State law, however, governs what we can and cannot do. Only judges can issue cease and desist orders. We are following the proper procedures and I have made it extremely clear to our staff that once we start to let this sort of thing slide, it is a long slippery slope that will result in negative impacts on our more mature neighborhoods and property values. At the BZA hearing, it WILL BE IMPORTANT FOR YOUR NEIGHBORS TO BE PRESENT AND MAKE THEIR OPINIONS KNOWN TO THE BZA. I ALSO THINK YOU NEED TO STRESS OVER AND OVER THAT THIS IS A "BUSINESS" NOT A CHARITY ACTIVITY. We already have evidence that the applicants lied about living in the house and that point needs to be brought out as well. You may be heartened to know that the city spent over $50,000 about a year last year prosecuting a similar zoning violation concerning an illegal business in a residential zoned area, including having to hire a private investigator to prove that the business was still being conducted after the defendant promised to stop. We will do everything we can to enforce the zoning we have at this address. The business does have certain rights under state law and we are always concerned that we not lose an appeal to a court of law and for that reason must strictly follow the procedural rules laid out in state law and make certain the business owner has every opportunity to present his case. Do not confuse making sure we don't lose with an appeal with leniency in these matters. Please feel free to write or contact me anytime. My name is Todd Mellencamp and my residence is 11040 Beech -Wood Drive West, I am an adjoining property owner to 1325 East 111th Street, this property is currently being used as a business (private non accredited school) in an R -1 zoned area and has been operating since the end of September 2003. The owners of the 2/6/2004 Page2of2 property at 1325 East 111th Street live at 13784 Hickory Ridge Court which clearly shows the property at 111th Street is strictly a business. After several calls to the Zoning office by myself and other adjoining property owners and local residences reporting the violation (to no avail), business as usual at 1325 East 111th Street. This case finally went before the Zoning Board in the January 2004 board meeting and was tabled until the February 2004 meeting due to an improper filing for a Special Use Variance by a non accredited school. The most troubling concern is that after several complaints to the Zoning Office past and present, your administration continues to ignore the violation and not uphold the City Codes by delivering a 'Cease and Desist Order' against the business. Mr. Mayor, please help me understand why we even have city codes in place if they cannot be upheld by your administration? The Zoning Office tells me there is not a violation until after a Zoning Board Hearing and denial, I suppose that being the case I could open a business anywhere in Carmel /Clay.Your help in this matter would very much be appreciated, and Thank You very much for your time. The purpose of this letter is to provide some insight into the disability of autism. While autism used to be a rare disability with the incidence rate of 2 in 10,000, the rate today is 5 in 1,000 in the state of Indiana. This dramatic increase has placed a tremendous strain both on school systems and on families to provide quality programming. Today, many of the quality in -home programs virtually bankrupt families. In addition to the increase in the number of those diagnosed, the "face" of autism has also changed. Typically people still believe that these are children who are restrained or who best belong in state institutions. However, the vast majority of these children are able to attend school, graduate, get a job.. and yes, some even marry. In order to ensure future success, we have learned that early intensive education is critical and that children initially may learn skills best in smaller settings. We also know that children must be deliberately taught every thing, including how to play, socialize with others, communicate their needs, and every other skill that other children simply learn through osmosis. This need for intensity of services, plus the increased incidence of autism, has resulted in the development of various and incredibly pricey programs. The type of program that Susan Pieples runs provides families with an affordable and highly effective alternative. Having a child with this disability is isolating and tremendously challenging for families. This intense need requires communities to come together on behalf of these families and children. Susan Pieples has been a valued teacher for our son, Blake, now 5 years old with a ._diagnosis-of autism. Susan came to our home for two years on a regular basis to tutor Blake, and we give her much of the credit as to his continued progress. -Blake is verbal, outgoing, and extremely smart, and _obviously, can -learn- a_great has :the right _teacher :and environment. Susan is a Godsend with her patience, kindness, and committment that these children have much potential with the right circumstances in teaching. Blake attended summer school at Broad Horizons this summer and loved it, making new friends, playing, learning, and in an environment that is best for many of these children; small classes, and a "home environment Her dream became a reality when the school moved -to the home in question. It is her desire to have it like a home because this is best for these children.. In fact, I couldn't find the school because it looks no different than any other home in the area, no signs, parking problems, etc. Inside it is warm with comfortable furniture, just like a home would be, with learning materials and wonderful opportunities for these children to reach their full potential. Any fear from the neighbors that a child would "escape" the house is unfounded, and no different than a small child that would get out from any family. This fear, is quite frankly, discriminatory in nature. Susan is a very gifted teacher, and so important to these children and their progress. The school is in the best location and is not a problem for anyone in the neighborhood. Please votato allow it to remain in this home so that our children can keep their "school home" and be allowed to learn, play, be comfortable and accepted, and so that they can reach their potential. Susan's belief has always been that these children have so much to offer and that they are so capable of learning, and she is so important to all of the families that are lucky enough to have her as a teacher to their son or daughter. As I said, Susan has helped our son, Blake so much that it is hard to measure. I would like to point out that I believe Broad Horizons is a wonderful asset to the children it serves. My son has been receiving services at the school for 4 months. I have always found the residential 'look' of the school to blend in with surrounding houses and have never witnessed anything that could be construed as disruptive to the neighborhood. It is my understanding that it is the intent of the school to maintain this appearance even after the completion of additional parking. The staff and associates of Broad Horizons have treated my family with professionalism, respect and care. I am certain their neighbors can expect the same. (Variance hearing #SU- 101 -03, #03100003). As a nearby resident of the area in which the building in question is located, I can vouch that it has been unchanged and is indistinguishable from any other residence. Susan Pieples has no intention of altering any aspect of the building, now or in the future. A residential setting is ideal for the small number of autistic children that Mrs. Pieples will be servicing. I know Susan Pieples to be a caring and compassionate person who would be sure all children are well supervised. There is nothing to fear from having these children in the neighborhood from 9:00 to 4:00 each day. As an attorney, I understand that consideration of variances require very careful consideration and a balance of many interests. As a parent who has a child who has been tutored by Susan Pieples (director of Broad Horizons School), I believe that this school offers a nationally groundbreaking curriculum in educating children with mild to moderate learning disabilities. My son, Henry, now attends public school, and is fully mainstreamed in the regular school curriculum, as a result of the work of Susan Pieples. When we first met Susan (when Henry was three years old), he did not speak. He certainly does now. First, the old "not in my backyard" issue I think people hear that the school houses children with autism and they are frightened by the terminology. I understand this because when I first heard the term applied to my child, "frightened" was an understatement. But what we know now is that the characteristics of autism are exacerbated by institutionalization and the old warehousing methods of the past; if children are identified and supported from ages 2 -6, they have every chance of normalizing attending public school and leading as normal a life as the rest of us, albeit with a few of the quirks that make people more interesting. Programs that actually supply the services these kids need have been focused on medical therapy, however, when the kids who have the best chance of normalizing really need a teacher intensive, carefully managed preschool. Susan Pieples provides that in her program, with an opportunity for therapists (speech, physical, occupational, special education) to participate in a child's day. It's a small number of kids, many of whom attend regular school and come to Susan's for supplemental education. I send my second son to Susan (Louis is "normal" whatever that means) for tutoring, simply because I think she is the best in the business. Susan Pieples is quickly acquiring a state and national reputation as a gifted educator. It is important for the City of Carmel to understand the value of her work, especially since the city is represented in Washington D.C. by Rep. Dan Burton, who is an activist on issues of autism due to his grandson's diagnosis of the condition. As far as the neighborhood and the property itself, Broad Horizons will not require cosmetic changes that will make the house look like anything other than another home in the neighborhood. There is no signage, or plans for such.. So far, all that has been done to the home on the outside has been tree trimming and clean -up that has only enhanced the property, which I understand was vacant for some time before its purchase by Susan Pieples. In fact, preservation of the property as a home is a must for a Montessori school environment, which emphasizes developing home skills for students as a part of the curriculum. 1/21/2004 Page 2 of 2 Parking is not so much an issue as getting in and out of the driveway, as parents arrive to drop off and pick up their children. It's a similar situation to the pre school around the corner on College (around 103rd street). understand there are plans for asphalting the drive and adding a turn around to help parents get in and out more easily, but I've not had any difficulty with this myself. School and tutoring is conducted from 9 -4 on weekdays, and on weekends, no children are around, unless they are Susan's own kids.. The children play outside in a fenced yard with supervision during day hours only on weekdays. If I can answer any questions, please call me at 259 -0126. The aggression was so severe there was a possibility he could endanger his life. You see he has never hurt anyone but himself, because he is so frustrated that he cannot talk like the rest of the children at school. He did not have a functional form of communication, and so when he was not understood he would resort to hitting, biting and banging himself out of pure frustration (this is not unusual for autistic children). Did you know just 5 years ago that one in every 10,000 children were diagnosed with autism and now, 1 out of every 110 in the State of Indiana are diagnosed with some form of autism? At the time our son left for Wichita, we thought it would only be for a short while, but then as he continued to get worse, and there was no sign of him coming home, we became more worried and began searching for schools that could help him here in Indiana (there weren't any) as an alternative. Specialized school are an important part of our community as well as a service for our Special Needs children. Fishers has the highest population of autistic children in the state of Indiana at this time and Carmel is second. This is a fact. Knowing this, I would hope the planning council would take a closer look at Broad Horizons. There is a school in Carmel (Broad Horizons), it is not a residential facility but they service children with developmental delays and that is more than what most public schools will do. Montessori schools are known for precision teaching which is the type of teaching we use for children with developmental delays. I ask of you sir, to reconsider any denial to for a variance to Broad Horizons. This school is a blessing in your backyard for many children and families of Carmel. It is imperative that children with developmental delays find a place they feel at home with in order to learn like `typical' children. Michael now talks and says some statements Like, "I want cookie" or I want movie" it is a breakthrough that would of never happen without the help of a special school similar to Broad Horizons.
