To all,
Susan Pieples has officially withdrawn her application for a use variance.
She requested and was provided the Home Occupation standards in the Ordinance. She
indicated she was separating from her husband and letting go her employees and would
comply with the home occupation standards in the Ordinance.
I will be meeting with her sometime within the next week to discuss the limitations set forth
in the Ordinance.
If you have any comments please let me know. Specifically the ordinance would provide no
more than 15 percent of the home to be used and allow one outside employee. In addition
the Department is making an official determination that children playing in the rear yard is
not a violation of section 25.18.01.8.2 or 25.18.01.C.
Ms. Pieples has also indicated that she will be making improvements to the driveway. An
improvement consistent with the site plan provided with the subject application would not
require a permit and is allowed under the Ordinance.
Ms. Pieples will be made aware that the Department may inspect the property to confirm
compliance with the Ordinance.
Angie: Pleas label the agenda for this item as "WITHDRAWN
Jesse: Please continue to document activity on the site. When I meet with Ms. Peoples I will
have her provide a site plan illustrating the area of activity including use of the home.

25.18 Home Occupation.
25.18.01 Standards Generally.
A. Floor Area: Home Occupations shall utilize no more than fifteen percent
(15 of the gross floor area of the dwelling.

B. Character:
1. The Home Occupation shall not change the character of the
Dwelling, Lot or parcel;
2. The Dwelling shall not bear any indication from the
exterior that it is being utilized in whole or in part for any
purpose other than a Dwelling;
3. The Home Occupation shall not be permitted outside
storage or display of materials in connection with the Home
Occupation;
4. The Home Occupation shall not be permitted signs other
than those normally permitted in the district in which the
Home Occupation is located.
C. Nuisance: The Home Occupation shall be conducted wholly within the
Dwelling, such that there is no outside noise, vibration, odor, smoke, dust,
glare or electrical disturbance.
D. Employees. The Home Occupation shall employ no more than one (1)
individual outside of the immediate family.
E. Deliveries. The delivery of any materials for the Home Occupation will
not exceed two (2) trips per day by any vehicle not owned by a family
member.
F. Equipment. The Home Occupation shall utilize only mechanical
equipment that is customarily used for domestic purposes and is of a size
and type that is similar to domestic mechanical equipment or is customarily
found in a business office.
25.18.02 Excluded Uses:
A. antique or gift shop;
B. serving of food or beverages;
C. animal hospital or commercial kennel;
D. automobile repair;
E. major appliance repair or services; and
F. any processing or manufacturing that produces noxious materials or
products.

should be a good place to start from.

Dear Mr. Dobosiewicz:
I would like to withdraw my petition for a use variance /special use variance at this time. As it
seems I have no other alternative, I am seperating from my husband and moving into the
house at 1325 E. 111th Street. I will also have to let two employees go, but I cannot abandon
the children and their families) who so desperately need this service.
I understand from talking with Steve Hardin and Matt Skelton at Bingham, McHale Attrnys.,
that you can explain to me further the requirements of the "home occupation" statues. I
would like to have clarification on the following issues specifically:

After I move in, am I going to have to worry about invasion of privacy by anyone wanting to
"verify" the use of my home? I am willing to make whatever consessions are necessary to
meet the law, I have been very up front with everyone to date, and I would be very
uncomfortable staying here if I have to constantly wonder if the "zoning police" are coming.
I also understand that the occupation cannot be seen or heard outside the building. Does this
mean that the children cannot play in my back yard? If so, would a privacy fence help to
permit them to play. Especially since there are other children in the neighborhood, and we do
not go out for long (20 -30 minutes) it would really be a crime to have to keep them indoors on
nice days.
The driveway is a shambles, and is not safe (even if it were only me), because there is no
turn around, and I have to back out onto 111th. I assume if it is a home occupation, that
may as owner of the house, improve the driveway. Please advise me if this is going to be
problematic.
When you have the answers to these questions, I would like to set up an appointment to meet
with you or your representative to go over them in person.
