HomeMy WebLinkAboutLetter for time limitsMr. Jon Dobosiewicz Nelson Frankenberger 3105 E. 98th Street, Suite 170 Indianapolis, IN 46280 Dear Mr. Dobosiewicz: JAMES BRAINARD, MAYOR Via email: jond @NF LAW.COM March 25, 2010 Original by mail RE: Time Limit Keystone Group, Old Meridian Plaza Docket Nos. 08010011 DP /ADLS, 08010004 UV, 08020013 V, 08020014 V, 08020016 V, and 08020017 V Please let this letter confirm the approval time limits for the above mentioned dockets relating to Old Meridian Plaza, located at 12863 Old Meridian St. The time limit established for variances per Section 30.05.05 of the Carmel Zoning Ordinance requires that any permanent variance be part of a project on which continuous construction has commenced within three (3) years from the date the variance(s) was granted. Also, the time limit established for DP and ADLS approvals under Zoning Ordinance Sections 24.99.A.7.c and 24.99.B.5.c requires that an approved DP or ADLS shall be valid for three (3) years from the date of approval. These time limits were amended with ordinance Z- 530 -09, effective date July 20, 2009. Further, this letter shall clarify that the provisions on Section 25.07.07, Sign Permits, which requires that signs approved by the Commission be established within three (3) year after the date of approval. With that, the following expiration dates are now in effect for Old Meridian Plaza: The Letter of Grant dated April 28, 2008 for the approval of Docket No. 08010011 DP /ADLS will now become null and void (expire) on April 15, 2011. The Letter of Grant dated February 26, 2008 for the approval of Docket No.s 08010004 UV, 08020013 V, 08020014V, 08020016 V, and 08020017 V will now become null and void (expire) on February 25, 2011. Commencement of continuous construction is triggered by obtaining the associated building or sign permit associated with the related approval, and also being the point in time commemorating the breaking of ground of the construction of a development or structure. A copy of this letter will be placed in the Variance and DP /ADLS files for future reference.
