Box 30188 Indianapolis, IN 46230 RE: ZONING ORDINANCE VIOLATION Dear Sir or Madam: Last fall, you received a letter from me dated October 11, 2007 regarding the concerns our department received relating to 755 E. 106th Street in Clay Township, a property listed under your ownership. The concern cited that the property was being utilized for vehicle storage. The letter indicated to you that this was not a permitted use under the Carmel/ Clay Zoning Ordinance. In response to that letter, you placed a telephone call to my office on October 19, 2007, at which time you indicated that you intended to get the lot cleaned up and list it for sale. This department has performed several reinspections of the site in anticipation of seeing some sort of improvement in the property's condition or full compliance. However, our most recent site inspection on February 19, 2008 revealed that there are still at least five vehicles parked illegally on the grass of the site. Not only were we able to document that the site remains in violation, but some of the vehicles that were documented in our recent inspection were different vehicles than we documented from the initial inspections last September and other vehicles have also been relocated on the site, as well. This property remains in violation of the Carmel/Clay Zoning Ordinance, Section 27.02.03, which states: §27.02.03 Parking spaces may be located on any part of a lot, unless otherwise specified herein. Parking spaces shall not be located in any required greenbelt or lawn area. Please bring this property into full compliance by April 30, 2008. Failure to do so will result in further enforcement action which may include an appearance in Carmel City Court and the assessment of fines. The concern cited that the property was being utilized for vehicle storage. This is not a permitted use under the Carmel/ Clay Zoning Ordinance. This department performed an initial site inspection of the subject property. We documented at least five vehicles parked on grass on the subject property. This is a violation of another portion of the Carmel/ Clay Zoning Ordinance, Section 27.02.03, which states, §27.02.03 Parking spaces may be located on any part of a lot, unless otherwise specified herein. Parking spaces shall not be located in any required greenbelt or lawn area. To avoid further enforcement action, please permanently discontinue parking vehicles on grass by October 29, 2007. I will ask our code ecinforcement officer to talk to the postmaster (who I don't know —they change all the time and never have the courtesy to come and introduce themselves —arrogant, I think, on the part of the organization). Since we're closer to the Carmel Post Office we use it even though our mail flows through the Nora PO. The interior of the Carmel PO is a credit to the community but the exterior always need cleaning. The curbs around the parking lot are littered with trash and lots of cigarette butts. I've called and talked to the Postmaster and he claims his "budget" doesn't allow for keeping the outside clean and the weeds and grass cut. Surely you must know the Postmaster and wonder if word from you might stimulate him to clean the place up and have it look like the rest of Carmel, nice and clean. The next item is the "junk yard" at the southwest corner of 106 St and Jessup Drive. The property has had an old double decker bus parked in the lot for a good four months. Not only the bus but some other old and junky vehicles. This looks to me as a violation of the Carmel Clay Zoning ordinance. Thanks for your help. A concerned citizen.
