HomeMy WebLinkAboutMinutes Sub 07-02-021,1`I y G`'`y of Cq,9y C ity CARMEL /CLAY PLAN COMMISSION SUBDIVISION COMMITTEE JULY 2 The regularly scheduled meeting of the Subdivision Committee convened at 7:00 PM in the Caucus Rooms of City Hall, Carmel, Indiana. Members present were: Dave Cremeans, chairperson; Wayne Haney; Ron Houck; Norma Meighen; Maureen Pearson; and Dan Dutcher, thereby establishing a quorum. Laurence Lillig was in attendance representing the Department of Community Services. The following item was under consideration: 1. Docket No. 64 -02 Z; Rezone of Dixie Hi -Way Addition, Lot 8 the west half of Lot 9 The petitioner seeks to rezone one and one -half lots from the R -3/ Residence District within the Home Place District Overlay Zone to the B -1 /Business District within the Home Place District Overlay Zone. The site is located at 10820 North College Avenue. The site is zoned R -3 /Residence within the Home Place District Overlay Zone. Filed by Leonard Voight. Leonard Voight, 14928 Pacer Court, Carmel, appeared before the Committee requesting a rezone of Lot 8 and the west half of Lot 9 from the R -3 /Residence District within the Home Place District Overlay Zone to the B -1 /Business District. There is commercial property to the north and south of the site, the library, and the fire station. The property has an existing gravel driveway, impervious to rain. Mr. Voight maintains a good relationship with the neighbors. The purpose of the rezone is to protect the subject property from immin two family residential development consistent with the existing R -3 /Residence zoning. The property falls within the Home Place District Overlay Zone. Under the existing zoning, within the Home Place Overlay, the residential use would be permitted regardless of the Home Place Business District sub- classification. What this accomplishes is protection of the integrity of the Comprehensive Plan with respect to the Business District, with an eye toward future commercial redevelopment of this property. This, in effect, is a "half -way" measure. S:P1anCommission\ Minutes \SubdivisionCommittee \2002ju1 1 The petitioner is not proposing any site improvements at this time beyond the paving of the drive. It is the desire of the petitioner to receive an indication from the Commission as to whether, knowing that he will be requesting Development Standards Variances regarding Home Place Overlay requirements, they would be supportive of those requests through the DP /ADLS and DSV processes through the Commission and Board. If the Commission does not support the intent of this rezone, then the petitioner would like to know at this time, so that he does not pursue the matter fruitlessly. Mr. Houck expressed reservations regarding the granting of Development Standards Variances for the site in perpetuity. He asked whether it would be possible to place a time limit on the subsequent Development Plan approval. Mr. Lillig stated he did not believe a time limit could be imposed on the Development Plan itself, but the Board of Zoning Appeals could place a time limit on the approval of any required Development Standards Variances. Mr. Cremeans and Mr. Houck briefly discussed whether a time limit was appropriate at all, and ultimately reached a consensus that the Commission recommend to the Board that a five -year time limit be placed on any Development Standards Variances sought by the petitioner for this property. Discussion of the nature of the proposed use led to the conclusion that it would be regarded as a Medical Office use, rather than a Medical Laboratory. A change from that use would be weighed pursuant to Section 23E.2: Commission Approval regarding compliance with the Overlay requirements. Mr. Lillig inquired as to whether there was any development on the west half of Lot 9 at this time. Mr. Voight responded that there was nothing on that portion of the site, and nothing is being proposed at this time. Ron Houck moved to forward Docket No. 64 -02 Z, Rezone of Dixie Hi -Way Addition, Lot 8 and the west half of Lot 9, back to the Plan Commission with a Favorable recommendation, and with a recommendation to the Board of Zoning Appeals that any Developmental Standards Variances be approved with a five -year time limit. Following a second by Pat Rice, the vote was six (6) in favor, zero (0) opposed. There being no further business to come before the Committee, the meeting was adjourned at 7:40 P.M.
