Petitioner, please note the following:
1. This Item will not be on an agenda of the Technical Advisory Committee.
2. Mailed and Published Public Notice needs to occur no later than Friday, March 12. Published notice is
required within the Indianapolis Star. Note: the placement of a public hearing sign on the property is also
required by the BZA Rules of Procedure, Article VI, Section 6 (see attached PDF).
3. The Proof of Notice will need to be received by this Department no later than noon, Friday, March 19.
Failure to submit Proof of Notice by this time will result in the tabling of the petition.
4. The Filing Fee and Nine (9) Informational Packets must be delivered to BZA Secretary Connie Tingley_-
no later than NOON, Friday, March 12. Failure to submit Informational Packets by this time will result in the
automatic tabling of the petition to the April 26, 2010 agenda of the BZA.
5. This Item will appear on the March 22, 2010 agenda of the Board of Zoning Appeals Hearing Officer
under Public Hearings.
6. The petitioner will need to provide a fully filled -out Findings of Fact sheet for each petition the night of
the meeting for the Board's use (Sheet 8). On Ballot sheets, only fill out docket number, petitioner, and date
(Sheet 7). Ballot sheets must be collated.
7. Either the Petitioner or someone representing the Petitioner must be present at the meeting for the item to
be heard. If no one appears, it will be tabled to the April 26, 2010 meeting.

as Instrument Number 200100024234.
Together with a permanent, non exclusive easement for ingress and egress on, over and across
the following real estate:

Exhibit B
Explanation of Requested Development Standards Variance
The Carmel Professional Office Building is an existing single story, multi- tenant medical office
building "Building located at 13250 Hazel Dell Parkway, Carmel, Indiana (the "Project The
Project is owned and operated by Hazel Dell Office Development, LLP (the "Applicant The
Applicant is requesting a variance from Section 25.07.02 -09(b) of the Carmel Sign Ordinance
"Sign Ordinance in order to place a Ground Identification Sign at the Project in addition to the
Wall Identification Sign that currently exists on the Building.
The Sign Ordinance states that Multi- Tenant Ground Floor Buildings are permitted to have
"[o]ne (1) Wall or Roof Identification Sign per business or one (1) Ground Identification Sign
per building See Section.25.07.02(b). The Project currently has a Wall Identification Sign
that was approved by the City of Carmel Planning Commission, Special Studies Committee, on
April 9, 2002 as Docket No. 36 -02. The Applicant is now requesting a variance from Section
25.07.02(b) in order to install a Ground Identification Sign in addition to the existing Wall
Identification Sign. A depiction of the Ground Identification Sign being proposed by the
Applicant is attached hereto as Exhibit C "Proposed Ground Sign
The Proposed Ground Sign does not exceed the standards set forth in the Sign Ordinance for
Multi- Tenant Buildings that are located near right -of -ways that are considered Non Freeways.
The Proposed Ground Sign will be located less than fifty (50) feet from Hazel Dell Parkway and
the Building Frontage is 170 feet. Therefore, a Ground Identification Sign is permitted at the
Project if the Maximum Sign Area does not exceed seventy -five (75) square feet and a
Maximum Height of six (6) feet. The Proposed Ground Sign does not exceed either standard.
A variance is necessary for the Project in order to permit the installation of the Proposed Ground
Sign. Without the Proposed Ground Sign, passing motorists on Hazel Dell Parkway will be
unable to (i) identify the Building address, (ii) identify the major tenants occupying space within
the Building, and (iii) identify the predominant use of the Building (physician office space). The
existing Wall Identification Sign does not identify the Building address and it merely identifies
one of the major tenants within the Building. Further, the Wall Identification Sign cannot be
easily viewed by passing motorists as a result of trees and other shrubbery along Hazel Dell
Parkway. The tenants within the building will be at a substantial disadvantage if their patients are
unable to locate the Building.
