The following item will appear on your November 16 meeting agenda. It was forwarded with a
unanimous favorable recommendation from the Plan Commission:
CC- 11- 16 -09 -02 (Docket No. 09090013 CPA):
2010 -2015 Zone Improvement Plan (ZIP)
The applicant seeks to update the existing, 2005 -2010 Zone Improvement Plan upon
which the parks and recreation impact fee is based. The proposal contains a projected 10-
year development plan for parks and recreation infrastructure which includes an estimated
$23.45 million in additions and improvements to the existing Carmel /Clay parks system.
The proposal also recommends that the existing impact fee (currently imposed at a level
of $1,261 /unit) remain at $1,261 for an additional year, and then be increased to $1,387
effective September 2011, to $1,526 effective September 2012, to $1,679 effective
September 2013, and finally to $1,847 effective September 2014. Filed by the Carmel
Department of Community Services, on behalf of the Carmel Plan Commission.

associated with Ordinance Z- 534 -09 (Docket No. 09090012 OA): Parks and Recreation Impact Fees

RECOMMENDATION ON THE PETITION OF THE CITY OF CARMEL TO AMEND
THE CARMEL CLAY COMPREHENSIVE PLAN
PURSUANT TO INDIANA CODE 36 -7 -4 -508

Dear Members:
The Carmel Advisory Plan Commission offers you the following report on the application to the
Commission (Docket No. 09090013 CPA) to amend the Carmel Clay Comprehensive Plan
(C3 Plan) in order to add the Zone Improvement Plan, upon which the parks and recreation
impact fee is based, as an appendix item to the C3 Plan.
The Carmel Advisory Plan Commission's recommendation on the petition is FAVORABLE.
At its regular meeting on October 20, 2009, the Commission voted eight (8) in Favor, zero (0)
Opposed, zero (0) Abstaining, to forward to the Common Council the proposed Resolution CC-
11-16-09-02 with a Favorable Recommendation.

5 A RESOLUTION OF THE COMMON COUNCIL
6 OF THE CITY OF CARMEL, INDIANA,
7 APPROVING AN AMENDMENT TO THE CARMEL CLAY COMPREHENSIVE PLAN
8 REGARDING THE ZONE IMPROVEMENT PLAN
9
10 WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in IC
11 36 -7 -4), each unit of local government that wishes to adopt land use and zoning ordinances must first
12 approve by resolution a comprehensive plan for the geographic area over which it has jurisdiction; and
13
14 WHEREAS, the Carmel Clay Comprehensive Plan (the "C3 Plan was approved and
15 recommended by the Carmel Clay Plan Commission on November 18, 2008, duly approved by
16 resolution (as amended) of the Common Council of the City of Carmel on May 4, 2009, with those C3
17 Plan amendments approved by the Carmel Clay Plan Commission on May 19, 2009, with May 20,
18 2009 becoming the effective date of the C3 Plan, and therefore it is the official Comprehensive Plan of
19 the City of Carmel, Indiana and Clay Township, Indiana; and
20
21 WHEREAS, the Mayor of the City of Carmel appointed the Impact Fee Advisory Committee
22 to serve in an advisory capacity to assist and advise the City with regard to the adoption of an impact
23 fee ordinance under Indiana Code Section 36 -7 -4 -1311; and
24
25 WHEREAS, the Impact Fee Advisory Committee met and advised the Carmel Clay Plan
26 Commission to recommend to the Common Council a revised and updated Zone Improvement Plan
27 and Park Impact Fee Ordinance resulting in an amendment to the Comprehensive Plan; and

29 WHEREAS, the Carmel Clay Plan Commission has duly approved, and recommended to the
30 Common Council, an amendment to the community's Comprehensive Plan regarding a revised and
31 updated Zone Improvement Plan;

33 NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel,
34 Indiana, that, pursuant to IC 36 -7 -4 -509, it hereby adopts this Resolution to approve the following
35 amendment to the comprehensive plan regarding the Zone Improvement Plan on which the Park
36 Impact Fee is based.

39 After its adoption, this Resolution shall be filed in the office of the Clerk- Treasurer of the City
40 of Carmel, who shall also forward one (1) copy of this Resolution to the secretary of the Carmel Clay
41 Plan Commission and one (1) copy to the office of the Hamilton County Recorder, all in accordance
42 with IC 36 -7 -4 -509 and other applicable laws.
