for store construction, the store design criteria, the sign criteria and the lease exhibit represent the scope of work performed by Tony Sacco's (Tenant) General Contractor. C. All work
materials and construction shall conform with any and all applicable federal, state and local building, health and fire codes and ordinances; comply with the SIMON PROPERTY GROUP design
standard and requirements. D. All discrepancies or omissions on drawings must be brought to the attention of Tony Sacco's , by the General Contractor prior to the start of work. Failure
by the General Contractor to identify errors or omissions will not be grounds for extras. The Architect must be made aware of any omissions or discrepancies. E. General Contractor shall
be responsible for distribution of complete sets of contract documents (drawings & specifications) to all trades. Each trade shall review all contract documents so as to be aware of
all items of work affecting their respective trade. No claims for "extras" will be honored due to failure to review complete set of documents. F. Do not scale drawings -use dimensions
only. G. Field verify existing construction, configuration and dimensions. General Contractor to confirm all dimensions against actual site conditions. Any conflict or discrepancies
in dimensions or elevations shall be resolved with the Architect prior to proceeding with the work or procurement of materials. H. The General Contractor shall verify all counter and
cabinetry dimensions as represented on the construction drawings with the existing site conditions prior to the start of construction. Should there be any discrepancies, the General
Contractor shall report them immediately to the Architect and the Project Manager so to avoid any problems in the placement of counters. I. Any request for extras (change orders) must
be approved in writing by the Construction Manager of Tony Sacco's . No extras can be authorized by the Operations Personnel. J. The General Contractor shall not acknowledge any requests
for additional work by any Landlord Agent without obtaining prior approval from an authorized representative from the Tony Sacco's office. K. The General Contractor shall obtain permits,
approvals, inspections, certificate for compliance and certificate of occupancy as required, unless otherwise noted by Tony Sacco's . L. The General Contractor is responsible for all
final inspections. M. The General Contractor shall check with and coordinate all work with the Landlord's Project Personnel. N. The General Contractor shall maintain on site at all times,
all approved drawings including all revisions and addenda, and bulletins. O. The General Contractor shall provide in writing to Tony Sacco's a one (1) year warranty from final acceptance
for all sprinkler, HVAC, plumbing, and electrical work. P. The General Contractor shall coordinate all trades necessary to complete the work outlined in these documents. Q. The General
Contractor shall provide "As-Built" drawings for the Landlord within seventy-five (75) days of completion of construction. R. The General Contractor shall be responsible for all safety
precautions and requirements during construction. S. The Architect will not have control over or charge of and will not be responsible for construction means and methods, techniques,
sequences or procedures or for safety precautions and programs in connection with work, since these are solely the Contractor's responsibility. The Architect will not be responsible
for the Contractor's failure to carry out the work in accordance with the documents. The Architect will not have control of or charge of and will not be responsible for the acts or omissions
of the Contractor, Subcontractors or their Agents or employees or any other persons performing portions of the work. T. The General Contractor shall coordinate the shipping of all items
noted as "Supplied by Tony Sacco's". U. The General Contractor shall receive, assemble and/or install store equipment and furniture (per Tony Sacco's ' final furn/equip plan)and other
items, including setting of all shelves prior to the delivery of food to the restaurant. V. The General Contractor shall have the space cleaned upon completion of the work by a professional
cleaning service. W.General Contractor is to coordinate all work with the Landlord's Project Personnel. X. Sign manufacturer is to submit signage shop drawings to Tenant and Architect
for approval. Submit sketches or photographs of any planned graphics, prior to fabrication and installation. Y. General Contractor shall minimize dust generation and protect return ducts
and return plenums from airborne dust during demolition and construction. Z. Shop drawings shall be submitted (by General Contractor) to the Architect/Engineer for approval prior to
fabrication or installation of any item. AA. Egress doors shall not lock against the direction of egress travel. BB.All construction shall be in accordance with the barrier free requirements
of the ANSI A117.1and the Americans with Disabilities Act (ADA), whichever is more stringent CC. All trades shall coordinate their work with TONY SACCO'S installers and contractors.
DD. Permits may be required for stock room shelving. Verify and comply with local codes. EE.For the purpose of these drawings, the terms " Tony Sacco's " and "Tenant" shall be used and
interchangeable. FF. For the purpose of these drawings, the terms "General Contractor", "Contractor", "T.I. Contractor" and "Tenant Improvement Contractor" shall be used and interchangeable.
GG. The Contractor shall obtain and furnish Tenant with certificate of occupancy, and/or intermediate (temporary) certificates of occupancy as required for Tenant to construct Tenant
interior improvements within demised premises. HH. The design and construction work shall be in accordance with applicable design standards, all ordinances, state and local building
codes, and all governing codes. In the event of conflict between the applicable codes, the most stringent requirement shall be followed. II. No construction work may begin prior to issuance
of building permit. JJ. Insurance: coordinate with Tony Sacco's construction requirements. KK. Contractor shall provide field dimensions for Architect, Construction Manager and Fixture
Manufacturer. LL. Work hours are to be coordinated with Landlord and Tony Sacco's . Work outside and above space shall be coordinated with the Landlord. MM.Contractor is responsible
for removing all construction debris from job site on a nightly basis or as required by the job schedule. There will be no access to a dumpster and placement of a dumpster shall be confirmed
with the Landlord. NN. Contractor shall be responsible for protection of all existing surfaces outside of Tenant space that is utilized by them for: work, travel or material storage.
OO. All storefront components within a Tenants lease line are to be constructed by Tenant. PP. Contractor is required to maintain a copy of as-built drawings on site at all times. GENERAL
NOTES: Plans reviewed and approved by Landlords Tenant Coordinator must be present on the jobsite and accompanied by the approved building department plans. Any deviation from Landlord
approved plans must be resubmitted to Landlord for approval. All plans must be signed and sealed by an Architect and Engineer, licensed in the state where the work will be performed.
Approval of Tenant's construction documents and specifications by the Landlord does not release the Tenant/Contractor from complying with the lease agreement and all applicable building
codes and governing regulations. Landlord and Tenant responsibilities are as outlined in the lease. The Tenant shall be responsible for verifying that these remodel/construction documents
meet all A.D.A. standards and requirements. It is the reponsibility of the Tenant or the Tenant's Contractor to field verify existing conditions and dimensions at . Tenant must submit
finish samples. All roof penetrations and related roof work must be done by the Mall's Roofing Contractor at The Mall's Contractor must be utiliized for all modifications to the sprinkler
system at . the sprinkler system must be fully charged and operational prior to Contractor going off site. Nothing is permitted to be attached to, suspended from, or penetrate the roof
deck. You must attach to the the top chord of joist or structural steel, which exists above the Tenant's space. Any existing material/equipment not being reused must be completely removed
and disposed of preperly at . Any utilities to be removed must be dismantled back to point of origin. All floor penetrations through concrete slabs must be core-bored or saw cut, sleeved,
sealed, firestopped and waterproofed. All piping sleeves shall extend a minimum of 4" in height. All patching must be level and flush with existing concrete floor. Any wet/kitchen/food
prep areas on upper levels must be waterproofed using a 30 mil. polyethylene cleavage space membrane before finished floor is applied. Tenant must demonstrate watertight integrity of
the membrane to Landlord's field representative. Any masonry openings to be in-filled, must be done iwth exact materials to match existing exterior of building materials must be approved
by Mall Management. The Tenant's Contractor is responsible to comply with all Property Management rules and regulations per Landlor criteria and instructions by the Landord On-site Management.
