They have been given until April 9 to do the work, but I'm not anticipating that they will get
anything done. If 1 have a quote in hand, we can have you go do the work the day after.

RE: CITY CODE VIOLATION — RUBBISH/ GRAFFITI/ PUBLIC NUISANCE
Dear Sir or Madam:
This letter is being provided to inform you that an inquiry was made to the Department of
Community Services regarding a possible City Code Violation at 1045 Rangelfne Rd., in the
City of Carmel, a property listed under your ownership. An inspection revealed that the concern
appears to be valid and that the property is in violation of the Carmel City Code, §6-77(k), which
construes the following conditions to be public health nuisances:
(k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building
materials, machinery, dead trees, or parts thereof, upon any premises in a
residential area.
And, Carmel City Codes § 6-82 (a), (b-1), and (b-7) that specifically defines graffiti,
violation status, and removal procedures:
(a) Graffiti shall include markings which deface, deform, mar or which cause the
defacing, deforming, or marring of any public or private property including
by way of illustration and not limitation, buildings, trees, lampposts, poles,
hydrants, bridges, piers, sidewalks, streets, and alleyways, or the surface of
any public or private property located upon any public thoroughfare or right-
of-way, or upon any public place within the City. However, this section shall
not prohibit the posting of notices required by law to be posted.
(b)(1) It shall be unlawful for any person to cause the appearance of graffiti on
public or private property within the Carmel corporate city limits.
(b)(7) If the owner fails to abate the violation within the time prescribed by the
notice, the owner shall be deemed to have granted permission to the
respective city official to cause a designed of the City to enter the property
for the limited purpose of covering and/or removing such graffiti.

The structure on the east side of the property (the vacant house) is also a public nuisance as
defined by the City of Carmel Property Maintenance Code, specifically § 6-222, which states:
§6-222 (a) (4) Vacant structures and land. All vacant structures and premises thereof or
vacant land shall be maintained in a clean, safe, secure, healthful and sanitary condition
as provided herein so as not to cause a blighting problem or adversely affect the public
health or safety or violate the provisions of this Code.
§6-222 (b) (1) Sanitation. All exterior property and premises shall be maintained in a
clean, safe and sanitary condition. The owner or occupant shall keep that part of the
exterior property, which such occupant occupies or controls in a clean and sanitary
condition.
§6-222 (c) (1) General. The exterior of a structure shall be maintained in good repair,
structurally sound and sanitary so as not to pose a threat to the public health, safety or
welfare.
There are also several sections of the Carmel City Code § 6-159 Unsafe Building Regulations
that can be applied to the property in its entirety. The property needs to be maintained and free
from rubbish, debris, and graffiti. The structures also need to be secured immediately (all
windows and doors) and monitored to ensure they remain secure. As I was doing my inspection
several children came out of the unsecured structure and walked to the adjacent apartment
complex.
Please bring all violations of the Carmel City Code into compliance by April 9, 2009. Failure to
resolve the violation(s) by the specified deadline will result in further enforcement action by the
City of Carmel, to include City abatement of all issues (to which property owner is billed). Other
measures could also include daily citations being issued, appearance in Court, and the possible
demolition of any structure(s) that meets the Code provisions. If you have any questions or
