Docket No. 09090024 DP /ADLS: 96th /Augusta Site Plan Ray Stair Property The applicant seeks site plan and design approval to relocate an existing structure from 3760 W. 96 St. to 9641 N. Augusta Dr. just north of and adjacent to said parcel, as well as seek approval for parking, landscaping, lighting, and signage. The site is pending a rezone to B -5 /Business. Filed by the Department of Community Services, on behalf of Hamilton County. The applicant seeks site plan and design approval to relocate an existing building, from the northeast corner of 96 Augusta, just north to 9641 N. Augusta Dr. Due to road improvements proposed by Hamilton County, near 96 St. and Augusta Dr., the location of the current building and parking area needs to shift and re- locate northward. Please refer to the informational packet for more detail. The rezone of this parcel to B -5 /Business is currently under review at City Council, with its first reading at the Nov. 16 public hearing. This item appeared at the October 21 Technical Advisory Committee meeting where technical aspects of the project were reviewed/discussed, such as landscaping plans, stormwater quality plans, erosion control plans, etc. Outstanding issues /comments: 1. Variance approval from the BZA will be required for a 15 -ft side yard setback. Per the US 421 Overlay requirements, the minimum side yard setback when next to an existing residence (s) or undeveloped residential zone is 50 -ft or two times the building height, whichever is greater. 2. The Forestry Dept has no issues with the Landscape Plan Tree preservation Plan. 3. Please submit signage details /colors /dimensions. 4. Please provide the dumpster enclosure details. 5. The Hamilton County Surveyor's Office needs a detailed Phase II stormwater quality review plan. If they receive a SWPPP or a site plan and the construction limits show a total disturbance of 1 acre, then a Rule 5 permit will not be required. If the total disturbed area is greater than 1 acre, then a SWPPP will be required as well as a IDEM Rule 5 permit. This is a State and Federal requirement as well as County. After all comments /questions are addressed, the Dept of Community Services (DOCS) recommends that the Commission suspends its rules of procedure this evening, and vote to approve this item with the conditions of: submitting a stormwater quality review plan to the County and seeking BZA approval for the 15 -ft side yard setback from the north property line.
