Carmel, Indiana 46032 RE: CITY CODE VIOLATION — CONDITION OF PROPERTY Dear Mr. & Ms. Thorburn: This letter is being provided to inform you that an inquiry was made to the Department of Community Services regarding a possible City Code Violation at 85 Harmony Drive, in the City of Carmel, a property listed under your ownership. An inspection revealed that the concern appears to be valid and that the property is in violation of the Carmel City Code, §6-77(k) and §6-88(c) which construes the following conditions to be public health nuisances: (k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building materials, machinery, dead trees, or parts thereof, upon any premises in a residential area. (c) Requirement to cut. All owners of real property ("property") located within the City shall cut and remove weeds and other rank vegetation growing thereon that exceeds an average height of six inches, and shall keep their property clear of debris. Please bring the condition of this property into compliance with the Carmel/Clay City Code by July 17, 2009. Failure to resolve the violation(s) by the specified deadline will result in further enforcement action by the City of Carmel. While their front yard is not terrible at the moment, their back yard has not been mowed or maintained in 4 years. There are maple sapling trees growing in the gutter. The overgrowth of grass, weeds, brush, and other assorted foliage within their back yard is abominable. Grass and weeds are easily 4 feet tall. I try to maintain my yard, front and back, to an acceptable level. Surely, it's not a golf course. However, I simply cannot effectively combat the weeds, pollen, and insect infestation that is occurring next door. Simply, their lack of maintenance is degrading my quality of life and property value. The pollen from the weeds and the insects are so bad that I cannot spend time in my yard. I am honestly concerned that it may pose a public health risk. Additionally, with two children living at home, I have concerns for their welfare —what are the living conditions inside the house? My neighbors have often expressed similar concerns. Please use this letter as formal authorization to come onto my property at 91 Harmony Road in order to gain a view into their back yard. You have my permission to access my property, including my back yard. If you, or your inspector, will advise me of the time of their visit I will endeavor to have my two veryfriendly female Weimaraner dogs (Emmy & Luna) restricted to the run on the south side of the house during the visit. Normally, they have "free reign" in the back yard. I am currently attempting to "spruce up" my front yard, so when your inspector visits you may see signs of recent plantings and shrub removal. Additionally, for reference, I am enclosing photographs taken of their property from my yard, an "aerial view" from my roof, and the street. Thank -you for your assistance. Sincerely, Peter J.
