shall revert one -half each to the abutting property owners on each side of the Vacation
Parcel; and,
2. Meridian Heights Associates, LLC shall not remove any portion of the hard surface
roadway currently located within the Vacation Parcel until (a) a Development Plan is
approved by the Plan Commission of the City of Carmel, with respect to property that
includes all or a portion of the Vacation Parcel (the date on which such Development
Plan is approved is referred to as the "Approval Date and (b) any alternative roadway
(which may include the continued use of all or a portion of the hard surface roadway
currently located within the Vacation Parcel) required to provide access from and to Lots
33, 35, 36, 37, 38, 40, 41 and 45 (or so many of such Lots that remain in an ownership
other than that of Meridian Heights Associates, LLC, or its affiliates, grantees, successors
or assigns) to and from 131 Street that is required or contemplated by such approved
Development Plan is constructed (the date on which the construction of such alternative
roadway is completed is referred to as the "Release Date and,
3. After the Release Date, Meridian Heights Associates, LLC may remove that portion of
the hard surface roadway currently located within the Vacation Parcel that is no longer
required to provide access to and from such Lots from and to 131 Street; and,
4. Meridian Heights Associates, LLC shall cause all portions of the hard surface roadway
currently located within the Vacation Parcel to be maintained in accordance with the
standards of the City of Carmel Street Department applicable to the maintenance of pubic
rights -of -way, including the removal of snow accumulations, at all times prior to the
Release Date.
This Ordinance shall be in full force and effect on the Approval Date.

Re: Phase 11 Vacation a Portion of Lynne Drive, Sonna Drive, Vivian
Drive and Catherine Drive in North Meridian Heights, Sections 1 2.
Dear Council Members:
Petitioner, Meridian Heights Associates, LLC, is petitioning the Carmel City
Council to vacate a portion of the public rights -of -way for Catherine Drive and
Vivian Drive located within Section 1 of North Meridian Heights Subdivision, as
recorded in the Hamilton County Recorder's Office on March 2, 1959 and filed in
Plat Book 2, Pages 130 and 131, and a portion of the public rights -of -way for
Vivian Drive, Sonna Drive and Lynne Drive located within Section 2 of North
Meridian Heights Subdivision, as recorded in the Hamilton County Recorder's
Office on May 3, 1961 and filed in Plat Book 2, Page 20, as depicted on the
enclosed Exhibit and Legal Description prepared by DeBoy Land Development
Services. Petitioner owns all but 8 lots which abut the rights -of -way proposed for
vacation.
This vacation represents a Phase II street vacation and is filed
contemporaneously with: (i) a Phase I street vacation for a portion of Lynne
Drive and Catherine Drive; (ii) a Phase I plat vacation of 39 of the 47 lots that
make up North Meridian Heights Subdivision, Sections 1 and 2; and, (iii) a
request to vacate platted easements within North Meridian Heights Subdivision,
Sections 1 and 2. The approval of these vacations would allow the Petitioner to
begin redevelopment efforts on the Real Estate consistent with the general
concept set forth in the Draft Site Plan for Meridian and Main enclosed with this
letter.
As a condition of approval of this vacation request, Petitioner would agree to not
remove the street sections north of Vivian Drive that provide direct access to the
remaining 8 lots and shall provide for continuous access from those remaining 8
lots to 131 Street through a private access easement.

Meridian Heights Associates, LLC, hereby petitions the City Council for the City of Carmel,
Indiana, for the vacation of a portion of the public right-of-way commonly known as Lynne
Drive, a public right -of -way commonly known as Sonna Drive, a public right -of -way commonly
known as Vivian Drive and a portion of the public right-of-way commonly known as Catherine
Drive, all located within North Meridian Heights Subdivision, Section 1, as recorded in the
Hamilton County Recorder's Office on March 2, 1959 and filed in Plat Book 2, Pages 130 and
131, and North Meridian Heights Subdivision, Section 2, as recorded in the Hamilton County
Recorder's Office on May 3, 1961 and filed_ in Plat Book 2, Page 20.
In support of this request, Petitioner notes that:
1. The area of the North Meridian Heights Subdivision has changed over the years and with
the creation of the Meridian. Street Overlay. One aspect of the Meridian Street Overlay is
to prohibit single family development for which North Meridian Heights Subdivision and
street network were designed. The area has also been rezoned from.S -2 to the B -6
classification to provide for redevelopment of the subdivision.
2. The specific description of the property to be vacated has been prepared by DeBoy Land
Development Services, a copy of that'legal description is attached.
3. The owner of 23 of the 31 lots abutting the portions of Lynne Drive, Sonna Drive, Vivian
Drive and Catherine Drive petitioned for vacation is:
