1. This Item will be on the January 20, 2010 agenda of the Technical Advisory Committee. Please
submit packets digitally to all members (list attached) at your earliest convenience.
2. Mailed and Published Public Notice needs to occur no later than Friday, January 1, 2010.
Published notice is required within the Indianapolis Star. Note: the placement of a public hearing
sign on the property is also required by the BZA Rules of Procedure, Article VI, Section 6 (see
attached PDF). Please note, obtaining addresses from the County Auditor's Office may take up to five
days.
3. The Proof of Notice will need to be received by this Department no later than noon, Friday,
January 22. Failure to submit Proof of Notice by this time will result in the tabling of the petition.
4- The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie
Tingley no later than NOON, Friday, January 15. Failure to submit Informational Packets by this
time will result in the automatic tabling of the petition to the February 22, 2010 agenda of the BZA.
5. This Item will appear on the January 26, 2010 agenda of the Board of Zoning Appeals under
Public Hearings.
6. The petitioner will need to provide a fully filled -out Findings -of -Fact sheet for each petition the night
of the meeting for the Board's use (Sheet 8). On Ballot sheets, only fill out docket number, petitioner,
and date (Sheet 7). Ballot sheets must be collated.
7. Either the Petitioner or someone representing the Petitioner must be present at the meeting for the
item to be heard. If no one appears, it will be tabled to the February 22, 2010 meeting.

Variances of Development Standards
Petitioner respectfully requests land use approval to construct a multi-
family residential community within the Old Meridian Overlay area of Carmel
(per the attached site and development plans). Variances of development
standards are necessary as the site is oddly configured, bound by roadways on
two of three sides, and the current zoning does not contemplate buildings with a
footprint larger than 15,000 square feet occupying the site. For reference, the

Variance of Use
Petitioner respectfully requests a variance of use to construct a multi-
family residential community within the Old Meridian Overlay area of Carmel
(per the attached site and development plans). A variance of use is necessary as
the site is zoned Old Meridian/Office and does not contemplate residential
development as a permissible use of the site. For reference, the following
section of the City of Carmel Zoning Ordinance is cited as follows:
Chapter 20, Section 20G.05- zoning to provide for a mix of
compatible, non residential a es, only.

The attached Findings of Fact demonstrate how the proposal will contribute to
and be compatible with the Old Meridian Overlay area.
Land Description
A part of the Northwest Quarter of the Northeast Quarter of Section 35, Township 18 North,
Range 3 East, in Clay Township, Hamilton County, City of Carmel, State of Indiana and being a
portion of the real estate described in that certain Deed of Distribution, recorded as Inst. No.
9523509 in the Office of the Hamilton County Recorder, being more particularly described as
follows:
Commencing at the Northwest corner of said Section 35, being marked by a Harrison Monument,
per ties; thence North 88 degrees 53 minutes 58 seconds East, basis of bearings assumed,
2658.54 feet to the Northwest corner of said Quarter Quarter Section, being marked by a small

Dear Mr. Hill:
As you know, we have been asked to provide an engineer's estimate for the public right
of -way improvements associated with the subject project. Since the project is in its very
early stages, it would be difficult to produce an estimate with any level of accuracy at this
time.
Please note that we have been told in previous conversations with the City Engineer's
office that typical right -of -way improvements are in the range of $90 per lineal foot of
street frontage. Based on the updated survey, the property line lengths along Old
Meridian Street and Pennsylvania Street total approximately 2284 lineal feet. Therefore,
a rough estimate for the right -of -way improvements at $90 /1ineal foot would be
$205,000.
Please let me know if I can provide any additional information or if you have any
questions.
