The real estate is approximately 1.26 acres and is zoned S -1 (Residential). The Taylor Home sits adjacent to the Mitchner Ditch Legal Drain which runs along the rear of the property. The Taylor family would like to expand the outdoor living space they currently have to accommodate a patio with outdoor kitchen and covered sitting area. Construction of this improvement requires the reconstruction and expansion of a retaining wall to be placed in the area identified under Tab 2 of this booklet. The photo exhibits under Tab 3 provide additional views of the area in question and the location of the proposed improvement. The proposed Variance request is to permit an accessory building to be constructed within the 75' Legal Drain Easement. A Non enforcement Request to allow improvements to encroach into the Legal Drain Easement for the Mitchener Ditch was approved by the Drainage Board on April 27, 2009. The non enforcement allows improvement up to within 25 feet of the Legal Drain. This Variance request exclusively addresses the proposed covered accessory structure. Expansion of the retaining wall, patio and outdoor kitchen only required the approval by the Drainage Board. Construction of the retaining. The applicant is requesting the rear yard building setback to be reduced to 25' to be consistent with the easement non enforcement approved by the Drainage Board to allow the covered sitting area in addition to the patio, outdoor kitchen, and retain wall already permitted.
