The subdivider shall be required to provide and install certain minimum improvements in the subdivision as a condition for approval of the Final Plat by the Commission. All such required improvements shall be constructed in accordance with the minimum requirements of these regulations and the construction standards and specifications adopted by the jurisdiction over a particular improvement. Nothing contained herein, however, shall be construed as prohibiting the subdivider from installing improvements meeting higher standards than the minimum requirements. 3.01.01 A failure to comply with any of the requirements of this Ordinance, including violations of conditions and safeguards established in connection with the granting of variances, special uses, rezonings and development plan approvals shall constitute a violation of this Ordinance. 26.04.01 The requirements of this Section shall apply to all Special Uses, Subdivision Plats, properties containing multi -family uses, and properties within all Business, Manufacturing, and Industrial districts, unless other buffer or perimeter planting standards are specified within an individual district or zone. Overview The bufferyard landscaping for lots 17-21 of Westwood Estates does not comply with the Landscape Plan approved by the Carmel Plan Commission on December 12, 2002. The approved plan required a landscape buffer of not less than ten feet in width with plantings to conform with the requirements of the bufferyard B classification under Chapter 26 of the zoning ordinance. No separate written commitment was made nor recorded with respect to the landscaping requirements. Lots 17-21 have a required 30 foot county regulated drainage easement along the south property line. This is a closed drain and the pipe is located within ten feet of the south property line. Currently, trees have been planted within the drainage easement; however, ilre number of trees planted do not comply with the approved Landscape Plan. Single family homes have been built on all but one of the affected lots. I contacted Mike Howard, Hamilton County Attorney, to seek approval from the County to plant trees within the drainage easement. Mr. Howard stated that the Hamilton County Drainage Board, at its meeting to be held on August 14, 2007, will consider a resolution which would transfer enforcement of encroachment matters to local municipalities, where a drain is located within the corporate limits of a municipality, and require any party seeking encroachment to sign a waiver of liability document. The waiver of liability document will release the County from any liability arising from its maintenance of regulated drains. Proposed Actions 1. New Landscape Plan. Justus is in the process of preparing a new landscape plan which will conform to the B bufferyard landscape requirements as agreed to with the Carmel Plan Commission. Approval of Variance. Later this week, Justus will submit the proposed new landscape plan to Scott Brewer of the Department of Community Services and to Gary Duncan of the Department of Engineering for their review and approval. Following the approval by both Brewer and Duncan, and the adoption of the new drainage resolution by the Hamilton County Drainage Board, Justus will submit an application on or before September 7, for a development standards variance to the Carmel Board of Zoning Appeals to allow the bufferyard landscaping to be located in the drainage easement. The variance petition would be heard at the November 26 meeting of the Board of Zoning Appeals. 3. Aporoval of Amendment Landscape Plan by Subdivision Committee. If the variance is granted, Justus will file an amended ADLS application for approval of the new proposed landscape plan. This application could be heard by the Subdivision Committee of the Plan Commission on December 4, 2007. Upon approval by the Committee, the landscape plan will be implemented as soon as possible subject to weather conditions and plant availability. It is impossible after the fact to determine whether, without the commitments, the entire project would have been denied. It is only reasonable to assume that all commitments that were part of the approval process were considered both important and necessary. There is also a serious matter of public trust if the public can not absolutely count on all commitments being fully fulfilled. We are aware that Justus Builders have not fulfilled their landscape buffer requirements at Westwood Estates. Inadequate landscape buffering is an issue that many area residents can quickly become very heated about. We have heard many complaints and have too often been the bearer of bad news that, at least in the past, the approval process has not included any requirement for maintaining the landscaping in the buffer. We know the Plan Commission has made improvements in this and very much urge you to insist on a landscape buffer maintenance provision in all developments. In the particular case of Justus Builders, it is imperative they be required to fulfill the landscape buffering plan. Justus Builders knew as a result of the Feb. 19, 2003 TAC meeting, well before building the first house, that they would not be permitted to use any part of the drainage easement for landscape buffering. (See attachment of relevant minutes.) This was a foreseeable problem for which Justus Builders seems to have gambled that they could agree to the requirements and then ignore fulfilling and/or beg release rather than adjust their plans. To now claim this as a hardship and be granted relief would be outrageous and is unacceptable. This is not a precedent area residents want set nor do we believe Xou and other City officials want to set this kind of precedent. We ask that you do whatever possible to ensure the commitment Justus Builders made in gaining approval for Westwood Estates was not an "optional' agreement. For the right price, there is likely more than one option for fulfilling the commitment without moving or tearing down homes already built. Perhaps it is possible for Justus Builders to buy back land from homeowners in Westwood Estates to gain the buffer space. Perhaps it is more feasible to purchase the additional land from the adjoining property owners. Another alternative might be to arrange legally, in perpetuity, a "lease" on the adjoining properties of an area for planting and maintaining the required additional landscape buffering. Perhaps some other good plan can be developed. However, please realize that compensatory planting elsewhere is not acceptable. Such compensatory planting would not 7/31/2007 Page 2 of 2 provide any relief for the directly affected homeowners and would defeat the very purpose of the landscape buffering requirements. Anything less than full buffering will anger and destroy trust not only for the adjoining property owners, but also for many area residents not directly affected. We ask that you inform Justus Builders that they lost their gamble and that you direct them to spend the money it takes to fulfill their agreed upon requirement for gaining approval of Westwood Estates. We also ask that you keep this problem in mind when reviewing any proposal for Justus Builders. Their lack of compliance with this commitment indicates they require close scrutiny and that you must question even routine details. Rich Kelly (EMHT Engineer) and I met with Greg on 5/7/07 at 3:30pm and tried to get his favorable acknowledgment concerning the drainage easement along the Crook property even thou Greg's email below states the Counties position on this matter. Greg was very respectful, but indicated that his office would not be giving a favorable recommendation for the reduction of the easement if we decided to petition his Board for a "Non- enforcement Agreement on individual Tracts". I unfortunately have exhausted all the options that we can think of to accommodate all parties. I apologize that this has become a burden for all involved, but I need the assistance of the City to help with a solution. Please let me know what my next step will need to be. "There are areas of ground on the Plat marked "Landscaping Easements". Such Landscape Easements are hereby created and reserved for the use of the Developer, during the Development Period, and the Association for access to and the installation, maintenance and replacement of foliage, landscaping, screening materials, entrance walls, lighting, irrigation and other improvements. Except as installed by Developer or installed and maintained by the Association or with the approval of the Architectural Review Committee, no structures or improvements, including without limitation piers, decks, walkways, patios and fences, shall be erected or maintained upon said Landscape Easements. The landscape easements shall also provide for access for the public to utilize the asphalt walking path located within the common area for access through the common areas to adjoining properties. Access to the public shall be limited to the asphalt path only." That is what has been established by the covenants. To let you know, I do not enforce subdivision covenants when they exceed what township or city codes provide for already. That is totally up to the Homeowner's Association to pursue. If they want to go after the deck after they take control that is completely up to them. All I have is a deck already constructed that requires a permit in order to legally establish it. And we will issue the permit. What I was making a comment on was concerning the landscape installation inside that 30' drainage easement. That is what the county is not going to permit to happen. These restrictions were also clearly again stated in the secondary plat, as I have pointed out before. Chris Miller of Justus is working on the landscaping issues. He has already had a meeting with the Hamilton County Surveyor and his staff to ask permission to install landscaping in that 30' easement area that was approved. The answer given was absolutely not. No one at the Plan Commission, DOCS staff or Justus knew at the time of the hearings that the county would not permit this to occur. We have found out that there is a regulated drain in that easement, but had no way of knowing that the county would take such a stance as it pertains to landscaping near one. Justus is preparing to go back in front of the Plan Commission with this information and request a modification of the original plans as approved. There will be a hearing open to the public with the usual notifications provided so you will be able to present your side of this issue at that time. As far as the decks go, Justus has filed the necessary paperwork with the Surveyor's Office to obtain permission for the deck at 2123 Renegade Ct. This approval is forthcoming and when they receive it they will apply for the required permit. Justus has already filed applications for 2 of the other ones and they are currently under review. Mr. Bartz' deck at 2087 Renegade Ct. has been released from the permit requirement as it is not over the 30" height regulation and, therefore, does not require a permit. They can also put it on some of the open space. I see this move by Justus as a continuation of the harrasement they have caused us. As I have previously stated, I want to have my say when the homeowners ask for a variance for the decks in the drainage easement. I have not heard whether you have sent a letter to Dave Martin on his deck. Even though it does not encroach as much as the Burns' deck, it still is within the drainage easement. Justus has not been worthy of allowing them to put the construction trailer on our property line. We have looked at it long enough. If they do not relocate it, I will begin to pile junk along my north property line so the Westwood "Winers" get a dose of what we are getting to deal with. They are working towards a solution on the landscaping issues as well as helping the homeowners obtain permits for their decks as I requested. The construction trailer is back because they applied for a permit for it and they have a right to utilize one during the development/construction of the subdivision. The large green storage container is being removed from Westwood. We should see the container disappear very soon; this week I believe.
