HomeMy WebLinkAboutCC-02-01-10-02 TOF/ Monon CenterRESOLUTION CC- 02- 01 -10 -02 SPONSOR: Councilor Sharp A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REGARDING THE PRIOR TRANSFER OF MONIES FOR MONON CENTER OPERATIONS WHEREAS, the City of Cannel, Indiana "City and Clay Township of Hamilton County, Indiana "Township entered into a certain Interlocal Cooperation Agreement "Interlocal Agreement dated July 26, 2002, to provide joint park and recreational services to the City and the Township; and WHEREAS, the Interlocal Agreement, as the same has been subsequently amended from time to time, remains in full force and effect as of the date of this Resolution; and WHEREAS, pursuant to the terms of the Interlocal Agreement, a Carmel /Clay Parks and Recreation Board "Parks Board was created to administer the park and recreational services provided to the City and the Township, which Parks Board remains duly formed and operating as of the date of this Resolution; and WHEREAS, on December 16, 2002, the City, pursuant to the request of the Parks Board, duly established a non reverting parks and recreation operating fund, which includes the operating expenses of various Parks Board programs; and WHEREAS, in 2007, the Monon Center was opened in Central Park, and provides a state- of -the- art water park, fitness center and gathering place for all City and Township residents and guests (the "Monon Center and WHEREAS, in December 2008, and December 2009, the City transferred funds to allow the continued operation of the Monon Center (the "Transferred Funds and WHEREAS, in Resolution 12- 21- 09 -02, the City required that any Transferred Funds not expended on or before December 31, 2009, be promptly returned; and WHEREAS, the Common Council seeks to allow the Parks Board to expend the Transferred Funds on operational costs for the Monon Center, rather than require those funds to be returned to the City; and WHEREAS, the Monon Center Fund (referenced by the City of Carmel Clerk Treasurer's Office as Parks Monon Fund #109) has certain departments in the 2010 budget, numbered 1091 -1096 "Monon Center Operational Departments that are responsible for the operational expenses of the Monon Center. The foregoing Recitals are fully incorporated herein by this reference. Section 2. The Council hereby Resolves that the Parks Board is entitled to apply the Transferred Funds to expenses from the Monon Center Operational Departments. Section 3. All other obligations and requirements set forward in Resolution 12- 21 -09 -02 are hereby incorporated by reference, and shall continue in full force and effect. Section 4. This Resolution shall become effective on and after the date and time it is properly approved and signed by a majority of the members of the Cannel Common Council.
