PO Box 24007 Indianapolis, IN 46224 RE: ZONING ORDINANCE VIOLATION — WEEKEND RIGHT-OF-WAY SIGNS Dear Sir or Madam: This letter is being provided to inform you that a temporary sign(s) violation has been brought to this department's attention. The signs advertise for the Alexandria Apartments and were located at several intersections along Rangeline Road, Carmel Drive, 1161" Street, and several other thoroughfares within the City of Carmel. BUSINESSES ARE NOT PERMITTED TO DISPLAY SIGNAGE IN THE PUBLIC RIGHT OF WAY. Furthermore, signs that advertise for services or goods that are not offered on the property upon which they are installed are also a violation of Carmel's Zoning Ordinance. According to Section 25.07.01-4 Prohibited Signs, of the Carmel/Clay Zoning Ordinance the following signs are prohibited: (f) Signs consisting of banners, posters, pennants, ribbons, streamers, strings of light bulbs, spinners or similar devices, unless they are permitted specifically by other sections of this Ordinance. (1) Signs which are located upon, over, or in any street or highway right-of-way, except for official highway signs; (k) Signs which are established on trees, utility poles, or fences. (1) Signs which advertise goods, products, services or facilities or direct persons to a different location (or to a telephone number at a different location) from where the sign is installed. (Off -premise signs require a Developmental Standards Variance from the Board of Zoning Appeals.) Furthermore, this violation includes a banner installed on the roof of one of your apartment buildings (shown to the right). These standards apply to all of Clay Township and will be enforced throughout the entire township. This letter and Violation Notice shall serve as the first and final warning. After April 3, 2009, any documentation of signs in the public right-of-way or signs which violate any standard of the Carmel/Clay Zoning Ordinance, including the roof -top banner installed on the apartment building, will result in the issuance of a Complaint and Summons to appear in Carmel City Court resulting in the assessment of any applicable fines.
