HomeMy WebLinkAboutD-1953-09 Council Meetings/Agendas As AmendedORDINANCE D- 1953 -09 AS AMENDED SPONSOR(S): Councilor Sharp AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA AMENDING CHAPTER 3, ARTICLE 1 DIVISION II, SECTIONS 3 -9(a) (c), 3 -13, 3 -15 AND 3 -19 OF THE CARMEL CITY CODE WHEREAS, the Common Council of the City of Carmel, Indiana "Council has previously passed and enacted certain ordinances currently now codified in Sections 3 -9, 3 -13, 3 -15 and 3 -19 of the Carmel City Code; and WHEREAS, the Council wishes to amend the City Code Sections referenced above, finding that such amendments are in the public interest. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1: The foregoing Recitals are incorporated herein by this reference. Section 2: That Chapter 3, Article 2, Division II, Section 3 -9(a) of the Carmel City Code is hereby amended to read as follows: 13 -9(a). The Common Council shall meet on the first and third Mondays of each month unless otherwise determined by a majority vote of same." Section 3: That Chapter 3, Article 2, Division II, Section 3 -9(c) of the Carmel City Code is hereby amended to read as follows: Section 4: That Chapter 3, Article 2, Division II, Section 3 -13(a) of the Carmel City Code is hereby amended to read as follows: Page One of Three Pages §3 -9(c). A special meeting of the Council may be called by the Mayor so long as forty -eight (48) hours advance notice of same has been given to each Council member either verbally, by letter mailed to the Councilor's official address as last provided to the Mayor's office, or by electronic mail sent to the Councilor's City e -mail address or to such other electronic address as has been provided to the Mayor's Office. A special meeting of the Council may be called by the President Pro Tempore of the Council so long as forty -eight (48) hours advance notice of same has been given to each Councilor and the Mayor either verbally, by letter delivered to the Councilor's official address as last provided to the Clerk- Treasurer's Office, or by electronic mail sent to the Councilor's City e -mail address or to such other address as has been provided to the Clerk Treasurer's Office. Public notice of all special meetings shall comply with Indiana law, Any such notice must also be delivered simultaneously to the Clerk- Treasurer's Office." Prepared by Douglas C. The Common Council shall elect from its membership at its last regular meeting each year a President Pro Tempore to serve the following calendar year for a term of one year, except that in years in which a general election is held to elect Common Council members, the election of a President Pro Tempore shall take place at the Common Council's first regular meeting of the year for which such officer is to serve." Section 5: That Chapter 3, Article 2, Division II, Section 3-1 3(b)(5) of the Carmel City Code is hereby amended to read as follows: §3- 13(b)(5). In the absence of the Mayor, the President Pro Tempore shall serve as presiding officer of the Common Council and call and adjourn meetings of same." Section 6: That Chapter 3, Article 2, Division II, Section 3 -15(b) of the Carmel City Code is hereby amended to read as follows: §3.15(b). The Clerk Treasurer shall be empowered to delegate to employees of his or her office the aforesaid responsibilities and shall, if necessary, include a budget request to the Common Council, remuneration for such assistance from the budget of the Common Council. The Clerk- Treasurer shall perform all those other responsibilities set forth in the Indiana Code as regards his or her relationship to the Common Council." Section 7: That Chapter 3, Article 2, Division II, Section 3 -19(a) of the Carmel City Code is hereby amended to read as follows: §3- 19(a). The agenda of the Common Council shall be prepared by the Clerk Treasurer of the City. Council members, the Mayor and/or the Clerk- Treasurer may add items to the Council agenda, but all agenda items must be received in the Office of the Clerk- Treasurer, via electronic transmission or the delivery of a written copy thereof, by 12:00 noon local time, six (6) business days prior to the day of the Council meeting. In the event an agenda item is delivered to the Office of the Clerk- Treasurer via electronic transmission, a written copy of such agenda item shall thereafter be delivered to said office by 12:00 noon local time, five (5) business days prior to the day of the Council meeting. This written copy must be accompanied by an affidavit that the hard copy is in every way identical to the electronic version. If the hard copy differs in any way from the electronic version, it will be removed from the agenda. The Clerk- Treasurer shall mail or cause to be delivered the Council agenda and all supporting materials to each Council member by 5:00 p.m. on the Wednesday preceding the Council meeting to which the agenda pertains. Section 8. All portions of prior City ordinances inconsistent with any provision of this Ordinance are hereby repealed as of the effective date of this Ordinance. Section 9. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.
