The Minutes of the October 20, 2009 meeting were approved as submitted.
Legal Counsel Report, John Molitor: Regarding the Johnson Acres Garage, the Court over -rules the
defendant's motion to dismiss. The next step is for the defendant to file a formal answer to the neighbors'
complaint against him.

1. Docket No. 09090017 OA: 116th and College PUD (116th Street Centre, Ph 2)
The applicant seeks approval to amend Ordinance Z- 484 -05: 116 Street Centre Planned Unit
Development (PUD). The site is located at the northeast corner of 116"' St. and College Ave. and is
zoned PUD. Filed by Steve Hardin of Baker Daniels, LLP for J.C. Hart Company, Inc.
Present for Petitioner: Steve Hardin, attorney, Baker Daniels; John Hart and Todd May; Randy Sherman,
architect; Mark Zuckerman, Equicor Development.
Overview:
Petitioner has worked with the DOCS Staff on design site plan issues

Suggest ramp to front door parking area incorporate 3 or 4 feet of landscape to lessen impact of ramp

Doors will be installed on dumpster
Brick enclosure is taller than the dumpster
Enclosure materials will match foundation of the building

3. Docket No. 09100005 OA: Carmel Dr Range Line Road Overlay Sunset Amendment
The applicant seeks to amend the Zoning Ordinance, Chapter 23F: Carmel Drive -Range Line
Road Overlay Zone in order to extend the sunset clause. Filed by the Carmel Department of
Community Services.
Present for Petitioner: Alexia Donahue -Wold, Dept of Community Services.
Overview:
Sunset Clause currently expires December 31, 2009
