The site is zoned S -1 /Residence Estate. Filed by Dawn Barnett of Drees Homes. General Information: The petitioner is seeking VV 141 ST ,'„IN;;, I il T approval to build a bathhouse and pool o amenity area in the S -1 �3 Residence Zone. It needs to be fifteen (15). When you get comments from Scott Brewer if you would take the perimeter of the active use area as opposed to the entire site, you can take some of those plantings and put them in other areas to provide screening along the parking lot and augment the area. We would like to see more shrubs planted adjacent to the parking lot and the future lot. Access from the parking lot to the pool area I see one connection, is that the only intended connection? A comment from the County Highway the entrance detail with the curb interval I want to see some detail about that entrance and either make it all asphalt into the site with integral curb or all concrete up to the back side of the sidewalk and not install curb between the sidewalk and the street. Analysis: The pool amenity area will be landscaped accordingly, and the structure will be built with unique materials, giving the neighborhood an aesthetic focal point. Plan Commission approval for improvements (ADLS Amendment) to the neighborhood, such as pocket parks has been granted. The Urban Forester stated that the landscape plan is adequate, and he is waiting for a revised plan that identifies each type of plant on the plan and shows dimensions of the site. 1 -4! Findings of Fact: SU 1.) The Special Use in the Flood Plain District, Ordinance Z -160, Section 21.6 as amended does not apply and all prerequisites have been met by the Petitioner as verified by: The site plan does not show the property in a flood plain. 2.) The Special Use will be consistent with the Character and the Permitted Land Use of the Zoning District and Carmel/Clay Comprehensive Plan because: while the Comprehensive Plan does not address the estate residential areas, the low intensity residential area policy states that these areas should be served by and accessible to... parks or playgrounds and schools and bicycle and/or pedestrian trails... (Comp. Plan, pg.5 -5). 3.) The Special Use is physically suitable for the land in question because: The poolhouse and pool are physically suitable for the site because it is in a common area, so that residents may enjoy an amenity in the neighborhood. 4.) The Special Use will not be injuriously or adversely affect the adjacent land or property values because: The poolhouse and pool will increase or keep property values the same, since the proposed use is an amenity to the neighborhood. 5.) The Special Use will not adversely affect vehicular or pedestrian traffic flow, nor the adequate availability of water, sewage, or storm drainage facilities or police or fire protection because: The poolhouse and pool will not affect the availability of facilities. All utilities already exist. 6.) The Board has reviewed the requirements of the Ordinance Z -160, Section 21.3 (1 -25) as they relate to this Special Use, and does not find that those criteria prevent the granting of the Special Use: The site plan has been reviewed, and the meets all requirements for a pool and poolhouse, except a commitment of a lifeguard and the pool being a minimum of 2000 square feet in area.
