RE: LAND USE VIOLATION
Dear Ms. Brust:
This letter is being provided to inform you that our department has recently received some
concerns regarding The Carmel Performing Arts Center at 575 Carmel Dr W, in the
City of Carmel, a property listed under your ownership. After conducting lengthy research
into the original petition for ADLS and the recorded approval, the M-3 zoning ordinance
and the permitted use table I have concluded that the use of your facility as anything other
than a dance/gymnastics studio is not permitted and, therefore, constitutes a violation.
I am officially informing you that you must discontinue the dances and/or raves that have
occurred in your facility and the other 3 that are planned for the future. No further
activities such as these will be allowed to occur and if they do continue then a citation and
summons will be issued commanding you into Carmel City Court to answer to the charge
of failure to comply with my request. The hearing could result in fines being assessed by
the judge for each day of violation up to the maximum allowed by state law $2500 per day.

3i. Commission to consider Docket No. 50-93 SP, a Secondary Plat application for The Carmel
Performing Arts Center. The petitioner seeks approval to plat a 1.96 acre lot within Block 12
of the Carmel Science and Technology Park. Site is located at 575 East Carmel Drive and is
zoned M-3. Filed by Theresa K. Brust.
4i. Commission to consider Docket No. 51-93 ADLS/DP, a Development Plan and an
Architectural Design, Lighting, and Signage Application for The Carmel Performing Arts Center.
The petitioner seeks approval to construct a two story, 18,900 square feet dance and gymnastics
studio at 575 East Carmel Drive, Carmel. The site is zoned M-3 and is located within Block 12
of the Carmel Science and Technology Park. Filed by Theresa K. Brust.
Tom Ryan, commercial general contractor, appeared before the Commission representing Theresa
K. Brust, also present. Also present for the petitioner was Steve Horman of Cripe Engineering.
At last month's meeting, Staff endorsed this project and stated that it does represent retail usage
within the technology park. Staff reiterated that this project meets all requirements of the statute.
Christopher C. Painchaud moved for joint approval of Docket No. 50-93 SP and Docket No. 51-
93 ADLS/DP, seconded by Dick Klar, unanimously approved
5i. Commission to consider Docket No. 52-93 PP (Cluster), a -Primary Plat application for
Shady Brook subdivision. The petitioner seeks primary plat approval to plat 56 lots on 34.2 acres
of land located on the northeast comer of 99th Street and Chester Road, Clay Township. The
site is zoned S-2.
The petitioner is also requesting the following Subdivision Regulation variance: 6.3.7 - Length
of a cul-de-sac to exceed 600 feet. Filed by Mark Boyce for C.P. Morgan Development.
Jim Nelson, 3663 Brumley Way, Carmel, appeared before the Commission representing Shady
Brook. The project site is located east of and adjacent to Keystone, north of Keystone's
intersection with 99th Street. The Primary Plat was presented at Subdivision Committee and the
vote was unanimous recommendation for approval. There has been one change in the plan
between the public hearing and the subdivision committee meeting and that is that the entry wail
treatment adjacent to Chester Road and Keystone Avenue now provides that the brick wall
contains sections of wrought iron so that passersby will be able to view the project, and those
within will be We to see out.
