This letter and enclosure are sent to inform you of a variance request by the City of Carmel Hamilton County to reduce the setback of 2 properties totaling 1.83 acres and located at 3760 W. 96`" Street and along Augusta Drive North. The site has recently been rezoned to the B5/US 421 Overlay District category, per Docket No. 09090023 Z. The properties are also identified as tax parcel ID numbers 17 -13- 07-00-00- 038.000 and 17- 13- 07- 00 -00- 037.000. The site plan, included, shows details on the proposed re- configuration of Augusta Drive and the resulting dimensions and layout of the site. Designated as Docket No. 09110032 V, the hearing will be held on Tuesday, January 6, 2010, at 5:30 PM in the Caucus Rooms, Carmel City Hall, One Civic Square, Carmel, IN 46032. The file for this proposal (Docket No. 09110032 V) is on file at the Carmel Department of Community Services, One Civic Square, Carmel, Indiana 46032, and may be viewed Monday through Friday between the hours of 8:00 AM and 5:00 PM. Any written comments or objections to the proposal should be filed with the Secretary of the Board of Zoning Appeals on or before the date of the Public Hearing. All written comments and objections will be presented to the Board. Any oral comments concerning the proposal will be heard by the Board at the hearing according to its Rules of Procedure. In addition, the hearing may be continued from time to time by the Board as it may find necessary. Hamilton County is currently in the process of final design of a major road improvement project east of 96th Street and US 421. As part of the plans for the project to construct the 96th Street/North Augusta Drive roundabout, the County will be taking the office building located at the northeast corner of the intersection. Mr. and Mrs. Ramon Stair, owners of the property, are in the process of finalizing an agreement with the County to relocate the existing building on a parcel of ground immediately contiguous to, and north of, the buildings existing location. In doing so, the Stair family will preserve an older well maintained building, will eliminate their existing mound sanitary system, and connect to the existing Wastewater Utility. The County is planning to extend North Augusta Drive (to be renamed to Commerce Drive) and improve 96th Street to become a safer and more efficient roadway. The proposed project includes the reconstruction of 2,600 feet of 96th Street from just east of US 421 (Michigan Road) to just immediately east of Sycamore Road, which is east of Shelborne Rd. The project also includes the reconstruction and extension of Commerce Drive to include improvements to the existing North Augusta Drive. The improved 96th Street will be widened and consist of two 12' travel lanes in each direction separated by a 10' raised grassy median. Additionally an 8' multi -use path will be placed behind a 5' buffer on the north side of the road, and a 5' concrete sidewalk will be placed behind a 5' buffer on the south side of the road. The roadway on Commerce Drive will generally be one 12' travel lane in each direction, in some locations the travel lanes will be separated by a 12' two -way left turn lane. Eight foot wide multi- use paths will be placed behind a 5' buffer on both sides of the roadway. Roundabouts will be installed at the intersection of 96th Street and Shelborne Road and at the intersection of 96th Street and Commerce Drive (existing North Augusta Drive).
