Good afternoon, Howard:
I just spoke with the Planning Director about this. Please try to re -work the site to get the 50 -ft side yard building
setback_along the north side of the parcel. Can you flip the site plan, so that parking is on the north side of the site? Is
the curb cut set in stone with the new' road project, or can it be moved northward?
If nothing works, we will have to take this before the BZA for a variance. And of course, we will get this taken care of,
but will need you and Randy to attend one additional meeting.... Possible dates are 5:30 PM on Nov. 23 (which is
pushing it, as far as getting public notice done), or Dec. 1, Dec. 15, or Dec. 21 for a BZA hearing officer meeting. The
hearing officer is just one member of the BZA that hears the case and votes on the variance request. (I prefer the date
of Dec. 21, since it falls on the same date as the full BZA meeting.)
Please let me know the outcome.

As per our conversation, I enclose a map from the County GIS system showing the property lines and regulated drainage
easement for the heavily wooded area north and east of the proposed Stair building. The combined yellow and
green lined represents the approximate centerline of the drainage easement. The blue line represents the approximate
75' regulated drainage easement on either side of the stream, which easement is imposed pursuant to Indiana Code 36 -9-
27-33. This area is part of the Crooked Creek drain.
As we discussed, the 421 overlay district requires a 50' setback between residential and commercial uses in a B -5 zone.
The general setback in the B -5 zone is 15'. The development plan submitted by Mr. Stair uses the 15' setback. We
believe the effective screen between the residential uses to the northeast and the Stair property created by the regulated
drainage easement far exceeds the intent of the Ordinance. We would, therefore, request that the required 50' setback
from the Stair property line be reduced to 15' because the natural buffer is substantially greater than any setback benefit
imposed by the Ordinance.
Please let Randy and I know of the staffs' position on this issue. We would suggest that the Plan Commission would have
the authority to grant this easement as part of the development plan process, unless your Ordinance specifically provides
to the contrary.

northern side building setback should be 50 -ft from the north property line.

Good morning, gentlemen:
Well, I am so glad your rezone item received a favorable recommendation from the Plan Commission last night!
Now, on to City Council.
I will place the public notice ad in the Noblesville Star for your rezone item (now Z- 533 -09) by Nov. 2. Also, I
will prepare the informational packets for the City Council members due on Nov. 5. Let me know if you have
any documents that you want me to add, other than the usual memo, site plan, building elevations, ordinance
text, etc. The City Council meeting begins at 6 pm on Monday, November 16. Please have a representative
present at that meeting to answer any questions City Council may have about your rezone item.
Then, on Tuesday, November 17, your site plan building elevations will appear at the Plan Commission
public hearing at 6 pm. Like last time, we will ask that the Commission suspends its rules and vote that
evening. However, the item might be sent to the Dec. 1 sub committee meeting for further review /discussion.

Dear Mr. Stair:
We have reviewed the Rezone and ADLS Plans submitted to the Hamilton County Surveyor's
Office on October 1, 2009 for this project and have the following comments:
1. This proposed project falls within the unincorporated limits and MS4 jurisdiction of
Hamilton County.
2. The proposed project DOES NOT fall in a Carmel Well Head Protection Zone.
3. The proposed project does fall in the Crooked Creek Regulated Drain Watershed.
4. Hamilton County Surveyor's Office has no objections to the Rezone request.
5. The provided plans do not provide enough detail for a drainage review or Phase II Water
Quality Review. Drainage calculations will need to be provided to evaluate compliance with
the regulated drain allowable release rates. Also, a Stormwater Pollution Prevention Plan
will need to be provided to Bob Thompson of our office for a Phase II Water Quality
Review.
6. Please review the Hamilton County Stormwater Management Technical Standards Manual at
http:// www. co .hamilton.in.us /upload/images/ survey /docs /HC SMTSM_20090109.pdf for all
the requirements for stormwater runoff.
7. Permits will be required from our office for the discharge to the Crooked Creek Regulated
Drain and for earth disturbing activity in excess of 1 acre.

result in delay of the review process.

of soil or greater I will need a Stormwater Pollution Prevention Plan submitted by a licensed engineer
(see our Stormwater Design Manual) or surveyor and upon approval (if needed) you will need to get a
Rule 5 permit from IDEM. From the plan I have it is not clear how much soil is being disturbed so I
will need a scaled plan showing the limits of construction. Please call if you have any questions. For

Gentlemen:
Hamilton County is currently in the process of final design of a major road improvement project east of 96th
Street and US 421.
The County is planning to extend North Augusta Drive (to be renamed Commerce Drive) and improve 96th
Street. The project will provide a safer and more efficient roadway. The proposed project includes the
reconstruction of 2,600' of 96th Street from just east of US 421 (Michigan Road) to just immediately east of
Sycamore Road. The project also includes the reconstruction and extension of Commerce Drive from its
existing terminus south to 96th Street to include improvements to the existing North Augusta Drive.
The improved 96th Street will be widened and consist of two 12' travel lanes in each direction separated by a
10' raised grassy median. Additionally an 8' multi -use path will be placed behind a 5' buffer on the north side
of the road, and a 5' concrete sidewalk will be placed behind a 5' buffer on the south side of the road. The
roadway on Commerce Drive will generally be one 12' travel lane in each direction, in some locations the travel
lanes will be separated by a 12' two -way left turn lane. Eight foot multi -use paths will be placed behind a 5'
buffer on both sides of the roadway. Roudabouts will be installed at the intersection of 96th Street and
Shelborne Road and at the intersection of 96th Street and Commerce Drive (existing North Augusta Drive).
As part of the plans for the project to construct the 96th Street /North Augusta Drive round -a -bout, we will be
taking the office building located at the northeast corner of the intersection. Mr. and Mrs. Ramon
Stair, owners of the property, along with their son, Randy, whose architectural building, occupies the
business are in the process of finalizing an agreement whereby the County will pay a substantial sum to the
Stairs. The payment will allow the Stair family to relocate the existing building on a parcel of ground
immediately contiguous to, and north of, the buildings existing location. We anticipate working with
your office to rezone both parcels as R -5.
In doing so, the Stair family will preserve an older well maintained building, will eliminate their existing
mound sanitary system, and connect to the existing Wastewater Utility. The relocation of the building will
cause the business to incur substantial expenses for rent and the cost of business interruption. In total, the
City will be paying $795,000 total compensation to the Stair family.
As part of our agreement, the County is asking the City of Carmel to waive the various fees that the Stair
family will incur in order to relocate the building. As you know, this project will substantially benefit the
City of Carmel by constructing some of the infrastructure which was part of the Carmel commitment in the
Western Clay annexation. In addition, we anticipate that there will be drainage improvements benefiting the
area for Carmel's soon -to -be taxpayers and residents.
As a small contribution to the cost of the project, the County is requesting, on behalf of themselves and the
Stair family, that the City waive all zoning application fees, plan review fees, normal inspection fees,
and other Department of Planning fees associated with the relocation of the building. We would also ask that
you explore waiver of the sewer and water fees.
I briefly discussed this waiver with the Mayor 30 days ago, assuring him that the Hamilton County TIF
District is going to be paying all of the other costs of this project. The Mayor stated that he would be more
than willing to waive the planning and zoning fees upon assurances of Mr. Haney, that he was legally
authorized to do so. He and I were both unsure whether sewer and water fees could be waived, but would
seek your in put on that issue.
In conclusion, the County will incur over $2,500,000 of land acquisition expenses for this project and
anticipates the construction costs to be approximately $4,200,000. We would greatly appreciate your
assistance on the comparatively small costs listed above.
