FINDINGS OF FACT DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
it does not increase the density of what the zoning ordinance will allow absent the variance, and will not
dreate any traffic safety hazard. Additionally, the Community will benefit from upgrading the development of
the parcel with modern, upscale construction.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The development density will be compatible with that of adjacent property, and the proposed development
allows for adequate side and rear yards.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in
the use of the property because:
The flood plain located at the back of the property has reduced the available lot depth and area, thus making
it impractical to provide for the required setback. Additionally, the 50 foot half right of way for 106 Street
has reduced the developable size of the parcel.
DECISION
IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by
reference and made a part hereof.
