Legal Counsel Report, John Molitor: Regarding the Johnson Acres Garage, the Court over -ruled the defendant's motion to dismiss. Augusta Dr. just north of and adjacent to said parcel, as well as seek approval for parking, landscaping, lighting, and signage. The site is pending a rezone to B- 5/Business. Filed by the Department of Community Services on behalf of Hamilton County. Present for Petitioner: Michael Howard, Attorney for Hamilton County. Also present: Ray and Randy Stair. Overview: Proposal will move building to the north side of the property Green space and trees will remain on the property New Building will include an addition to the first floor Roof lines and architectural amenities will be substantially similar to the major building Exterior of addition will be red brick Existing building will remain with existing facade Ground lighting on site —no spillage at property line Sign is 24 square feet black aluminum, 12 -inch letters on a red brick background for "Stair," 6 -inch letters for "Associates, Inc." Docket No. 09100005 OA: Carmel Dr -Range Line Road Overlay Sunset Amendment The applicant seeks to amend the Zoning Ordinance, Chapter 23F: Carmel Drive Range Line Road Overlay Zone in order to extend the sunset clause. Filed by the Carmel Department of Community Services. Present for Petitioner: Alexia Donahue -Wold, Dept of Community Services.
