The Schneider Corporation z: Historic Fort Harrison 8901 Otis Avenue Indianapolis, IN 46216 -1037 2 66t 0 S p 0 0 RE: Towne Oak Estates Carmel Construction Plans Project Review #1 Dear Mr. Batt: The City has received your construction plans dated March 5, 2007 for the March 21, 2007 TAC meeting. We offer the following comments: GENERAL INFORMATION 1. These comments represent the Department of Engineering's first review of the construction plans for this project. 2. We request that all responses to our comments be provided in writing and be accompanied by a drawing reflecting the requested revisions. Failure to provide written responses may result in the delay of the review process. 3. It is critical that this office be made aware of all modifications made on the plans being re- submitted, particularly if any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans including all revisions. Please notify us of any changes and specifically state any changes, including changes resulting from Plan Commission, BZA or other committee meetings. 4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations submitted to this office for review. If you have not already done so, please provide a set of drainage plans and calculations to their office for review. We will share Crossroad's comments as they are received. 5. Final drawings will not be approved for construction until: a. All Engineering Department, Utility Department, Clay Regional Waste District and Hamilton County Surveyor issues have been resolved. b. All bonds and performance guarantees are posted. c. All Board of Public Works and Safety approvals and any other governing agency approvals (if required) are obtained. d. All off -site easements necessary to install utilities to serve the development are secured. e. Digital Files are submitted. f. All final executed pipeline agreements between the developer and the pipeline companies are provided. g. Water Availability Fees are paid. 6. The Department reserves the right to provide additional comments based upon subsequent reviews. 7. An approved Storm Water Management Permit is required prior to commencing any earth disturbing activity. 8. An approved right -of -way permit is required prior to commencing any work in the public right -of -way. 9. If it will be necessary to relocate existing utility poles, they must be relocated to within one foot of the proposed right -of -way. Costs for such relocations are to be borne by the developer. April 24, 2007 RE: Towne Oak Estates Project Review #1 Page 2 of 8 10. As previously discussed, compliance with the Thoroughfare Plan includes construction of the improvements prescribed by the Thoroughfare Plan across the frontage controlled by the development (including sections with no access). Typically, developers provide a commitment equal to the value to construct these improvements for deposit into the City's non reverting thoroughfare fund. Please refer to Comment No: 38 (a -d) below related to additional requested commitments in lieu of certain improvements. 11. The Department requires that the construction drawings be developed in accordance with the City of Carmel digital submission standards and that all required submittals for primary plat, secondary plat, and construction drawings be made. The digital files must be submitted to the Department of Engineering prior to the approval of the construction plans. Please contact the City GIS Department for the requirements. 12. Jurisdictions: a. The project site is located within current City of Carmel Corporate Limits. b. Streets and Right of Way City of Carmel (Towne Road, Internal Street) c. Water City of Carmel Utilities d. Sanitary Sewers Clay Township Regional Waste District e. Storm Sewers/Drainage Hamilton County Surveyor City of Carmel. f. Legal Drains Hamilton County Surveyor's Office. 13. Drawings submitted for approval: a. The design engineer must certify all drawings submitted for final approval. b. Due to the dual jurisdiction between the City of Carmel and the Hamilton County Surveyor's Office, this office will require 8 -sets of drawings to be submitted for approval after all issues have been resolved. The drawings will be stamped as approved by the City of Carmel and signed by the City Engineer and by Carmel Utilities. The 8 -sets must then be submitted to the Hamilton County Surveyor for approval. Distribution of approved drawings will be 2 -sets to City of Carmel Engineering; 1 -set to Carmel Utilities; 2 -sets to the Hamilton County Surveyor; and 1 -set each to the Developer, Project Engineer and Contractor. 14. Carmel Utilities will provide separate reviews of this project for water issues. Please assure that copies of all drawings are sent to: Paul Pace Carmel Utilities Distribution 3450 West 13 V Street Westfield, IN 46074 15. Carmel Utilities does subscribe to "Holey Moley" who should be contacted directly for all water main locations. 16. I am including copies of the following with this correspondence: a. Subdivision Project Approval Procedures b. Performance Release Procedure c. Subdivision Building Permits d. Permit Data, Contacts, etc. e. Water Fees f. Street Sign Data g. Schedule for Board of Public Works and Safety meeting dates and agenda deadlines. BOARD OF PUBLIC WORKS AND SAFETY 17. Please use the Engineering Department deadlines for submissions to the Board. 18. Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or the Board of Zoning Appeals (if applicable) and completion of review by the Technical Advisory Committee. All written requests to be placed on the Board's agenda must include the appropriate Docket Number and the date (or dates) of approval by the Plan Commission and/or the Board of Zoning Appeals (if applicable). Water Availability approval from the Board is based upon the total number of single family residential lots. Reference item #34 -37 below for a more detailed explanation. If an entryway irrigation system, other community irrigation system, community swimming pool, community clubhouse or community bathhouse is planned for this development, approval for additional Water Availability must be obtained from the Board. 20. Commercial Curb Cut Approval It appears that this is a typical residential subdivision and will not require BPWS curb cut approval. 21. Temporary Construction Entrance approval if the location is at a site other than the location of the proposed permanent entrance to the development. 22. The installation of any permanent, privately owned and/or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Carmel. Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation system agreements. 23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 24. Dedication of Right of Way if not platted. 25. Any open pavement cuts of Towne Road will require Board approval. BONDING REOUIREMENTS 26. Upon initial review, it appears performance guarantees shall be provided for the following: a. Streets (base, binder and surface must be bonded together) b. Curb Gutters c. Water Mains d. Street Signs. Please designate if Standard City of Carmel Street Signs or decorative type street signs will be installed. A Performance Guarantee is required in either case. However, if decorative signs are installed, they must meet our minimum standards. Additionally, after the Performance Guarantee for decorative signs has been released, 3- Year Maintenance Guarantee will not be required as future maintenance will be the responsibility of the Developer /Owner/HOA. e. Interior Sidewalks (builders lot right of way sidewalks) f. Exterior Sidewalks (common area/perimeter road right of way sidewalks /asphalt paths). g. Right of Way Improvements may be bonded separately. This could include acceleration/deceleration lanes, passing blister, pavement widening, thermoplastic striping, stone shoulders, curbs, etc. h. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley, Engineering Department Stormwater Administrator, for details regarding engineer's estimates /performance guarantee requirements for these items. i. Please note that Storm Sewers and Monuments and Markers are under the bonding jurisdiction of the Hamilton County Surveyor who should be contacted directly regarding their requirements. j. Sanitary Sewers are under the jurisdiction of the Clay Township Regional Waste District (CTRWD) who likewise should be contacted directly regarding their requirements. 27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost of labor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes and materials, etc. 28. Upon completion and release of individual Performance Guarantees, a three -year Maintenance Guarantee will be required (see Street Sign comments above). The Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements. 29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. Mr. Eric W. Batt, P.E. April 24, 2007 RE: Towne Oak Estates Project Review #1 Page 4 of 8 30. Please reference the enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 31. Any work in the dedicated right of way of Towne Road will require an approved Right of Way Permit and a License Permit Bond. 32. The bond amount is determined by the number of instances of work in the right of way at $2,000.00 per instance. However, if the work is included in the scope of work of a required and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the bond requirements of the Right of Way Permit. 33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting and bonding. AVAILABILITY AND CONNECTION FEES 34. The Availability and Connections Fees are current as of this date but are subject to future revisions. 35. Availability (acreage) Fees must be paid after all other Engineering Department requirements have been satisfied and prior to approval and start of construction activities. Availability Fees are based upon total platted acreage or legal description acreage for the development at the current rate of $1,010.00 per acre for Water Availability. The legal description on the secondary plat submitted with these plans does not indicate the acreage. Please revise the legal description so that total acreage is stated. Based upon a rough calculation of the acreage, the following Availability Fees might apply: a. Water 18.745 Acres $1,010.00 /Acre $18,932.45 36. Connection Fees are paid when the infrastructure has been completed, satisfactory test results obtained and the development has been released for building permits. Connection Fees are paid on an individual -lot basis. Based on the drawings submitted, there appear to be 16 residential lots or 16.0 E.D.U.s a. The current Water Connection Fee is $1,310.00 per EDU. 37. If an entryway irrigation system, other community irrigation system, community swimming pool, community clubhouse or community bath house is planned for this development, additional Water Availability Fees and Water Connection Fees will be assessed based upon the size and usage of the system and upon the recommendations of the Director of Carmel Utilities. CONSTRUCTION DRAWING REVIEW COMMENTS 38. General Comments a. Given that the City has tentatively scheduled improvements to Towne Road across the frontage during the summer of 2007; the City is requesting that the acceleration and deceleration auxiliary lanes and associated gravel shoulder and sub surface drain not be constructed with this project. As these auxiliary lanes are required by Ordinance, the Department of Engineering cannot waive the requirement for their construction. In lieu of constructing the auxiliary lanes, the City is requesting a commitment equal to the cost to otherwise construct the auxiliary lanes, gravel shoulder and sub surface drain. b. Given that the City has tentatively scheduled improvements to Towne Road across the frontage during the summer of 2007; the City is requesting that the required passing blister and associated gravel shoulder and sub surface drain not be constructed with this project. As this passing blister is required by Ordinance (there is sufficient right -of -way on the west side of the roadway, the Department of Engineering cannot waive the requirement for its construction. In lieu of constructing the passing blister, the City is requesting a commitment equal to the cost to otherwise construct the passing blister, gravel shoulder and sub surface drain. c. Given that the City has tentatively scheduled improvements to Towne Road across the frontage during the summer of 2007; the City is requesting that the alternative Mr. Eric W. Batt, P.E. April 24, 2007 RE: Towne Oak Estates Project Review #1 Page 5 of 8 transportation multi -use path across the frontage not be constructed with this project. As this path is required by Ordinance, the Department of Engineering cannot waive the requirement for its construction. In lieu of constructing the path, the City is requesting a commitment equal to the cost to otherwise construct the asphalt path. If the cost for the path construction is already included in the formal commitments; then this additional commitment would not be required. d. Given that the City has tentatively scheduled improvements to Towne Road across the frontage during the summer of 2007; the City is rescinding the previous request for widening, gravel shoulder with sub surface drain adjacent to such widening, milling, resurfacing and re- striping of Towne Road across the frontage. No credit against the formal commitments may be claimed for this work. e. This project is subject to the City's Storm Water Manangement and Storm Water Quality Ordinances. f. Please provide the requisite storm water /drainage information required by Section 100 of the Storm Water Technical Standards Manual on the plan sheets. g. Please contact Amanda Foley to review storm water quality/treatment requirements. h. Please remove the landscape plan sheets and remove the titles of those sheets from the Index on the Cover Sheet. i. Please turn off the portions of the existing Towne Road driveways scheduled for demolition from Sheets C101 and C301. j. Any and all details and notes related to these auxiliary lanes may be deleted. Any and all details and notes related to this asphalt path may be deleted. k. The Drainage and Utility Easement overlaps the Landscaping Easement across the Towne Road frontage. Please revise such that these easements do not overlap. 1. Please provide a response to the following which represent comments related to the review of the Primary Plat for which a response was not received i. Is it possible to discharge the pond in one location? ii. What is the maximum surface elevation of the pond? How does this relate to the topography of the overall site? iii. What is limit of water storage on lot 9? iv. Will the covenants establish no -build restrictions within the gas pipe easements to restrict the construction of any above or below grade improvements? v. The dry detention pond must have 2% cross slopes or a SSD. m. The City will require copies of any agreements with the pipeline company prior to plan approval. 39. Sheet D101 a. Please review demolition activities with the urban forester. b. Please add a note that reads: "No earth disturbing activity may take place without an approved storm water management permit." c. Keynote 2. This note shall be revised to require demolition that conforms with City Code Section 6- 227(h)(10). d. How will the culvert under Towne Road be removed/abandoned? Please coordinate this work with the road project designer. 40. Sheets C101 a. Please revise Structures 109, 110, and 115 so that the Structures are not end sections. These structures must be inlets. Please coordinate the installation of Structure 110 and 115 with the future road project. Verify if the structures are needed in the short or long term to drain the right -of -way, to serve as an outlet for the City's roadway drainage system or both. Initial indication of the long -term need of Structure 115 would be as a discharge point of the roadway drainage system and may not need to act to drain surface runoff from the right -of -way. Initial indication of the long -term need of Structure 110 would be to serve as a discharge point of the roadway drainage system and to drain surface runoff from the right -of -way. Mr. Eric W. The half right -of -way is superimposed with an existing tree symbol. Please indicate the right -of -way label more clearly. d. The proposed driveway for Lot 16 scales to be approximately 22 -feet wide. Please revise such that each driveway is a maximum of 20 -feet wide at the throat within the right -of- way. The portion of the new driveways within the right -of -way for Lots 2 and 16 must conform to City Code Section 6- 227(a)(1); 6- 227(h)(6). e. Please indicate in the legend that the line type "F" represents the force main. f. Please add a note to each sheet that reads: "No earth disturbing activity may take place without an approved storm water management permit." g. Please delete the auxiliary lanes and extend the proposed roadway out to the existing edge of pavement. The interior curbing may end at the tangent of the future return radii of the road project. h. Please indicate the construction of the multi -use path by others and indicate at the future location per the road plans. i. General Note 4. Please revise "granular" to be specific and to reference City backfill standards. j. Thank you for relocating the entrance as previously discussed. The City will modify the current road plans to provide a median break; a southbound left turn lane and taper and the construction of the entrance within the right -of -way. There is an apparent conflict with the proposed entrance and the proposed road drainage system. The City will modify the road plans to address this conflict. k. The future drive culverts of Lots 2, 6, 7, 8, 9, 10 and 11 must be sized to convey the upstream watershed in accordance with the City's Storm Water Technical Standards. 1. Please confirm with the Clay Regional Waste District the need for a curb cut and small access drive for the lift station. m. Will the configuration of Structures 100 and 140 and 120, 130 and 135 result in short circuiting of any water quality desires? n. There does not appear to be adequate perimeter swales and infrastructure. Swales are not to exceed 300 -feet or 3 lots in length. Is there a direct discharge area to the south? The runoff from Lots 10 -13 must be treated. A swale appears necessary along the north side of Lots 1 -5 to direct off -site runoff so it does not flow across the Lots. o. Please add a note to the plans that all work in Towne Road shall be coordinated with the road project's contractor and in no wall shall interfere with the City's road project. p. The proposed improvements of the City's road project shall be indicated on the plans to identify potential conflicts. Please shade these improvements back and label `By Others q. This plan shall anticipate and accommodate the final grading of the road project and shall be constructed the same as if these road improvements were in place and the final grading were "existing r. Unless the force main system is to be owned and operated by the Clay Regional Waste District, construction of the force main will require an approved Consent -to- Encroach. The Consent -to- Encroach must stipulate an abandonment plan by the HOA. The City requires installation of the force main by boring or other trenchless method. The crossing angle needs to be as close to perpendicular as possible. s. Please identify the off -site route of the pond emergency overflow? Is the downstream system adequate to receive this flow? 41. Sheet C102. a. Please add a note to each sheet that reads: "No earth disturbing activity may take place without an approved storm water management permit." 42. Sheet C201 a. Please indicate the trunk line of the future road drainage system on the profile. b. Please revise the street profile as needed to account for the future Towne Road elevations. Mr. Eric W. Batt, P.E. Please indicate the back of curb to back of curb dimension. b. Please add a note as follows: "ANY PLANNED LANE RESTRICTIONS FOR MORE THAT 15 MINUTES REQUIRES 48 -HOUR NOTIFICATION TO THE CITY ENGINEER FOR PROPER NOTIFICATION TO EMERGENCY RESPONSE AGENCIES." c. Please update the Maintenance of Traffic plan for construction of the entrance only (no auxiliary lanes). d. Please revise General Note 4 to require an approved Right -of -Way permit and notification of the City of Carmel prior to commencing any work in the right -of -way of Towne Road. e. As no auxiliary lanes are to be constructed, please delete the "Towne Road Pavement Section" detail. 44. Sheet C401 a. Please add a minimum cover note conforming to the City Standards for lateral installations to this sheet. 45. Sheet C501 a. As previously stated, installation of the force main shall be by boring or other trenchless method. Please delete the granular backfill hatching. b. Please indicate the sub surface drain crossing on the profile. c. The design shall account for the future trunk line of the roadway drainage system. Please indicate the trunk line on the profile. 46. Sheet C601 and C602 a. Please add a minimum cover note conforming to the City Standards to each sheet. b. Is there a conflict with the roadway sub surface drains between Structures 121 and 122? 47. Sheet C701 a. Please add a minimum cover note conforming to the City Standards for lateral installations to this sheet. 48. Sheet C702 a. Please revise Note 3G to reference City Backfill Standards for granular material. 49. Sheet C801 a. Please replace Details 1, 2, 3 and 5 with the most current details from the City's website. b. Please delineate on the Development Plan where each different type of curb is to be installed. c. Detail 11. Please indicate 1 -inch ribbing as the tactile warning surface for the ADA ramps. d. Detail 9. Please indicate 50 -foot as a "maximum" joint spacing. Please also specify 5 -foot maximum spacing for contraction joints on radii. 50. Sheet C802 a. Please replace Detail 9 with the most current detail from the City's website. 51. Sheet C805 a. Please require Hancor Hi -Q double wall pipe, or equivalent, for Detail SSD -1. 52. Sheet C901 a. Earthwork Note 4 (A). Please confirm with Scott Brewer that this language is satisfactory. b. Sanitary Sewer Note F (8). Please revise to specify backfill per City Backfill Standards. c. Storm Sewers Notes 2 (A) and 2 (B). Please ensure that the material specifications meet or exceed the material specifications outlined in the Storm Water Technical Standards Manual. d. The proposed project falls in the incorporated area and MS4 jurisdiction of the City of Carmel 2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone. 3. The proposed project drains thru the Clay Creek Regulated Drain and is therefore in the Regulated Drain Watershed. 4. This proposed development will be a Hamilton County Regulated Drain Subdivision. 5. Please submit the following procedural items with the revised construction plans to this office, petition for regulated drain subdivision, subdivision non- enforcement agreement, outlet permit (to Clay Creek Drain), engineer's estim.ate, and all associated bonds for 120% of construction cost. The bonds will need to cover storm sewers, SSD, and Monumentation. Hamilton County Ordinance 4- 26- 99 -C(2)e does not allow outlets to directly discharge onto the ground as surface flow. The site outlet will need to extend to a regulated drain or natural watercourse. Contact with Brenwick and my opinion from Hamilton County Parks Department is that neither adjoining property owner is acceptable with the direct discharge onto their. property. 7. If structures in Village of West Clay or Coxhall Parks and Gardens are utilized for the site outlet, the capacity of the existing structures will need to be verified in the drainage calculations before the outlet can be ruled acceptable. 8. Hamilton County Ordinance 4- 26- 99 -C(7)c and Carmel Stormwater Technical Standards Manual Section 302.06 -10 prohibits dry detention areas from being located on residential lots, even if covered by easement. 9. Why does the site have 2 separate outlet points? While is does allow developed conditions to mimic pre developed conditions, it is allowing the site to exceed the allowable release rates via 2 6" orifices. 10. Hamilton County Ordinance 4- 26- 99 -C(7)c requires SSD with a free positive outlet in the bottom of the dry detention basin to keep the bottom dry. Additional information can be found in the HCSTSM, Section 302.07. 1L It appears the SSD might conflict with the storm sewer where it crosses between Str. 121 and 122_ Please show the SSD on the storm sewer. l' P sheets so the conflict can be avoided. 12. Why is basin Direct South a direct runoff basin when it has a storm pipe running through the basin and is capable of collecting a portion of the basin discharge? 13. The total post developed discharge from the site must be less then the allowable release rate times the acreage.
