HomeMy WebLinkAboutCRC-07-2001 Merchants Pointe EDA RESOLUTION NO. 9 9 RESOLUTION OF THE CARMEL REDEVELOPMENT COMMISSION CONFIRMING THE DECLARATORY RESOLUTION PREVIOUSLY ADOPTED BY THE COMMISSION WHEREAS, the Carmel Redevelopment Commission (the "Commission exists and operates under the provisions of IC 36 -7 -14, et seq., and IC 36 -7 -25 as amended from time to time (the "Act and WHEREAS, on March 14, 2001, the Commission adopted and approved a resolution (the "Declaratory Resolution declaring that an area within the City of Carmel (the "City is an economic development area and designated such area as the Merchants' Pointe Economic Development Area (the "Area and determined that it would be of public utility and benefit to develop the Area pursuant to an economic development plan entitled "Economic Development Plan Merchants' Pointe Economic Development Area" (the "Economic Development Plan and WHEREAS, on March 20, 2001, the Carmel /Clay Plan Commission (the "Plan Commission which is the duly designated and acting planning body of the City, adopted and approved an order determining that the Declaratory Resolution and the Economic Development Plan conform to the plan of development for the City and approved, ratified and confirmed the Economic Development Plan; and WHEREAS, on April, 16, 2001, the Common Council of the City adopted its Resolution which approved the order of the Plan Commission, as adopted on March 20, 2001; and WHEREAS, pursuant to Section 17 of the Act, the Commission caused to be published in accordance with IC 5 -3 -1, a "Notice of Public Hearing Concerning Merchants' Pointe Economic Development Area" (the "Notice and filed copies of the Notice with all Departments, Bodies and Officers of the City having to do with City planning, variances from zoning ordinances, land use or the issuance of building permits; and WHEREAS, at the hearing held by the Commission on May 24, 2001 at 7:00 p.m. (local time) at City Hall in Cannel, Indiana, the Commission considered written remonstrances and objections filed, if any, and heard all persons interested in or affected by the proceedings and, in addition, heard all persons who had filed a written remonstrance against the Declaratory Resolution and/or the Economic Development Plan, and considered those remonstrances, if any, and such other evidence presented; and WHEREAS, the Commission now desires to take final action determining the public utility and benefit of the proposed economic development of the Area and confirming the Declaratory Resolution in accordance with Section 17 of the Act. NOW, THEREFORE, BE IT RESOLVED, by the Carmel Redevelopment Commission as follows: 1. After considering the evidence and other data presented at the hearing on the 9th day of May, 2001, the Commission hereby confirms the findings and determinations of the designation of the Area and all other findings and determinations and designations, and approving and adopting actions contained in the Declaratory Resolution. 2. The Commission hereby finds and determines that it will be of public utility and benefit to proceed with the Economic Development Plan in the form approved by the Commission in the Declaratory Resolution. 3. The Declaratory Resolution shall be, and the same hereby is, confirmed. 4. This Resolution constitutes final action, pursuant to IC 36- 7- 14- 17(d), by the Commission determining the public utility and benefit of the proposed project and confirming the Declaratory Resolution pertaining to the Area. 5. The Secretary is directed to record the final action taken by the Commission pursuant to the requirements of IC 36- 7- 14- 17(d).
