPS unit.

RE: Temporary Construction Entrance Request Herron Creek Villas
Dear Board Members:
Edward Fleming of Weihe Engineers, on behalf of Guilford Commons, LLC, owner of the property at 531
Guilford Road, has requested approval of a temporary construction entrance on the east side of Guilford
Road. Herron Creek Villas is a proposed Horizontal Property Regime development on the former Carmel
First Church of God property.
The proposed temporary construction entrance is located approximately 1,200 -feet north of the intersection
of City Center Drive and Guilford Road, on the east side of Guilford Road. This construction entrance is
necessary to allow the import of approximately 15,000 -cubic yard of soil material to raise the site to meet
the grades proposed on the development plan. This work is being done in advance of final approval of the
Development Plan due to the fact that the soil material is available presently from an off -site source.
The Department of Engineering recommends that the Board approve the requested temporary construction
entrance contingent upon satisfaction of the following requirements:
1. In addition to complying with the approved Storm Water Pollution Prevention Plan for this
earthwork, the petitioner shall comply with the provisions of Carmel City Code sections 6-
227(aX1), 6-227(aX8), 6- 227(b)(1), 6- 227(hX2), 6- 227(hx3) and 6- 227(h)(5) and 6- 227(hX9).
2. If this entrance is not anticipated to be used for further development of the site, then within 60-
days from the date of approval or upon completion of the Work, whichever occurs first, the
portion of the temporary construction entrance within the right -of -way shall be removed in
accordance with Carmel City Code section 6- 227(h)(10) and the right -of -way restored to the
satisfaction of the City.

current protection.
Exception. Smoke alarms are permitted to be solely battery operated in buildings where no construction is
taking place, buildings that are not served from a commercial power source and in existing areas of buildings
undergoing alterations or repairs that do not result in the removal of interior wall or ceiling finishes exposing
the structure, unless. there is an attic, crawl space or basement available which cord provide access for
building wiring without the removal of interior finishes.
(4) Interconnection. Where more than one smoke alarm is required to be installed within an individual dwelling unit in
Group R -2, R -3, R -4 and in dwellings not regulated as Group R 'occupancies, the smoke alarms shall be
interconnected in such a manner that the activation of one alarm will activate all of the alarms in the individual unit.

(1) interconnection Is not required in building which are not undergoing alterations, repairs, or construction of any
kind.
(2) Smoke alarms In existing areas are not required to be interconnected where alterations or repairs do not

space or basement available which could provide access for interconnection without the removal of interior
finishes.
§6-227 Improvements To The Premises
(a) General
(1) All i it; n .f ew tt tenance of existin. lm rovement sh iI in rd= nce ith the current Ci of
Carmel standards or of the federal, state or local govemment agency that have jurisdiction such installation and
maintenance activities and in accordance with-Section §6-220 (b) (7) of this Code
(2) No construction activity, installation of improvements or clearing of any vegetation or ground cover shall occur in
areas designated as Tree Preservation Easement.
(3) No construction activity, installation of Improvements or clearing of any vegetation or ground cover shall occur
within a platted or dedicated landscape easement with the exception of additional tree or plant material or other
vegetation with the approval of the City of Carmel Urban Forester.
(4) Excepting those Improvements allowed by other codes or ordinances or allowed by a permit from the Board of
Public Works and Safety pursuant to Carmel City Code Section §8.67, no construction or other materials utilized
to improve or maintain the Premises or temporary or permanent improvements, shall be installed, placed or
stored:
Within a platted or dedicated drainage, sanitary, utility or other designated easement.
ii Within areas designated as Flood Route.
iii Within platted or dedicated right -of -way or public ground.
iv Upon, in or under any street, greenway or alley.
v In a manner inconsistent with the provisions of Section §6-222 (b) (16) of this Code.
(5) No person shall alter or modify existing grading or ground surface elevations within easements or rights of way at
any time.
(6) No person shall alter or modify existing City of Carmel, public or other Improvements within easements or rights
of -way at any time without proper approvals.
(7) Grading, filling, excavating or any change in the grade of the premises is permitted outside of platted or dedicated
easements or rights -of -way, but shall be acceptable in appearance, shall not cause, create or result in or represent
the potential to cause, create or result In a Detriment and shall not result in the diversion of storm water.

P' (8) For all work in the City of Cannel right -of -way, the Owner or Responsible Party shall:
Install Improvements in strict accordance with Section §6 -220 (b) (7) of this Code.
fi Notify the Department or Engineering Right of Way Manager and Construction Manager at least 24
hours in advance of the start of construction within the right -of -way.
iii Restore the right- of-way as requested by the City during and at the completion of construction. This
shall include, but not be limited to repair and/or complete removal and replacement to current City
standards of damaged curbing, pavement, sidewalk, sod, grass, trees, or other vegetation.
Determination of damaged public Improvements shall be the sole discretion of the City.
iv Prior to starting the work, schedule a pre construction meeting with the Department of Engineering to
review the Department's construction requirements, staff notification requirements, required
inspections for certain stages of the work and to review the authority of the Department as it relates
to work within the City right -of -way.
v Provide an acceptable traffic control plan for the work within the right -of -way and obtain Department
of Engineering approval of the Plan prior to commencing the Work in the event that closure of any
lanes of travel of the public street necessary for completion of the work and such closure is approved
by the Board of Public Works and Safety.
vi Post traffic control devices at the locations on the approved traffic control and notification of the
Department of Engineering of such postings at least one week in advance of the start of
construction,
(b) Permits and Bonds
Pursuant to Carmel City Code Section §8-65, the Owner or Responsible Party shall obtain proper permits and post
proper bonds or other performance guarantees required by the City for all work in right of-way and for connections
to a public drainage system prior to starting the work. Work in the right -of -way is subject to inspection and
acceptance by the City.
(2) The Owner or Responsible Party shall obtain all other permits and post all other performance guarantees required
by the City and shall obtain all other permits frogrr other federal, state or local government agencies having
jurisdiction over such installation and constriction activities prior to starting the work.
(3) The Owner or Responsible Party shall provide written approval from the Home Owners Association to the City for
all proposed installation of new, or maintenance of existing, Improvements if the approval of the Home Owners
Association for such work is stipulated in the restrictive covenants.
(c) Review and Approval
(1) The City, and in some instances the Homeowners Association, depending on the restrictive covenants of
subdivision, reserves the right to review, approve or deny any and all proposed Improvements, or modifications to
existing Improvements on the premises, within the right -of -way or within platted or dedicated easements.
(2) The City may provide technical advice to the Owner or Responsible Party for installation of proposed
improvements or modifications to existing improvements but assistance will be limited to advice only. The City
assumes no responsibility if the Improvement does not function property or as intended.
(3) Prior to installing any new, or conducting maintenance of existing, Improvements on the premises, within platted or
dedicated easements or within the right -of -way, the Owner or Responsible Party shall review the covenants for
any restrictions related to the installation or maintenance activities. The City will not approve installation of
Improvements that violate existing restrictive covenants.

(d) Board of Public Works and Safety Approval
(1) Board of Public Works and Safety Approval is required for, but not limited to, the following:
Request for additional curb cut access to serve a residential property,
11 Pursuant to Carmel City Code Section §8 -62, construction of a driveway for commercial use
ill Proposed modifications of existing commercial or residential driveways and drive aprons within the
right -of -way:
iv Proposed open cuts into existing pavement or curbs, or into any portion thereof, or to excavate
therein, or to excavate beneath the surface thereof for any reason.
v Closure of any lanes of travel of the public street necessary for completion of the work.
vi Removal of existing driveways.
vii Temporary construction entrances or other type of temporary access if not located at the existing
driveway, curb.cut or main property access point, if said entrance or other type of temporary access
is proposed from a roadway bearing a designation on the City of Carmel 20 -year Thoroughfare Plan.
(e) Private Drainage Systems
(1) Proposed Private Drainage Systems and modifications to existing Private Drainage Systems shall be constructed
as a Legal Connection or a Legal Discharge and in accordance with Section §6 -220 (b) (7) of this Code.
(2) All Proposed Private Drainage Systems or modifications to existing Private Drainage Systems are subject to
review by the City. The Owner or Responsible Party shall submit a plan and other requested documentation for
review and approval by the City. If review and approval authority lies with another federal, state or local
government agency, the City shall direct the Owner or Responsible Party to file the information with the
appropriate agency.
(3) All premises shall be graded so as to prevent the accumulation of stagnant water thereon, within any structure
located thereon, or on other premises. Stagnant water shall be determined as any accumulation that has not
dispersed within seven (7) days of the last recorded local rainfall, with the exception of Stormwater Detention or
Stormwater Quality Facilities approved and or permitted by the City.
(4) It shall be prohibited to install improvements into or within any Watercourse or within the limits of the easements in
which the Watercourses are located.
(5) Connections to the Public Drainage System shall only be performed by Contractors bonded with the City. In
accordance with Section §6 -227 (b) (1) of this Code, this work is subject to inspection by the City.
(f) Stormwater Quality Best Management Practices
(1) if maintenance activity necessitates the reconstruction of the Stormwater Quality Best Management Practices, or
portions thereof, the work shall be approved, permitted, bonded and reconstructed in accordance with the
approved Storm Water Pollution Prevention Plan, City Codes and other federal, state or local government agency
standards governing the installation and maintenance of Storm Water Quality Best Management Practices and in
accordance with Section §6 -220 (b) (7) of this Code.
(g) Erosion Control, Sediment Control and Storm Water Quality During the Work
(1) No soil runoff shall be permitted from the premises during and after installation of any improvement or
maintenance thereof,
(2) Erosion Control, Sediment Control and Storm Water Quality measures shall be installed and shall be maintained
for the duration of the work and are subject to inspection by the City. Installation of Erosion Control, Sediment
Control and Storm Water Quality measures shall conform to Section §6-220 (b) (7) of this Code.

(3) The City reserves the right to install Erosion Control, Sediment Control and Storm Water Quality measures or to
maintain and/or repair existing Erosion Control, Sediment Control and Storm Water Quafity measures due to lack
of installation or maintenance of installed measures for Improvement projects by the Owner or Responsible Party
at the Owner's or Responsible Party's expense if lack of maintenance or state of disrepair is determined, at the
sole discretion of the City, to cause, create or result In or represent the potential to cause, create or result in a
Detriment.
(h) Driveways
(1) The City shall allow one (1) curb cut access to each premises served by City streets and roadways unless
otherwise approved by The Board of Public Works and Safety, The City shall determine the type of access
provided to each curb cut that Is in the best interest of public safety.
(2) Temporary construction entrances or other type of temporary access that are not located at the existing driveway,
curb cut or main property access point shall be approved by the Board of Public Works and Safety pursuant to §6-
227 (d) (1) of this Code or approved by the Department of Engineering if Board of Public Works and Safety
approval is not required.
--�3) Temporary construction entrances or other type of temporary access that are not located at the existing driveway,
curb cut or main property access point shall be installed or the access provided at the approved location.
Temporary construction entrances shall be constructed in strict accordance with current City Standards and shall
be in accordance with all provisions of Sections §6 -227 (h) of this Code. At the time stipulated by the Board of
Public Works approval, the temporary construction entrance (if constructed) shall be completely removed in
accordance with Section §6.227 (h) (10) of this Code and the right-of-way at the point of access, and in the vicinity
of the point of access if affected by the work and vehicular or other traffic associated with the access, restored in
accordance with Sections §6.227 (a) (8) of this Code.
(4) in all cases where an existing driveway, curb cut or main property access is utilized as a construction entrance or
other type of temporary access, the existing improvements within the right-of-way shall be restored in accordance
with Sections §6 -227 (a) (8) of this Code when the work is complete.
(5) Pursuant to Carmel City Code Sections §8-62 and §8-65, Right -of -Way Permits and proper posting of Right -of-
Way Bonds or Performance Bonds (at the discretion of the City) are required for all modifications to the portions of
the existing drives that are located in the right -of -way, installation of new driveways within •the right -of -way,
temporary construction entrances or other type of temporary access, and use of an existing driveway, curb cut or
main property access as a temporary construction entrance or other type of temporary access, whether or not the
work requires approval by the Board of Public Works and Safety.
(6) The portions of proposed driveways within the right -of -way or modifications to the portion of existing driveways
within the right of-way shall be constructed of concrete, unless the restrictive covenants or other prevailing
conditions warrant an asphalt drive. The portion of the driveway within the right -of -way shall be constructed or
modified in strict accordance with the current City standards. If an asphalt. drive Is installed, the sidewalk across
the driveway shall be concrete. Under no dreumstanoes shall an asphalt driveway be constructed within the right
of -way where the existing roadway has concrete curb and gutter.
(7) All proposed driveway construction or modifications to existing driveways shall be from the back edge of the
existing curb. The existing curb shall not be disturbed by the work unless the approved Construction Documents of
the development anticipated the work, In this case, the existing curb shall be removed and replaced in accordance
with the approved Construction Documents of the development or applicable City standards.
(8) Pursuant to Carmel City Code Section §8.62, no person shall construct a new driveway across an existing
sidewalk without approval by the Board of Public Works and Safety.
(9) In areas where the existing roadway is not curbed, new driveways shall be constructed such that the existing
roadside drainage is maintained. This shall include, if required by the City, the installation of 12 -inch minimum
diameter pipes, installed so that the pipe inverts match the existing roadside ditch elevations.

(10) In the event that an existing driveway Is proposed to be removed, removal wort shall be in accordance with the
following;
The existing driveway material and any underlying aggregate shall be completely removed within the
the right -of -way or as directed by the Board of Public Works and Safety.
11 The limits exi sting roadside drainage system shall be restored across the former driveway to match or
improve upon the existing swale configurations upstream and downstream of the existing driveway.
ill The area of the removed driveway within the limits of the right -of -way shall be backfilled and
topdressed with 6- inches minimum of topsoil such that the area is Ievel•with the undisturbed area.
iv Sod shall be installed within the area of the removed driveway within the limits of the right -of -way.
(1) Sidewalks Mufti -use Paths
(1) if removal of the existing sidewalk or multi -use path is required to facilitate the installation of a new driveway or
modifications to an existing driveway, such work being approved by the Board of Public Works and Safety, the
sidewalk shall be reconstructed of concrete and a multi-use path of asphalt in accordance with the current City
Standards.
(2) New sidewalks or modifications to existing sidewalks shall be concrete and new multi -use paths or modifications to
existing mutti -use paths shall be asphalt and shall be constructed in accordance with the current City standards.
(3) Pursuant to Carmel City Code Sections §8.63 and §8.65, Right -of -Way Permits and proper posting of Right -of-
Way Bonds or Performance Bonds (at the discretion of the City) are required for all modifications to the portions of
the sidewalks or multi-use pathways within the right of-way or installation of new sidewalks or multi-use pathways
within the right -of -way, whether or not the work requires approval by the Board of Public Works and Safety.
(4) Sidewalks or mufti-use paths constructed across premises as improvements are commenced on individual,
unimproved building lots shall be constructed in accordance with the approved construction plans on file with the
City and shall be constructed by the Owner or Responsible Party."
Section 3. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby
repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or
amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties
incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings
are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this
Ordinance had not been adopted.
Section 4. 1f any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such
decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can
be given the same effect.
Section 5. This Ordinance shall be in full force and effect from and after its passage and signing by the
Mayor.
PASSED by the Common Council of the City of Carmel, Indiana, this 9 day of
2006, by a vote of if ayes and 2.__nays.
