Yesterday, 12 -29 -2009, at approximately 2:00 pm, the Department of Engineering received responses to the review
comments that John e- mailed to Mr. Ed Fleming on 12 -21 -2009 and the supplemental review comments that Gary e-
mailed to Mr. Fleming on 12 -22 -2009. A quick review of Gary's comments indicates that 1 through 14 and 16 have been
responded to, but not all have been resolved as the response to comments 5, 6, 14, and 16 is: "This comment will be
addressed by the client's attorney." There was no response to comment 15. In response to comment 9, the
Department of Engineering received a request for a variance from Mr. Fleming.

I am uncertain what the overall point of this calculation is. Technically, in nature trees grow within inches of each other
with great success. Obviously, society tries to maintain a distance between trees and depending on the species 20'
between trees is not unrealistic. If I do my math right this would encompass the 54 trees per .5 acre. Fortunately, there are
alternatives to planting all the trees on site, like planting them adjacently off -site ect. Hopefully this will not need to be an
issue.
From what I see with the latest landscape plan I am unaware where there is a problem with too many trees on the site. In
all actuality, the City of Carmel would like to have all existing trees remain and any landscaping changes needed would
only affect the proportionally small area of the site where additions and construction are taking place. We do not desire
any changes to any of the perimeter landscaping outside of your requested building construction limits.
Hopefully, this answers your question.
PS. Scott Brewer the Environmental Planner will be back at work starting on Monday. He will be the one to contact on any
plan review questions from here on out. I will of course relay any conversation and thoughts that we have had.

The following email represents comments for this project specifically addressing the area of urban forestry. I
have reviewed the drawings submitted November 20, 2009 and offer the following comments:
URBAN FORESTRY REVIEW COMMENTS
1) After reviewing the site, I have found discrepancies with what existing trees are on the site
compared to what existing trees are shown on the plan C100. All three berms show a lesser count of
existing trees on the plan as compared to the actual site. Please provide an updated and accurate
Sheet C100 noting these discrepancies.
2) The Park Place PUD District requires that the developer shall conserve existing trees. With that, I
would like to have the existing trees that are outside any construction limits saved. This particularly
details the west berm and the south berm. If it is decided that removing the berms are an essential
part of the construction process, tree replacement shall occur to mitigate the size and quantity of the
existing trees. See chart:

4) Please provide shrubs along the entire length of the parking lot on the south side, where possible.
This will make a definite bearing on shielding headlights from shining at 116 St.
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re- submitted, particularly
if any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other committee meetings.
The Department of Community Services reserves the right to provide additional comments based on subsequent
reviews.

I appreciate your understanding while we were looking further at this issue.
Angie explained correctly where we ended up, in that the pole barn is an accessory structure which is clearly subordinate
to the main building, not part of a complex where the buildings are designed to act together as a whole.
It may not take a lot of additional investment in order to re -work the building /site so they look and function as more of a
unit. We are interested in talking with you more about that possibility, and working to help get you there.

I am aware that since we met a few weeks ago, that you have briefly discussed the signage concerns with the Director,
Mike Hollibaugh. And prior to that, Mike consulted with the Plan Commission attorney. The way the definition of multi
tenant building complex is read, the two buildings have to be primary buildings and not an accessory building. That was
the result of conversations at the staff meeting last Monday.
However, if you can bring plans to us that show the accessory building being used as a primary building, such as with an
additional tenant located in the easternmost building that is not located in the western primary building, additional
paved parking, and some exterior color /material upgrades that match the proposed upgrades to the westernmost
building, then we can permit additional signage. But as of now, we have not seen revised plans for that accessory
structure, and cannot permit the additional signage for that building, or the additional multi- tenant ground sign, without
a variance.
Mike Hollibaugh and Rachel Boone can correct me if I have misinterpreted the results of that Staff meeting.

Based on additional review, the City provides additional comments:
CONSTRUCTION DRAWING REVIEW COMMENTS
J1'. The Department of Engineering will not support the proposed 116" Street access.
X Please indicate additional right -of -way for a 70 -foot half on 116" Street and a 45 -foot
half on Guilford Road.
7 Please confirm with the -Department of Community Services if bicycle parking and path
in accordancewith.the Alternative Transportation Plan is required across each frontage.
Proper easement is required for storm water quality and storm water detention systems. 6 Guilford Road plans indicate the reconstruction of the two drives from Guilford Road.
Due to the proxirnity of the southernmost drive to the intersection of 116 Street and
Guilford Road, the City cannot guarantee long -term full access to this drive.
Any improvements on Guilford Road need to be constructed to accommodate the current
design plans, the same as if these improvements already existed.
Please indicate the flood route.
X. Please revise grading note 8 to be the City standard note.
7 While, the overall increase in percent impervious is not large, the total land disturbance is
t OE' over the threshold. The proposed use has the potential to produce pollutants of concern.
The proposed plan requires removal of existing trees in favor of lawn areas that will
likely be irrigated and fertilized.- Two ;BMPs are required for the storm water generated

to provide only one provided that the runoff from more of the existing site is treated by
the single BMP. There appears to be the opportunity to install a bio -swale in the existing

Sheet C800.
X. Please revise all ADA ramp details if proposed to be in the right -of -way. If different

Response: The dumpster will be located in the rear of the garage area. Once this
location is determined, I will provide you with the drawings.

Plan Alternative Transportation Plan; contact the Engineering Dept.
for more details.
Response: The developer will provide this information.
9. Comment: Please provide the lot coverage percentage, which should include the

The signage looks pretty good. The proposed sizes are correct, so long as the tenant spaces are exactly as shown. There
is one instance on the south elevation where they show two tenant signs for one tenant space (farthest sw). This would
only work if there are actually two tenants there. I know they're probably just showing what could be there...but based off
the floor plan as shown it would not work. If they could add to the sign criteria: no raceways, limit the colors to three plus
black and white, logos are limited to 25% of the total sign area but are not restricted in color, and sign width cannot
exceed 80% of the storefront width.
They have presented two ground signs and wall signs for all the tenants. They will not be able to do this. Since they are
on two street frontages, they can have wall signs for the tenants and one ground sign with all tenants represented on the
sign. They do have the option of having the ground sign and the wall signs face the same frontage, but I would
recommend having the sign at the sw corner (diagonal to the street intersection) of the site to most effectively utilize the
ground sign. If there is concern over entrance identification, they could have small (3 sq. ft. and 3' tall) directional signs to
identify the entrance /exits.
As for design of the building, I think the awning on the west elevation seems out of place. Also, the colors seem very

screening are they going to provide to block the north view? I can imagine when the retirement community goes in there,
looking at garage doors, it will be an issue.

The City received your construction plans on November 24, 2009. We offer the following comments:
GENERAL INFORMATION
1. These comments: represent the Department of Engineering's first review of the preliminary
development plans forthis project.
2. We request that all responses to our comments be provided in writing and be accompanied by
a drawing reflecting the requested revisions. Failure to provide written responses may result
in the delay of the review process.
3. It is critical that this office be made aware of all modifications made on the plans being re-
submitted, particularly of any such changes are considered "new" or fall outside of our
'previous Please provide revised plans including all revisions. Please notify us of
any changes and specifically state any changes, including changes resulting from Plan
Commission, BZA.or other committee meetings.
4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide aset of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Board of Public Works-and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All off- site easements necessary to install utilities to serve the development are secured.
e. SWPP is approved.

7. An approved Storm Water Management Permit is required prior to commencing any earth
disturbing activity.

entrances hi this facility on Guilford. Road. For these reasons, the Department of Engineering
does not support theadditional curb cut on 116 Street.

20. Temporary Construction Entrance Approval. It appears the planned construction entrance is
located at the site.of a permanent curb cut planned on Guilford Road. Therefore, a separate
approval from the Board Will not be required.
21. The installation of any permanent privately owned and /or maintained improvement (signs,
`decorative street signs, irrigation Systems, walls, .streetlights', etc.) within dedicated right -of
way or dedicated easements requires the execution of a Consent to Encroach Agreement
betweenthe Owner anid the City of Cannel. Such agreements are executed by the Board of
Public Works and Satety.,The City, Engineer may.approve irrigation system agreements.
22. Secondary Plat approval if applicable. All performance guarantees must be posted prior to
submission of Secondary plats for.,Board of Public Works and Safety approval.
23. Dedication of Right of Way if net platted. This is, based upon. the City. Of Carmel 20 -Year
Thoroughfare Plan requirements, Dedication documents are available Open request. Please
be advised that all Right of Way Dedications must be accoriipanied by a Sales Disclosure
Agreement completed by the owner for the property being dedicated to. the City. The
.dedication document cannot be recorded Without a completed Sales Disclosure. The form is
available upon request.
24. Any open pavertient cuts of either Guilford Road er 116 Street will require Board approval.
25. Lane restrictions_of Guilford Road and /or 116` Street require Board of Public Works and
Safety approval. The Department of-Engineering assumes lane restrictions will be necessary
for curb work at' storm connector, and water, connection..
26. Sidewalk closuresrequired for any work require Board of Public Works and Safety approval
and must conform to City's sidewaik,closure policy. A detour must be established and
proper signage must be installed and iiiairitained for the duration of the closure.
BONDING REOUIREMENTS
27. Upon initial review if appears perfor ante guarantees shall be provided for the following:
a. Ifthisdevelopinentis`to be platted, a perforinance guarantee will be required for
PerimeterrMonurnentation.
b. Stornwater Post Construction BMPslnstallation Perfonnance- Guarantee.

d. All improvements in -.the right -of- -way.
28. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for
100% ofthe cost of labor and Materials to construct the individual improvements, to be
provided by the design engineer. Please: provide detailed Engineer's Estimates for each
improvement including quantities, unit costs, pipe sizes and materials, etc.
29. Upon completion and release 'of individual Perfonnance Guarantees, a three -year
Maintenance Guarantee will be required. (see Street Sign comments above). The
Maintenance Guarantee. amount is based upon 15% of the Perfonnance amount for Streets
and Curbs and 10% ofthe Performance amount for all other
30. Performance Guarantees maybe Performance or Subdivision Bonds or Irrevocable Letters of
Credit.

RIGHT OF WAY PERMIT AND BONDING
32. Any work in the dedicated right -of -way of Guilford Road or 110 Streei will require an
approved Right -of -Way Pernitand a License Permit Bond.
33. The bond amount is determined by our Right -of -Way Manager. However, if the work is
included in the scope of work .ofa required and posted Performance Guarantee, the
Perfonnance Guarantee may be used to satisfy the bond requirements of the Right -of -Way
Permit.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's Office
on November 25, 2009, for this project and have the following comments:
1. The proposed project falls in the incorporated area and MS4 jurisdiction of the City of
Carmel.
2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone.
3. The proposed project falls in the W.R. Fertig Regulated Drain Watershed.
4. The site has existing detention basins for the storm water runoff and the increase
impervious area with this proposal is minimal. The increased storage volume being
provided should cover the additional runoff without increasing the previously
approved site discharge rate.
5. No permits will be needed from our office.
6. Hamilton County Surveyor's Office has no objections to the proposed plans.

I have reviewed the drawings submitted for the December 16, 2009 Technical Advisory Committee meeting, and
comments from the Alternative Transportation review have been satisfactorily addressed.
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
1) The City of Carmel Parking Ordinance requires all commercial venues to include bicycle parking. Bicycle
parking spaces are required at a rate of five (5) bicycle parking spaces per one hundred (100) automobile
parking spaces with a minimum of four (4) spaces. Please see the City of Carmel's Parking Ordinance in
order to determine appropriate locations and construction details for the above.
We request that all responses to our comments be provided in writing. Failure to provide written responses may result
in delay of the review process.
