(317) 571-244-4 FAX (317) S71-2499 Issues at 1107 Laurelwood/10097 Cedar Ridge: Property Line: It appears from the GIS that the current landscaping and structure of the property encroaches the eastern property line. It is possible that the GIS lines are off, but it may be something to consider as we consider these other factors, as well. Even if the property lines have been honored, there appears to be a probable side yard setback encroachment along the West property line and possibly an encroachment into required front yard. Replotting of Lots: It appears that the two lots on which the property owners (The Edwards) have joined to construct their home have not been replatted into a single lot and, therefore, still exist with the existing platted easements, lot lines, etc. These lots need to replatted into a single lot and recorded appropriately. (See email from County Surveyor's office) The driveway: The property owners currently own a lot in an adjacent platted subdivision on which they have demolished the home and pool and cleared the lot. They have provided access to their Laurelwood property at the expense of the berming and wooded buffer that sits between these two lots and have cut through the woods and berm in two locations. It appears that the property owners intend to put a portion of their driveway on this adjacent lot in the other platted subdivision that isn't part of the gated Laurelwood subdivision. We have also heard that the intention for this driveway is for guest parking as well as additional access to the residence. Lot Coverage: It appears that the development of this lot is in excess of the 35% maximum lot coverage that is permitted by the S-1 Zoning classification. Now, with that said, the PO is crossing drainage and utility easements in both Laurelwood and Cedar Point and I am sure this will cause problem with somebody. There may be utilities in the easements and they would have rights to the easement or the easement may convey storm water runoff from other properties and he can not block the flow of the water. I would guess the HOA would have authority over the drainage easements as part of the covenants. I also noticed that he combined 2 lots into one big parcel in Laurelwood, but did not do it by replat. That would mean the easement on the common property line of the 2 lots is still legally there (not an official legal opinion), so he has a 20' Maintenance easement right through the middle of his house, that somebody has rights to. We are going to still look into this as a possible erosion control violations, as he has area that appears to not be properly protected and does not have vegetative cover. Our person that handles that is out of the office today, but I will get it to him tomorrow morning. I will let you know if he takes any action using that route. Now, with that said, the PO is crossing drainage and utility easements in both Laurelwood and Cedar Point and I am sure this will cause problem with somebody. There may be utilities in the easements and they would have rights to the easement or the easement may convey storm water runoff from other properties and he can not block the flow of the water. I would guess the HOA would have authority over the drainage easements as part of the covenants. I also noticed that he combined 2 lots into one big parcel in Laurelwood, but did not do it by replat. That would mean the easement on the common property line of the 2 lots is still legally'there (not an official legal opinion), so he has a 20, Maintenance easement right through the middle of his house, that somebody has rights to. We are going to still look into this as a possible erosion control violations, as he has area that appears to not be properly protected and does not have vegetative cover. Our person that handles that is out of the office today, but I will get it to him tomorrow morning. I will let you know if he takes any action using that route.
