The applicant seeks the following development standards variance approval:
Docket No. 09120001V 5.04.03.A Reduced front yard setback
The site is located at 1800 106 St and is zoned S1/Residential.

k 4, W, Analysis: Purchase of right -of -way will reduce

to fifteen feet. The site is heavily wooded, and

Findings of Fact: Reduced front yard setback.
7. The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: the reduction will provide for a bicycle path as well
as legally establishing a reduced setback.
8. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: the reduction will provide for a bicycle
path as well as legally establishing a reduced setback.
9. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the property likely could not be
developed without the grant of a variance.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket No. 09120001
V after all concerns have been addressed.
